[2:07] growth of our
[2:08] uh city.
[2:10] We thank you for the ones who are here

[2:13] Lord, and
[2:14] and the ones who desired to be here

[2:34] >> Pledge.
[2:36] >> I pledge allegiance to the flag
[2:39] of the United States of America, and to
[2:41] the republic for which it stands, one
[2:45] nation under God, indivisible, with
[2:49] liberty and justice for all.
[2:56] >> Once again, good evening, everyone. So
[2:58] glad that you chose to join us today.
[3:01] In case you haven't realized, we are at
[3:03] the city council

[3:09] And on our agenda today, we're like to

[3:19] with us today.
[3:21] And at this time, I take such a
[3:23] item of comments from audience of
[3:25] council, and we just read it for good
[3:27] measure. At this time, anyone will be
[3:30] allowed to speak on city-related
[3:32] matters only. No personal matters or
[3:35] matters under litigation will be
[3:37] allowed. The length of time may not
[3:39] exceed 3 minutes. No council discussion
[3:42] or action may take place on a matter
[3:45] until such matter has been placed on an
[3:48] agenda and posted in accordance with
[3:51] law. With that being said, I don't think
[3:53] we have any from the audience. Do the
[3:55] council have any statements related to
[3:57] the agenda items?
[4:00] >> Uh no. No.
[4:01] Well, I just want to just uh
[4:03] thank uh Mr. [name] uh for being with
[4:06] us and
[4:07] and
[4:09] working with us.
[4:11] Uh just want to appreciate him and uh
[4:13] just let him know that um
[4:17] I I was
[4:18] uh
[4:19] glad to
[4:21] to uh have known you, to work with you.
[4:25] Um and I know that your heart was for
[4:27] the city.
[4:28] Um and I just wish you good
[4:31] um
[4:32] good tidings and the best
[4:34] um
[4:37] the rest of your tenure or your years uh
[4:40] to come.
[4:41] >> Thank you. Thank you.
[4:43] Are there any other comments?
[4:45] If not, that brings us to item number
[4:48] one, regular session. Approve of minutes
[4:50] for the regular session, February 2nd,
[4:53] second,
[4:54] 2026.
[4:57] >> I'll make a motion to approve.
[4:58] >> I second.
[4:59] >> Okay, it's been moved and second. Any
[5:01] discussion? All in favor?
[5:04] Motion carries.
[5:06] It brings us to the item of reports,
[5:08] item number two, police department
[5:10] manpower power and criminal incident
[5:13] report for January 2026.
[5:16] Chief.
[5:18] >> Good evening, mayor, council, city
[5:20] administrator.
[5:21] Cracked Police Department's manpower and
[5:22] criminal activity report for January of
[5:25] 2026.
[5:26] Have 15 officers, worked 2,390
[5:30] hours, responded to 407 calls for
[5:33] service, investigated nine traffic
[5:35] accidents,
[5:37] made 25 arrests, issued 351 traffic
[5:41] citations,
[5:42] completed 57 reports, and responded to
[5:44] 11 alarm calls. Nine of those were false
[5:47] alarm. Below you'll see a breakdown and
[5:50] I'll entertain any questions you have on
[5:51] our monthly report.
[5:55] >> Council.
[5:57] Uh only question I have on the on the
[5:59] report, I just saw it at the very bottom
[6:01] where it said comments about uh the
[6:05] warrant warrant services. Do we receive
[6:08] Are there any fees added to the
[6:11] the warrant services? What is
[6:13] >> So, warrant services, those are someone
[6:15] has an outstanding criminal warrant for
[6:17] their arrest.
[6:18] Um
[6:19] we we pick them up on them. So, no,
[6:21] there's no fees that we charge and those
[6:22] come down from the courts or the judges
[6:25] on a criminal offense or a traffic
[6:27] citation.
[6:29] Um then we we make those arrests on
[6:31] those.
[6:31] >> Okay. I was just cuz I was wondering
[6:33] were there any fees uh encountered
[6:35] there?
[6:37] >> Are there any more questions?
[6:40] >> Thank you.
[6:41] >> No.
[6:42] Thank you, Chief. Thank you.
[6:43] >> Appreciate you.
[6:45] >> I guess
[6:47] >> Oh, I forgot we going to send you away
[6:48] before you do your pro sign. Number two,
[6:50] I mean number three. Got to read it for
[6:52] you. Presentation [snorts] of annual
[6:54] racial profiling report.
[6:58] >> Council, Mayor, this is our annual
[7:00] racial racial profiling report. We give
[7:02] it pretty much the same time every year.
[7:05] This is from January of 2025 through
[7:07] December 31st of 2025. As you all know,
[7:10] this is required by the state that we
[7:13] we publicize this every year and we have
[7:15] to turn this report in to the state as
[7:17] well.
[7:18] Uh so, I'll I'll start with
[7:20] [clears throat] a breakdown.
[7:22] African American
[7:23] 639 male
[7:26] 441 females for a total of 1,080.
[7:31] Asian Pacific Islander males 63
[7:35] female 24 for a total of 87.
[7:39] White
[7:40] male 1,441
[7:43] female 932.
[7:46] For a total of 2,000
[7:48] 3,373.
[7:51] Hispanic, male, 519.
[7:55] Female, 190. For a total of 709.
[7:59] Native America,
[8:01] male, 12.
[8:03] Female, four. For a total of 16.
[8:07] For the totals, uh 2,674
[8:10] males.
[8:12] 1,591
[8:13] females. For a total of 4,265.
