[0:00] At this time, we will for Monday,
[0:02] November the 3rd, 2025, and it's 6:00.
[0:06] And we will open with an invocation and
[0:08] a pledge. And we do appreciate Pastor
[0:10] [name]. He did offer to share the prayer,
[0:13] but we're grateful that he's doing it
[0:15] tonight. Thank you,
[0:16] >> let us pray. Heavenly Father, we come to
[0:19] you this afternoon thanking you for this
[0:21] day, beautiful weather, all your
[0:23] blessings in our life. And we also thank
[0:26] you for the opportunity to gather here
[0:28] tonight for those who are in attendance
[0:30] with us tonight. Father, we just ask you
[0:32] your blessings upon tonight. And and
[0:35] Lord, as always, as as we uh we're here
[0:39] concerning the the business and the
[0:42] betterment and the welfare and the
[0:43] growth of our city, we ask you for
[0:47] wisdom beyond our knowledge
[0:50] or our experience
[0:53] that you may be glorified
[0:56] uh through uh all things, Lord, that
[0:59] that we come to decisions about uh
[1:02] tonight. and we thank you and we give
[1:05] you all of the praise in Jesus name.
[1:07] Amen.
[1:08] >> Amen. The
[1:09] >> pledgece
[1:12] to the flag of the United States of
[1:15] America and to the republic for which it
[1:18] stands. One nation under God,
[1:22] indivisible, with liberty and justice
[1:24] for all.
[1:31] So once again, it's my pleasure to to
[1:33] recognize all of the visitors that are
[1:35] here. We're so grateful that you've
[1:36] taken out of your day to come and share
[1:39] with us uh equally. But I know one thing
[1:41] I'll usually forget is to recognize how
[1:44] appreciative we are of the council.
[1:47] This is not the highest paid job in the
[1:49] world. [laughter]
[1:51] So, we know that it's much love and much
[1:53] care and much concern the reason they
[1:55] continue to work with the city and we do
[1:58] appreciate the the job that they do
[2:00] because in case you haven't noticed when
[2:02] they leave here, it doesn't stop. It's
[2:05] always a friendly constituents that
[2:07] would like to share with them. So,
[2:09] they're on a 24-hour call. So, we do
[2:11] appreciate it and we thank them for
[2:13] their dedication. Uh with that being
[2:15] said, uh at this time we'll go to our uh
[2:19] comments from the audience at one and we
[2:21] have one and will be Bobby Bolan. Just
[2:25] as a reminder, each person has three
[2:27] minutes. Not that we don't we're not
[2:29] interested in what you're saying. Nobody
[2:32] from the council can comment. It's just
[2:34] your three minutes and when it's over we
[2:37] the clock would deem. Thank you so much.
[2:42] Mr. Mayor, council,
[2:44] family, appreciate y'all giving me this
[2:46] opportunity to appear here tonight.
[2:49] First, I want to congratulate you on
[2:51] your your case that you won this past
[2:54] week. Uh, judge dismissed it with
[2:56] prejudice, which is very good. And
[2:59] having said that, I also noticed that
[3:01] the judge made some remarks indicating
[3:06] in federal court that he does not
[3:08] understand why there's not been criminal
[3:11] charges pursued in this. [snorts]
[3:13] Uh I think what he's talking about there
[3:15] have been no indictments
[3:17] or anything else in regard to the
[3:20] criminal activity conducted by the
[3:22] members and the board of the CIDC.
[3:27] and they've had every opportunity,
[3:30] officials have, our past district
[3:32] attorney had an opportunity to prosecute
[3:34] it. Reasons unknown, either scared to or
[3:38] too lazy to do it, but she passed it on.
[3:42] Uh, our city
[3:45] uh police chief
[3:48] uh failed to present any cases, I think,
[3:50] for the same reason, possibly either
[3:52] lazy or too scared to do it. But a
[3:55] federal judge has seen and does not
[3:58] understand why
[4:01] uh there hadn't been any charges filed.
[4:04] And I think as a city council and the
[4:07] people in in this county and the city
[4:10] have every opport every reason to be
[4:13] told somehow somewhere what and why
[4:16] nothing has been done.
[4:19] I think it need to be come upon y'all's
[4:21] power through the city council to insist
[4:25] that charges are looked into and proper
[4:28] charges filed for the wrongdoing in the
[4:31] CIDC.
[4:33] I know that uh counties surrounding us I
[4:36] see all the time where officials have
[4:39] been prosecuted and sent to prison for a
[4:42] lot less than what has happened with the
[4:43] CIDC.