[8:17] Below that, you'll see a breakdown.
[8:20] Um
[8:20] few that I'll go through. Uh location of
[8:23] the stop. Uh on a city street, 1,050.
[8:28] Uh US Highway, 112.
[8:31] State Highway, 2,886.
[8:35] County Road, five.
[8:37] And private property or other, 212.
[8:41] Uh also,
[8:43] we'll break down uh search.
[8:46] Uh reason for the search, consent, 51.
[8:50] Contraband in plain view, 17.
[8:53] Probable cause, 87.
[8:56] Inventory, 19. And incident to arrest,
[8:59] two.
[9:01] Um below that, you'll see race known
[9:03] prior to stop.
[9:05] Uh
[9:09] 3,489,
[9:11] no.
[9:12] Uh searches conducted,
[9:14] 176.
[9:17] And did not conduct a search, 4,089.
[9:21] Contraband discovered,
[9:23] out of 176
[9:25] searches, discovered contraband 116
[9:28] times. Uh 60 of those times, uh did not.
[9:33] I'll entertain any questions you have on
[9:35] the rest of the racial profiling report.
[9:39] >> See, I I do have a question because I'm
[9:40] juvenile justice major.
[9:42] And uh I was just I was just looking at
[9:44] this and just kind of trying to get a
[9:46] feel of like how we could figure out if
[9:49] there was any racial profiling going on.
[9:52] Because like when you have like the uh
[9:54] subjects like reason for stop and
[9:56] contraband, things such as that, there's
[9:59] no indication of the race
[10:02] um or gender of the these stops that
[10:06] were actually made. So, I know you have
[10:09] them at the top that gives us a a
[10:11] breakdown, but you have a breakdown in
[10:13] the subject
[10:15] um
[10:17] but we don't know like how many people
[10:19] you uh gave tickets to, and were they
[10:21] female, were they male, were they
[10:24] you know, black, white, you know,
[10:26] Caucasian, Hispanic, things like that.
[10:29] So, that
[10:30] just looking at that to me doesn't help
[10:33] me decide whether there's racial
[10:36] profiling going on just looking at the
[10:38] numbers. So, how do I mean, reporting to
[10:42] the state, how does that actually work?
[10:43] Do they look at any of that or
[10:45] >> So, so the first thing I want to say is
[10:47] uh I can answer your question. There is
[10:49] no racial profiling going on as as
[10:51] presented by this report. The way the
[10:53] state breaks down racial profiling has
[10:55] to do with traffic stops conducted. It
[10:56] has nothing to do with searches incident
[10:59] to arrest. It's specifically
[11:01] are we stopping more Hispanics than
[11:04] white, more blacks than white, more
[11:07] white than black, vice versa. Uh that's
[11:10] the basis of racial profiling. If if
[11:13] we're profiling a particular race more
[11:15] than another. So, that that's that's
[11:18] where your racial profiling report comes
[11:20] from. Uh the state does not require and
[11:22] does not ask that it's broke down
[11:25] um
[11:25] where we searched uh
[11:28] 300 white people, 350 black people, 200
[11:32] Hispanics. They don't ask that. Now, the
[11:34] citations
[11:36] obviously, you can go back and look at
[11:37] those citations and you can tell from
[11:40] the information on that citation whether
[11:43] that person was was searched or not. So,
[11:46] that information is is not
[11:49] presented in the report. That
[11:51] information is available, but that
[11:53] information would take some time to
[11:54] compile a list
[11:56] to to to put that out for you.
[11:59] >> Yeah, the reason I ask is because like I
[12:00] just said, say for instance, just say
[12:02] like, you know, written warnings, you
[12:04] know, like the result of stops, like
[12:06] where it states written warnings,
[12:08] we don't know
[12:10] who those written warnings were given to
[12:12] or and not just that, you have like at
[12:15] the very bottom you have like the use of
[12:17] force resulting in bodily injury. We
[12:20] don't know if that was a
[12:22] employee or
[12:23] the violator or if they were male or
[12:26] female, black or white, Hispanic or
[12:29] Caucasian. So, we I mean, those are the
[12:30] things that I just when I looked over
[12:32] your your report, that's what I I I
[12:35] looked for.
[12:36] >> So, if you if you ever have a specific
[12:38] question about a stop, obviously, you
[12:40] know, I can be contacted. The reason
[12:42] they don't put all that specific
[12:44] information is you're talking about a 3
[12:46] to 5,000 page document and the state
[12:49] cannot accept that. So,
[12:51] that information there is loaded into
[12:54] the system, so there's there's no way to
[12:57] not have that available. It's just going
[12:59] to take time to to present something
[13:01] like that.
[13:02] But, as I told you,
[13:05] that's not a practice that we conduct at
[13:06] Crockett Police Department, so
[13:09] >> Yes, sir.
[13:10] >> I I want to congratulate and thank you
[13:12] for
[13:15] what what y'all do. I mean, I don't know
[13:17] how
[13:19] you can bring race into this when
[13:21] there's 1,293
[13:25] white people
[13:28] pulled over
[13:31] than any other race.
[13:35] So, how how can you bring race into
[13:37] this? So,
[13:39] I mean, you you you have a
[13:42] 3,524
[13:45] moving violations.
[13:47] It shouldn't matter if they're white,
[13:49] black, Hispanic, or what if they're
[13:51] breaking the law, they should be pulled
[13:53] over. It don't matter.
[13:56] And and it and it clearly see I can see
[13:59] right here there's 1,293
[14:01] more white than anybody.
[14:04] So, how
[14:07] Thank you.
[14:08] Thank you.
[14:09] For what you do.
[14:10] >> Thank you.
[14:11] >> Thank you.
[14:11] >> For what you do.
[14:13] Appreciate it.
[14:16] >> Okay, and that brings us to item number
[14:18] four, fire department monthly activity
[14:20] [clears throat] status report for
[14:22] January 2026.
[14:23] >> Good evening, mayor and council members.
[14:26] For the month of January, the fire
[14:27] department had a total of 49 calls.
[14:29] Breaking those down, 31 of those was in
[14:31] the city of Crockett with only one
[14:33] structure fire, and then 18 in our
[14:36] county response area. If you note,
[14:38] there's a couple errors on my report
[14:40] when I swapped from
[14:42] 25 to 26. Uh I think some of my
[14:45] calculations got off, but far as January
[14:47] going down that column, everything's
[14:48] correct. I think it threw an extra
[14:50] number at the end, and uh
[14:53] um only year-to-date, but everything's
[14:55] correct far as January all the way down
[14:58] that column.
[15:00] And then uh the very back page, there
[15:02] was an error that I need to correct. Uh
[15:05] it said there was 200 firefighter
[15:07] fatalities. That's
[15:09] I wish I had 200 firefighters,
[15:10] [laughter] but I definitely don't want
[15:11] that to happen to them, but
[15:13] um that was just my overseeing me
[15:15] changing form from 20 25 to 26. Some of
[15:18] my calculations got off that I I catch,
[15:20] and I thank uh
[15:22] Miss
[15:22] [name] for bringing some of that up that
[15:24] I didn't catch. So,
[15:26] the
[15:27] far as that, that's the report. Are
[15:29] there any questions on that? There's a
[15:31] further breakdown ball by ball.
[15:35] >> I do have a
[15:36] Well, I do have another question. Uh we
[15:38] did have a a fire on Stokes Street uh a
[15:41] little bit ago. And so, I was just
[15:43] inquiring about one of the the fire
[15:45] hydrants. When you got there, were one
[15:48] of them not working or
[15:49] >> No, that one's just a little further
[15:50] away.
[15:52] So, the deal is um
[15:54] we carry extra You know, we got 1,000 ft
[15:56] of fire hose. That lay was just a normal
[15:59] normal this
[16:01] the fire hydrant's not at every block
[16:02] block like it is in big cities in
[16:04] Crockett. So, sometimes it's two blocks
[16:06] to a fire hydrants.
[16:07] >> Okay.
[16:07] >> And um I I will give command or
[16:10] commandment on the public works. He has
[16:12] reached out to me and asked me for uh
[16:14] ideas of putting in new fire hydrants at
[16:17] at certain places I know we need them in
[16:19] town.
[16:19] >> Mhm.
[16:20] >> And um so, I'm working with uh him to
[16:22] put try to get them every block. It's
[16:24] going to take time, but there are some
[16:26] fire hydrants that been decommissioned
[16:29] because of some of the water lines used
[16:30] to be a 2-in line. Now, it's a a 4-in or
[16:33] 6-in line. And there's some some of the
[16:35] old fire hydrants that has been
[16:37] decommissioned, but we're trying to get
[16:39] those put back in place where to uh
[16:42] to meet that need.
[16:44] But, we do bring when we show up, we're
[16:46] bringing initially 1,000 gallons of
[16:47] water. And then we hook into a fire
[16:50] hydrant
[16:51] um
[16:52] and to get to continue on our fighting
[16:54] fire. So,
[16:56] >> I appreciate that. I I was also cuz I
[16:58] went and kind of rode the streets a
[16:59] little bit around where Sycamore and Oak
[17:02] Street bind in that area. And I was kind
[17:05] of concerned with those houses if they
[17:07] they caught on fire, would we be able to
[17:08] be be able to get the the big truck
[17:10] there or how do we s-
[17:13] >> Uh it's funny you bring that up. We we
[17:15] We get delivery of our new fire truck
[17:17] that y'all approved a couple of years
[17:18] ago. It finally showed up. It's still a
[17:20] couple weeks before it's going in. And
[17:22] this truck is a little bit shorter than
[17:23] our first one. So, we can make those
[17:25] tight turns instead of pulling up,
[17:27] backing up, pulling up, backing up to
[17:28] make some of these This new truck is
[17:30] 30-ft long, where the other one's like
[17:31] right at 40-ft. So, we're saving about
[17:34] 10-ft off that truck. Uh
[17:36] we did get that new truck in, but it's
[17:38] going to probably be another couple
[17:40] weeks before we get it into service cuz
[17:42] we try to save the city money. We do a
[17:43] lot of putting the tools on there
[17:45] ourselves, mounting everything, loading
[17:46] the hose. So, uh
[17:49] we should see that to go uh into service
[17:51] in the next couple of weeks. And it is
[17:52] shorter and it'll it'll definitely be
[17:54] easier to making these turns, some of
[17:56] these small city streets.
[17:58] So,
[17:59] um and also I'd like to report we did
[18:01] receive a $10,000 uh training grant from
[18:04] the Texas Forest Service.
[18:06] Um so, that'll be no cost to the city.
[18:08] We'll get to spend $10,000 towards uh
[18:11] training stuff, whether that's
[18:12] continuing CE
[18:14] or coming up with training props that we
[18:16] can use to train at the station. So, we
[18:18] did get Let y'all know we did receive
[18:20] $10,000 in Well, I'll be buying that
[18:23] stuff within the next couple of months
[18:25] just to fulfill that grant.