[4:45] And people don't understand in this
[4:47] county why that's happening these other
[4:50] places and we can't get any answers or
[4:52] anything done uh in this county
[4:55] regarding the CIDC.
[4:57] I appreciate your time. Thank you.
[4:59] >> Thank you.
[5:01] >> Uh with that being said, those are the
[5:03] comments from the audience at the time
[5:05] that the council would like to make a
[5:07] statement or comment. And likewise, it's
[5:09] not a discussion. It's just a general
[5:11] comment as it will be with others.
[5:14] Um um mayor council kind of just kind of
[5:18] want to bring to your attention um I'm
[5:21] still kind of concerned really concerned
[5:24] with the um deficit that we're in um the
[5:29] 328,000
[5:31] u dollars well over a4 million uh
[5:35] dollars. So, with that being said, I'm
[5:38] really concerned about it because I feel
[5:41] like that no one has spoke up and said
[5:43] that we needed to need an audit because
[5:46] that's quite a bit of money. As a matter
[5:48] of fact, um that's
[5:52] prison time uh speaking on that behalf.
[5:56] So, um I would suggest or recommend that
[6:00] we place it on our agenda to consider
[6:03] auditing having an audit to find um
[6:08] where any monies have been either
[6:10] mismanaged
[6:12] or any mouth or overspending has been
[6:16] done. So, with that being said, um I
[6:21] want to kind of ask um I see attorney
[6:25] >> Okay. We're just you're just having a
[6:27] journal conversation. It's not
[6:28] >> We have that done every year
[6:30] >> at this at this point. It's just your
[6:32] comment and not interaction.
[6:34] >> Okay. But
[6:35] >> it's been done every year,
[6:36] >> but I was told every excuse me,
[6:38] >> it's it's done every year.
[6:40] >> Okay. Right now, this is not a
[6:41] discussion area. She's just going to
[6:43] give a comment of where she feels
[6:45] without interaction.
[6:46] >> Yes, ma'am. But I was told last time
[6:48] that if I needed to speak to the
[6:50] attorney that y'all would prefer me to
[6:52] speak to the attorney in the presence of
[6:54] counsel. Okay. We're not This is It's
[6:56] not a a time at this point. You're just
[6:58] giving us comment at this time
[7:00] >> and we're not having a dialogue.
[7:01] >> Okay. It's just this is just for
[7:03] comment.
[7:04] >> Okay. Okay. We'll discuss in the
[7:07] executive session. Thank you. Yes,
[7:08] ma'am. Appreciate it.
[7:10] >> Can I say something?
[7:12] >> You can.
[7:12] >> I mean, it's like, do you
[7:13] >> I mean, it's not a rebuttal or anything.
[7:15] >> Well, no, I mean, I was just asking, do
[7:17] you get a letter from Alex and and
[7:20] filling out? I mean, it's done every
[7:22] year. Well, there's an audit.
[7:24] >> Let me just explain one thing.
[7:26] >> It's it's just a comment. It's not a
[7:28] conversation. So, you may make a comment
[7:30] about it or any of the council, but it's
[7:33] not a general conversation because it's
[7:35] not
[7:36] >> comment. Okay. You may say it's
[7:38] >> done every year.
[7:39] >> Okay. Thank you. Anybody else have a
[7:41] comment?
[7:42] >> Uh yes, ma'am. Uh, also just to to let
[7:45] um let you all know uh precinct three
[7:48] know that I kind of made uh some visits
[7:52] uh during at precinct during uh uh I
[7:55] think about month or two ago uh vis made
[7:59] some visits with some residents in
[8:00] precinct 3 and so they wanted me to
[8:03] bring to the attention of different
[8:05] items that um need uh addressing in
[8:09] precinct 3. So, with that being said, I
[8:12] want to make sure that we do uh get that
[8:15] on the agenda again [clears throat] um
[8:17] in December. Um, also with that being
[8:20] said, um there is um
[8:26] also a concern of the um
[8:30] town hall the the creek that's running
[8:35] um
[8:38] where MLK is Sycamore and down south uh
[8:43] South Second Street. So um I want to
[8:46] would like to address those concerns as
[8:49] well. So I wanted to bring bring that
[8:52] forth also um in that discussion about
[8:56] putting something on the agenda for next
[8:58] month um also about precinct 3. The size
[9:02] of the precinct 3 has been increased um
[9:05] and the population of precinct 2 was
[9:08] decreased. And from my understanding
[9:10] with the redistricting,
[9:12] um, trying to understand how the funds
[9:15] are distributed for repairs on streets
[9:20] or any other repairs that need to be
[9:22] done in our precinct. So, I would like
[9:24] for that to be explained as well, not
[9:27] just myself, but we have other new
[9:29] council members on here as well that
[9:31] probably don't understand the um the way
[9:34] the uh funds are distributed amongst the
[9:36] precincts.