[18:28] >> Thank you.
[18:29] >> Thank you.
[18:29] >> Thank you for sharing.
[18:32] >> Okay, that bring us item number five,
[18:34] considering approve change order number
[18:36] six final for the 2022 state
[18:40] infrastructure bank SIB street project.
[18:44] >> Mayor and council, this is the the final
[18:46] change order. Mr. Bob Thurber's here
[18:49] with KSA that'll kind of go over and
[18:51] explain the the final change order to
[18:54] you and
[18:55] answer [snorts] any questions about the
[18:57] the final change order.
[19:00] >> Thank you, Mayor, and members of the
[19:01] council.
[19:02] Mr. City Administrator, we got the
[19:05] uh we've finally come into a conclusion
[19:06] on our street project. When we
[19:08] originally bid this project, it was
[19:10] coming at $6.6 million.
[19:13] Uh of course, we didn't have a total of
[19:14] $6 million for construction,
[19:16] engineering, and construction admin and
[19:18] all that thing.
[19:20] So, the first change order and second
[19:22] change order reduced the the contract
[19:24] down to 5.007
[19:26] million.
[19:28] During the course of construction, of
[19:29] course,
[19:30] uh
[19:31] especially on the waterline side, we run
[19:33] into situations where
[19:35] uh we don't know where the waterline is
[19:36] exactly. Uh we run into situations where
[19:40] uh when we're working on a line trying
[19:41] to tie into it,
[19:43] uh
[19:44] there there's no way to shut the water
[19:46] off. And so, it's hard for the
[19:47] contractors to to work uh live in a live
[19:51] situation.
[19:52] So, we had change orders more on the
[19:54] water side. We added certain things
[19:57] called insertable valves, where you have
[19:59] to do a a special valve that are very
[20:02] expensive. They're like
[20:04] like a 6-in is 10,000. 8-in is like
[20:07] uh 13 or 14,000.
[20:10] Uh we had to change sides of streets
[20:11] because there was unknown lines in
[20:13] sometimes.
[20:15] Uh
[20:16] we also had some uh base failures. We
[20:18] had that on South Grace Street.
[20:21] Uh we also run into at Bell and Fifth
[20:23] Street
[20:25] uh
[20:25] where we collapsed the a sewer line. I
[20:27] don't know if it was a sewer line or a
[20:28] storm sewer line.
[20:30] Uh the bottom line is uh
[20:32] from the
[20:33] after change order one,
[20:35] 5.007,
[20:38] uh we have an increase in quantities in
[20:40] these unknown situations.
[20:43] And so, our drive-out price is about
[20:44] $5.2 million, Mayor.
[20:47] So,
[20:48] uh
[20:49] we're planning on having a a general
[20:51] walk-through
[20:52] uh this coming Thursday. We're going to
[20:54] drive all the streets
[20:55] uh to make everything uh sure everything
[20:57] is okay. We'll note any deficiencies or
[20:59] anything like that, and we'll document
[21:01] that as well.
[21:02] So, with that, Mayor, uh
[21:04] if there's any questions that answer,
[21:05] I'd be happy to try to do that.
[21:11] Overall, I think it's a fairly
[21:13] successful project.
[21:14] One interesting thing we found we found
[21:17] a valve, excuse me, a tee that was dated
[21:19] in 1901.
[21:20] >> Wow.
[21:21] >> [laughter]
[21:22] >> That was on Bowie, was it?
[21:24] >> Do what?
[21:24] >> Was that on Bowie or Fifth Street? Was
[21:26] that on Bowie or Fifth Street?
[21:27] >> No, it was not on Bowie. It was on uh
[21:29] Fifth Street, I believe.
[21:30] >> Mhm.
[21:31] I was over you made two changes on one
[21:34] on Bowie and one on Fifth Street.
[21:35] >> Mhm.
[21:36] >> Mhm.
[21:41] >> Question.
[21:42] >> [clears throat]
[21:44] >> No question.
[21:44] >> Um did you have something to do?
[21:46] I I I just um there was two streets I
[21:49] was going to ask and I I don't know who
[21:50] I need to ask, but I was wanting to know
[21:53] uh I know you what you have on uh change
[21:57] order number three, we have Bank and
[21:59] Fair Street.
[22:00] >> Yes, ma'am.
[22:01] >> And so um mine stand is like SIB street,
[22:04] so that was those were SIB approved.
[22:08] >> No, it wasn't, but let me tell you what
[22:09] we did. We didn't do that change order.
[22:12] And that's reflected in this change
[22:13] order. The reason we didn't do that
[22:15] change order was because the city forces
[22:17] did that by themselves. They were
[22:18] private lines.
[22:20] Uh we found out that the lines were not
[22:23] serving
[22:24] >> Mhm.
[22:25] >> uh from the front side of the street.
[22:26] >> Mhm.
[22:27] >> And so we had to But the city went in I
[22:29] think it's $34,000 worth of
[22:31] number three work.
[22:32] Uh but anyway, the city's
[22:34] uh forces did that on their own, so the
[22:36] number three was actually deleted.
[22:38] >> Okay.
[22:40] So, we just found out where we got that
[22:42] money from.
[22:44] Okay.
[22:45] Okay. That's That's um
[22:48] That's And then um
[22:50] uh the uh
[22:52] I guess I need to ask about like the MLK
[22:55] Street um
[22:57] the from West Goliad West West Bale
[23:02] from West Bell to
[23:05] um Goliad, I believe.
[23:07] >> Which one?
[23:08] >> West Bell to Goliad?
[23:11] Or MLK?
[23:13] Are you familiar?
[23:14] >> No, I don't I don't think that was in
[23:15] the original deal, if I'm not mistaken.
[23:18] I'd have to go back and look at that.
[23:19] >> Okay.
[23:19] >> It was.
[23:20] >> Uh TxDOT
[23:21] furnished us,
[23:23] you know,
[23:24] a map that showed the eligible streets.
[23:26] >> Okay.
[23:26] >> So, I'm not sure if that was eligible.
[23:28] But, the other thing was is
[23:30] the budget considerations.
[23:32] Um you know, we do when we do a design
[23:34] project, uh
[23:35] periodic times we put together an
[23:37] estimate of what we think this thing is
[23:38] going to cost.
[23:40] And
[23:41] >> [snorts]
[23:41] >> but from my standpoint, I was directed
[23:43] to do
[23:45] uh Bell Street to where we uh stopped
[23:47] the other project on MLK.
[23:50] >> Okay.
[23:54] Okay.
[23:56] >> Is it it?
[23:57] >> All right. Yes, I I would love to I just
[24:00] wanted you to take I would love when you
[24:02] come down to review the streets um
[24:05] to do your last final check, I would
[24:07] like to ride with you, if you don't
[24:08] mind.
[24:09] >> Okay.
[24:09] >> I appreciate it.
[24:10] >> I think we've got a big enough truck we
[24:11] can we can pile in. I think I've got the
[24:13] contractor and
[24:15] uh and myself and [name] probably leave
[24:18] will be going and we can stop and look
[24:20] at any streets we want to look at.
[24:21] >> Okay. Perfect.
[24:24] Okay.
[24:25] >> Any other questions?
[24:25] >> have any?
[24:27] >> Just need a motion to approve the
[24:30] >> I'll make a motion to approve.
[24:31] >> I'll second.
[24:33] >> It has been moved and seconded. Any
[24:34] discussion?
[24:36] All in favor.
[24:39] Opposed.
[24:41] Motion carried.
[24:44] I approve.
[24:45] >> I think Thank you, Mr. Thurber.
[24:46] >> We're going to try to meet about 1:00 on
[24:47] Thursday.
[24:48] >> Sir?
[24:48] >> We're going to try to meet about 1:00 on
[24:50] Thursday for driving the streets.
[24:52] >> Okay, this coming Thursday?
[24:53] >> Yes, ma'am.
[24:54] >> Okay, yes, sir.
[24:54] >> And I'll be processing the the final pay
[24:56] request, which holds the retainage only.
[25:00] And so, I'll get that out tomorrow and
[25:02] then after we have the walk-through and
[25:03] everything like that, the city can sign
[25:05] off on it. One important thing to
[25:07] remember is we do have a warranty period
[25:10] for the construction.
[25:14] Thank you, Mayor.
[25:15] >> Thank you so much. Appreciate it.
[25:16] Item number six, consider and approve an
[25:19] ordinance number 0-02B-26
[25:23] amending the fiscal year 2026 budget for
[25:26] the purchase of an excavator
[25:29] for the street department.
[25:31] >> Mayor and council, it's two parts.
[25:33] You'll see the ordinance for the budget
[25:36] amendment
[25:37] and it just basically says that
[25:39] the two sales of assets from the surplus
[25:43] that y'all declared surplus raised
[25:45] $80,077
[25:48] and we had insurance proceeds from a
[25:51] a truck fire that was 5218
[25:54] with a total revenue of 85,295.
[25:58] And then the next page you'll see the
[25:59] consolidated water has
[26:02] a Takeuchi
[26:04] excavator that they're no longer using.
[26:06] It's too small for them. It's basically
[26:09] a brand new excavator with 389 hours
[26:11] they're going to sell to the city
[26:13] because of
[26:14] our work together at that price when if
[26:17] you went to buy a new one, it's 142,000.
[26:20] So, you're basically approving the
[26:22] budget amendment
[26:24] for the proceeds and purchase of the
[26:27] Takeuchi track hoe excavator.
[26:31] >> Okay, two things on that. I I have one
[26:33] thing.
[26:34] >> Um if is there a time to make a motion
[26:36] so we
[26:36] >> Yeah, we need a motion before
[26:37] discussion.
[26:38] >> Well, I I I move to strike section two
[26:40] and section three in ordinance number
[26:43] uh 0-02B-26.
[26:53] That's fine. one.
[27:03] >> I said section 3 and 3.
[27:05] >> Yes, on the on the on page 18.
[27:07] >> That's where we said it.
[27:09] >> Okay, uh
[27:14] Did we vote it for?
[27:15] >> No, you asked for a second. See if
[27:17] somebody seconds it first.
[27:18] >> Okay.
[27:19] >> I'll make a motion to purchase.
[27:21] >> And
[27:22] >> I second.
[27:24] >> Okay, it's been moved and second. Hold
[27:26] on, no. Was that my motion?
[27:28] >> No.
[27:29] >> You know, it was we were we on this was
[27:31] >> Okay, we need to go back and if you
[27:33] don't get a second on yours, it needs to
[27:35] die for a lack of second.
[27:38] So, ask if there was a second to her
[27:40] motion.
[27:42] >> Yeah. Was it Was it a second to her
[27:44] motion?
[27:45] >> No.
[27:45] >> And that's why I said it wasn't one.