[9:37] >> Okay.
[9:37] >> Okay.
[9:38] >> Thank you. I think everybody understands
[9:40] it except one.
[9:41] >> Okay. Well, we're good. We're any Does
[9:43] anyone have a personal comment that
[9:45] they'd like to address? If not, thank
[9:47] you so much for your comments. And the
[9:51] way it's set up, it will be an
[9:52] opportunity to be an agenda item to
[9:55] discuss the details from the budget and
[9:57] those kinds of things. So, thank you so
[9:59] much. And so, that brings us down to the
[10:02] uh item, the veterans recognition.
[10:06] Number one, consider and approve a
[10:08] proclamation recognizing the
[10:10] contributions of veterans employed by
[10:12] the city of Crockett to acknowledge
[10:14] their commitment both in service to the
[10:17] nation and their continued service to
[10:20] the community through their work with
[10:22] the city. Uh [name] is going to present
[10:25] it.
[10:26] >> Good evening everyone.
[10:28] >> Good evening. While it's easily said
[10:29] that our employees are our greatest
[10:31] asset in the city, tonight the city of
[10:33] Crockett wants to take a special moment
[10:35] to honor a special group of people, the
[10:38] men and women among our city staff who
[10:39] proudly serve in the United States Armed
[10:42] Forces in recognition of the upcoming
[10:44] Veterans Day. Their service did not end
[10:47] when they took off the uniform. They
[10:49] carried that same discipline, courage,
[10:50] and dedication right here into public
[10:52] service of the city, serving our
[10:54] citizens each and every day in
[10:56] departments across the city. Tonight, we
[10:58] celebrate both this achievement and and
[11:00] the incredible people behind it. We're
[11:03] also proud to announce that the Texas
[11:05] Workforce Commission has officially
[11:07] recognize the city of Crockett as a

[11:20] council member, and over 20% of our
[11:21] employees that have or are serving as
[11:23] armed force veterans. At this time, I'd
[11:26] like to formally present the Veteran
[11:28] Friendly Employer Recognition Award on
[11:31] behalf of the Texas Workforce
[11:32] Commission. This award represents the
[11:34] city's dedication to providing
[11:36] opportunity, respect, and career growth
[11:38] for our veterans, individuals [snorts]
[11:39] whose leadership, work ethic, and
[11:41] integrity make our organization stronger
[11:43] every day.
[11:44] >> Thank you so much.
[11:48] [applause]
[11:53] And now the mayor has a special
[11:55] proclamation in honor of our veterans
[11:57] employed by the city to read.
[11:59] >> All right. Would y'all like to hear the
[12:01] other proclamation too? The recognition

[23:02] [laughter]

[24:27] >> All right. If y'all don't mind,
[24:29] everybody out in the audience can sit

[24:48] >> Bring them forward.
[24:49] >> Make sure you get [name]'s good side.
[24:51] >> Ready? Make sure your face is visible
[24:52] here.
[24:54] >> I think I got everybody
[24:56] over.
[24:57] >> Could [name], could you help move over
[24:59] just a little bit, please?
[25:01] >> Yeah, that'll work. That'll work.
[25:03] >> All right. You ready?
[25:08] >> All right. Thank you, guys. [applause]
[25:21] his him and his wife.
[25:23] >> Thank you, sir. Appreciate it.
[25:31] >> Thank you so much. It is always such a
[25:34] pleasure to honor people, to give honor
[25:36] to where honor is due. We do appreciate
[25:39] all the great things that have gone
[25:41] forth.
[25:46] >> And so with that, we're back to our
[25:49] regular order business, approval of
[25:52] minutes. Item number two,
[25:56] may
[25:56] >> make a motion we approve.
[25:58] >> I second the motion.
[25:59] >> It's been moved and second. All in
[26:00] favor?
[26:02] Motion.
[26:05] >> Motion carries. Okay. Uh then it brings
[26:08] us to item number three. Consider and
[26:10] approve a resolution for the temporary
[26:12] closure of state right of way for
[26:15] Christmas lighting of downtown Crockett.
[26:18] >> Mayor and council, uh the downtown
[26:22] Crockett Association has requested we
[26:25] close the east side of the square for
[26:27] the Christmas lighting, the annual event
[26:30] we have. It's at 6:00 p. p.m. It's just
[26:33] approving the resolution to close those
[26:35] state highways.
[26:37] >> Okay,
[26:38] >> I make a motion we approve it.
[26:39] >> I second.