[27:47] >> No. So, now you
[27:48] >> And then we vote
[27:50] >> the original.
[27:51] >> Now, the original motion is to approve
[27:53] the ordinance change or the budget
[27:55] amendment and the purchase.
[27:57] >> And he's making a motion.
[27:58] >> He made that motion.
[27:59] >> Mr. [name] second.
[28:00] >> second.
[28:01] >> And now it's all in favor.
[28:03] And now it's discussion, yes.
[28:04] >> to discuss it.
[28:06] Um what I want to ask is um
[28:09] do we have the money to purchase this
[28:12] this item?
[28:13] >> Yes, ma'am.
[28:14] That's why the budget amendment was
[28:16] first because we had the sale of the
[28:17] proceeds from surplus which raised
[28:20] 80,077
[28:22] dollars.
[28:23] The insurance proceeds came up with the
[28:25] other 5,000 and the purchase price of
[28:27] the excavators 85. So, we're That's
[28:30] where the money came from and that's
[28:32] where it's going to.
[28:33] >> Okay, so on from a sale of a
[28:35] >> Yes, on the sale of the the two sales
[28:37] that we had for surplus items.
[28:39] >> So, my understanding, I don't know, but
[28:41] in one of the trainings I attended, it
[28:44] said that we You not supposed to amend
[28:46] budgets
[28:47] just for purchase of items.
[28:49] >> Is that true or not?
[28:50] >> No,
[28:51] I'm not aware of that.
[28:54] And part of the deal is as we've talked
[28:56] about in the past that
[28:59] we want to do these budget amendments as
[29:00] they happen, making it all transparent,
[29:03] bringing everything where the money's
[29:05] coming from, where the money's going to,
[29:07] and that's what we're doing with this
[29:09] ordinance budget amendment. And it is by
[29:11] [clears throat] ordinance, not
[29:12] resolution, that we're doing the budget
[29:14] amendment, and we're purchasing the
[29:16] excavator.
[29:17] >> So even by ordinance or resolution, if
[29:19] the state state makes a statement that
[29:22] amendments are not to be done to make
[29:25] purchases?
[29:26] >> I
[29:27] I've never heard that.
[29:28] >> Okay. I mean, well, I'll I'll I'll
[29:30] verify that. I'll make sure because I
[29:32] know I I just took a train. I just had
[29:35] me
[29:36] I'll have to look back at my notes to
[29:37] make sure. I I'll call a hearing well at
[29:40] >> [name], [name], would there be anything put on
[29:42] this one?
[29:46] This uh
[29:47] paper right here
[29:49] if we didn't have the money to buy it?
[29:51] >> Absolutely not.
[29:51] >> Okay.
[29:53] I move on the previous question.
[29:56] Okay, so
[29:58] Okay, so
[29:59] >> previous question first.
[30:01] All those in favor of the previous
[30:02] question.
[30:03] >> All yeah. All of those that are in
[30:04] favor.
[30:07] Okay, you have passed.
[30:09] >> Now vote on the motion
[30:10] the approval of the budget amendment and
[30:13] the purchase.
[30:13] >> I was not in favor.
[30:16] >> Okay.
[30:18] All those in all in favor of the budget
[30:22] amendment.
[30:23] >> All in favor?
[30:24] >> All in favor. In favor.
[30:26] Now opposed.
[30:27] >> All opposed.
[30:30] Okay, so the motion
[30:32] carries, right?
[30:40] I kind of lost my
[30:45] Okay, so we've
[30:47] finished with both of them, right?
[30:49] And
[30:50] that brings us to item number seven.
[30:54] Consider and approve a resolution for
[30:55] the temporary close of state
[30:57] right-of-way for Alamo letter letter
[31:01] plaque ceremony.
[31:02] >> Mayor and council, we have
[31:04] representatives here that we're going to
[31:06] speak on behalf of the the Travis
[31:08] letter.
[31:11] >> Good evening, mayor, council, city
[31:12] administrator.
[31:13] Thank you for considering our
[31:15] request to close down Fifth Street. We
[31:17] are we will be dedicating on March the
[31:19] 2nd
[31:20] a plaque and monument on the courthouse
[31:23] lawn of the Travis letter public the
[31:25] Travis letter plaque the Alamo letter
[31:27] plaque. The the letter that William
[31:29] Barrett Travis wrote and sent to General
[31:31] Sam Houston that
[31:33] that the Alamo to go out. There is a
[31:35] push in the state to get this into every
[31:37] state courthouse.
[31:39] Uh we we've been working on this for a
[31:40] while now to to get it in. We're just
[31:42] about ready to go. We just need
[31:44] permission to close down that section of
[31:46] the street because we're expecting
[31:47] [clears throat]
[31:48] 100 to 150 people to show up for this
[31:50] dedication.
[31:52] So we'd just like to close down that
[31:53] section
[31:55] no later than noon. We're trying to keep
[31:57] the ceremony to 45 minutes or less.
[32:01] Which as you know is probably means it's
[32:02] going to run an hour hour 15.
[32:05] But we're going to you know we want to
[32:06] close it down enough so that people can
[32:07] get and come in and watch it
[32:09] and go from there.
[32:11] We invited the whole county. We want
[32:13] everybody to show up. It's going to be a
[32:15] great thing.
[32:16] We have people who will be showing up in
[32:18] period clothing doing a musket salute.
[32:20] We have people from the Sons of the
[32:22] Republic of Texas who will be making a
[32:24] small statement.
[32:25] And former judge uh
[32:28] Lonnie Hunt will be our master of
[32:29] ceremonies.
[32:31] >> [clears throat]
[32:32] >> And what is this letter in regards to?
[32:35] >> It's the it's called Travis letter or
[32:37] the victory or death letter.
[32:39] It's the letter that William Barrett
[32:40] Travis sent out to
[32:42] uh Texans and people of the world
[32:44] telling them how what the plight was in
[32:47] uh the Alamo.
[32:49] That what they were facing, you know,
[32:50] they they understood and all this stuff
[32:52] that they would fight and she says says
[32:54] victory or death in the letter, which is
[32:56] why most of us uh who study Texas
[32:58] history, you know, know it as the
[32:59] victory or death letter.
[33:01] >> So, this was basically the call to
[33:02] service.
[33:03] >> [clears throat]
[33:03] >> It was It was a call to service. He was
[33:05] letting everybody else know, "We're
[33:06] here. We are besieged." He sent that
[33:10] letter out on the 24th. On
[33:11] [clears throat] the On the 24th of
[33:12] February is when he sent that letter
[33:14] out. On the 23rd of February is when
[33:16] Santa Anna and the Mexican army showed
[33:18] up and surrounded the Alamo.
[33:21] So, at that point he sent that out and
[33:22] said, "Hey, we're here.
[33:25] We probably ain't going to go nowhere
[33:27] and we probably won't survive, but, you
[33:28] know,
[33:29] get us get us any help you can if you
[33:31] can."
[33:32] >> It's kind of like give me liberty or
[33:33] give me death.
[33:34] >> Really, it is.
[33:35] >> Or go
[33:36] go ahead and come and
[33:37] >> give me liberty or give me death or give
[33:38] >> Or or come and take it.
[33:39] >> Yeah.
[33:42] >> Yes.
[33:43] And the city's part in this process is
[33:46] we have to send the resolution to the
[33:48] state for the the road closure and
[33:50] that's what we're I would just wanted
[33:52] you to have a background of what the
[33:53] event was going to be, but our part in
[33:55] this is for
[33:57] getting the state closed the state
[33:58] highway closed.
[34:02] >> I I'll make a motion we
[34:04] approve the resolution.
[34:06] >> I can second the motion.
[34:07] >> It's been moved and seconded.
[34:10] All in favor.
[34:12] Opposed.
[34:14] >> Thank you folks very much. We appreciate
[34:15] >> Yes, sir. Yes, sir.
[34:19] >> Okay, item number eight, a public
[34:21] hearing on the submission of an
[34:22] application to the Texas Department of
[34:24] Agriculture for one or more Texas
[34:26] Community Development Block Grant
[34:28] Program TXCDBG
[34:30] grants for program year 2026.
[34:35] At this time,
[34:38] we're now open for our public hearing.
[34:45] Thank you.
[34:56] >> Mr. Council, I was going to present
[34:59] what this public hearing is about first,
[35:01] and then um
[35:02] we'll open it for any comments from
[35:04] council and
[35:06] the public.
[35:07] So, every every 2-year cycle, we get an
[35:10] opportunity to apply for more uh
[35:12] community development block grant
[35:14] funding.
[35:16] Uh this year, they've increased the
[35:17] allotment amount to $1 million.
[35:21] The last two CDBG programs that we've
[35:24] applied to and received was to address
[35:27] the needs of our sanita- sanitary sewer
[35:31] overflow initiative.
[35:33] Back in 2016 in 2015,
[35:36] um we were cited due to need many needs
[35:40] at our wastewater plant,
[35:42] the need for a sanitary sewer overflow
[35:44] initiative to improve
[35:47] um
[35:47] our sanitary sewer systems that uh
[35:50] caused um overflows. Basically, when
[35:53] sewer comes out of the ground out of a
[35:55] manhole or there's broken uh sewer
[35:57] lines.
[35:58] Um we needed to to provide them with a
[36:00] concerted effort and show that we're
[36:02] spending money
[36:04] to uh
[36:05] fix those uh sewer problems.
[36:08] So,
[36:10] um the last one that we received uh this
[36:12] previous uh cycle was on uh Beale
[36:15] Street. It was our MLK to Beale Street
[36:19] uh interceptor underneath the uh Union
[36:21] Pacific uh line.
[36:25] One of the reasons we use CDBG funding
[36:27] is is due to the amount of especially
[36:29] when it involves Union Pacific
[36:32] it requires lots of engineering money a
[36:34] lots of approval processes permitting
[36:37] and those are not things that we are
[36:39] able to keep up with in-house.
[36:41] So I I included a portion of that SSOI
[36:46] plan behind this map showing
[36:50] some of the projects that we're going to
[36:52] do that we're going to put efforts
[36:54] towards.
[36:55] Um
[36:57] and the one that's highlighted is about
[36:58] December 20 31, 2018 the city shall
[37:02] replace 270 ft of 18 in clay pipe with
[37:06] 24 in PVC pipe in sewer maintenance
[37:09] section two and that's what on this map
[37:12] is
[37:13] highlighted and shown as next project.
[37:16] That's the one that we have not
[37:18] completed yet. So we're asking for money
[37:20] there due to being a million dollars it
[37:22] used to be half a million dollars.
[37:26] Due to due to it increasing to a million
[37:28] dollars
[37:29] um we have a feeling that we may have
[37:31] some over you know we have more money to
[37:33] do more projects.
[37:35] We're wanting to put
[37:37] down there in along the Salus
[37:39] um housing projects on the back side of
[37:41] the Salus Street there's a creek that
[37:44] runs from West Goliad to West Houston
[37:47] and there's a sewer line that runs down
[37:49] that creek and and it used to run in the
[37:51] sewer in the creek bed or bank.
[37:55] After many years that bank has widened
[37:58] and eroded and washed out in many places
[38:00] so that sewer line is exposed and we've
[38:02] ran into some situations this past year
[38:04] where trees are falling
[38:06] and breaking that line. We actually have
[38:08] one where it fell down and broke the
[38:10] manhole. So that entire line needs to be
[38:13] redesigned moved over increased and and
[38:16] shored up to where we don't have sewer
[38:19] running into that creek.
[38:20] Um
[38:21] so we're wanting to as depending on what
[38:24] we get funded
[38:25] these are some of the projects that um
[38:28] we would like to both make remain
[38:30] compliant with TCEQ on
[38:32] and uh
[38:34] to to needed projects. Um
[38:36] the project that says next project
[38:39] the reason that we need to increase it
[38:40] is because on both sides of the railroad
[38:42] track, we have 24-in 24-in line sewer
[38:46] line
[38:48] and it's tied into an older 18-in line.
[38:51] So, it bottlenecks down
[38:52] and that's never a good thing. And um
[38:55] so, this will allow us to um bypass two
[38:58] creek crossings and um increase the size
[39:01] of our sewer line there
[39:02] where we continue to have that have
[39:04] problems.
[39:06] >> And you might And part of the reason
[39:08] this is a public hearing not the
[39:10] resolution cuz the resolution and all
[39:11] this was passed and the initial funding
[39:14] was not allowed for this project.
[39:16] They've come back and said now
[39:18] [clears throat] you're in the round of
[39:19] funding and so it's to the public
[39:22] hearing stage of that.
[39:24] >> Yeah.
[39:24] >> Okay.
[39:25] >> We applied for this a a year ago and did
[39:27] not receive it in the first round. Now,
[39:29] they said that we
[39:30] have moved up in funding cycle.
[39:33] >> That's good.
[39:34] Change price.
[39:35] >> That's good.
[39:36] >> And then if anybody wants to talk about
[39:37] >> Yeah, does anyone else have any comments
[39:40] on it?
[39:41] Open
[39:46] >> I don't
[39:47] >> If there's no more comments
[39:49] >> I close the public
[39:49] >> Mhm.
[39:50] We have 15 minutes closing in. 1 2 3
[39:53] Close.
[39:54] >> There's no action needed on that.
[39:55] >> Okay.
[39:57] So, that's right.
[39:59] Cuz we voted to
[40:01] Okay. So,
[40:02] uh
[40:06] See. Okay. Okay, item number nine.
[40:09] Consider an approval resolution of the
[40:10] city of Crockett, Texas authorizing the
[40:12] submission of a Texas Community
[40:14] Development Block Grant Program
[40:17] application to the Texas Department of
[40:19] Agriculture for the downtown
[40:21] revitalization program.
[40:23] >> I know it seems and I and I want to
[40:25] this will be the the third grant that
[40:27] we've dealt with since the last council
[40:29] meeting. This is another resolution just
[40:32] with intent to apply and this is for the
[40:34] sidewalks on East Goliad between 2nd and
[40:37] 4th streets on both sides and the
[40:40] resolution is just council being aware
[40:43] or
[40:44] us moving forward with the intent to
[40:46] apply for that those grant funds.
[40:50] >> Motion that we approve
[40:52] the authorizing of the submission of the
[40:54] Texas Community Development Block Grant
[40:57] Program application to
[40:59] the Texas Department of Agriculture for
[41:01] the downtown revitalization program.
[41:04] >> I second.
[41:06] >> Okay.
[41:09] >> And then
[41:10] >> Yeah.
[41:11] >> Um I was going to ask on the um
[41:14] on the
[41:17] downtown revitalization, so are we
[41:18] applying for this for the city or for
[41:21] the downtown side?
[41:23] >> No, it's for the city.
[41:24] >> The city of Palestine.
[41:26] >> Okay. And so far as the matching funds?
[41:29] >> It'll be city's.
[41:30] >> It'll be city match funds. Well, where
[41:32] will we be getting those matching funds
[41:33] from?
[41:33] >> Well, we'll have to that'll be a
[41:36] a council decision when we get there and
[41:39] it's just the grant process. It's just a
[41:41] matter of you have to say that we're
[41:43] willing to look for those funds if we
[41:45] get awarded that grant, but you're going
[41:48] to leverage
[41:49] 50,000 for a million.
[41:51] >> Okay.
[41:53] >> Pretty good trade. And we do a lot of in
[41:55] kind, so
[41:56] >> Sure.
[41:57] >> in house.
[41:58] So that that takes care of a lot of that
[42:01] cost.
[42:02] >> Sure.
[42:04] >> So, any other questions discussion?
[42:09] >> If not, we're ready to the
[42:11] All in favor?
[42:15] Opposed?
[42:18] Motion carries.
[42:21] And
[42:22] that brings us to item number 10.
[42:26] Government code 551.074
[42:29] personnel matters, consider matters
[42:31] related to the city administrator
[42:34] position. At this time, we will
[42:38] allow you to dismiss yourselves.
[42:52] I don't like the kids. I ate my candy in
[42:55] the car before I made it here. I got
[42:57] I did have some, but I ate it up.
[43:01] Here you go.
[43:07] Yeah.
[43:08] Everybody get