[26:40] >> Okay, it's been moved and second. All in
[26:42] favor? Motion carries. It bring us to
[26:45] item number four. Consider approve an
[26:47] audience of amending the code of of
[26:50] ordering city of Crockett, Texas by the
[26:52] amendment of chapter 13 license and
[26:54] business regulation amending amending
[26:57] article 13 ammusement uh redemption
[27:00] machines section 13-503
[27:04] paragraph C relating to
[27:08] uh I lost my disting restriction uh
[27:11] adding additional location to the 300 ft
[27:16] Distant restriction limiting the
[27:18] resident residential distant restriction
[27:22] to only apply to a residential dwelling.
[27:26] Adding an exception for a residential
[27:28] dwelling that is part of a mixed use
[27:32] commercial and residential property.
[27:34] clarifying how the distance restriction
[27:37] is measured and changing the distance
[27:39] measurement for a church to consider the
[27:42] church property line instead of only the
[27:45] church front door. Expanding the
[27:48] location restriction to one uh amusement
[27:51] redemption machine establishment per
[27:54] partial or providing a servability
[27:57] clause containing a repealing clause and
[28:00] providing an effective date. Mayor and
[28:03] Council, this is just basically updating
[28:05] and clarifying our existing ordinance.
[28:08] And if you'll notice um the changes
[28:10] that's on page 13 in your packet, it
[28:13] shows what's added, which is underlined,
[28:16] and what was taken out was marked
[28:18] through. Uh other religious
[28:20] establishments, government offices or
[28:22] offices that conduct government related
[28:24] business, public library, public parks
[28:25] or daycare facilities were added.
[28:28] [snorts]
[28:29] um counseling rehab centers or a
[28:32] residential dwelling other than a
[28:34] residential dwelling that is part of a
[28:36] mixeduse commercial and residential
[28:37] property. Then it just clarifies a
[28:40] little bit about how the distance shall
[28:42] be measured. Uh we submitted all that to
[28:45] the city attorney for approval and and
[28:49] so
[28:51] >> um I have a question.
[28:52] >> Sure.
[28:53] >> Okay. So, uh do we know the reason why
[28:56] the ordinance has come about? I notic
[28:58] you saying it's updating but did there
[29:00] were there a business or something like
[29:02] that ma'am you to inquire about this?
[29:05] >> No ma'am part of it is state statutes
[29:07] change too and what is required and and
[29:10] this is just basically clarifying
[29:12] because some of our ordinances as we've
[29:14] discussed before or simply outdated.
[29:18] We're trying to catch up and so when
[29:19] there's questions and we that come up
[29:22] then I want to make sure that they're
[29:24] right. And that's basically what this is
[29:26] doing is clarifying, codifying what we
[29:28] need to do as a city.
[29:30] >> Yeah. Cuz I was ask cuz I looked and I
[29:32] saw where you said uh adding locations.
[29:36] So
[29:37] where it says adding
[29:39] >> the the ones I just read off the in
[29:41] general like other religious
[29:43] establishments that was not in the
[29:44] ordinance before. not a specific
[29:46] location or a specific business, but
[29:49] where that the amusement redemption
[29:52] machine shall be shall not be situated
[29:54] within 300 ft of any church or other
[29:57] religious establishment, it just
[29:59] clarifies where they can and cannot be
[30:01] if somebody were to apply for a permit.
[30:03] When I when I did when I saw uh when I
[30:06] looked up the ordinance the the previous
[30:08] old ordinance uh I think it's on 13503b
[30:12] and it states that the amusement
[30:15] machines are only to be located in
[30:18] commercial district
[30:20] >> and that didn't change
[30:21] >> manufacturing but um but then you got
[30:25] the mixuse.
[30:27] that's within
[30:28] >> that could be within those the distance
[30:31] to those because of where boundary lines
[30:34] are. You could still be in that zoned
[30:36] area, but if you're within 300 ft and
[30:39] fit in there, then it would not be
[30:41] allowable there.
[30:42] >> Okay. In uh in the Okay. So, with that
[30:45] being said, so in a mixed use area, so
[30:49] how
[30:51] how is it own? So, in other words, if
[30:53] you
[30:53] >> The key to it is
[30:55] >> okay,
[30:55] >> it's still got to be zoned as you said.
[30:57] That didn't change.
[30:58] >> Okay.
[30:59] >> But the key to this is up front. It says
[31:01] situated within 300 ft up there.
[31:04] >> Oh, a residential area.
[31:06] >> Correct.
[31:08] >> Okay. Cuz it's going to be a mixeduse.
[31:10] So, within 300 ft residential. Okay.
[31:14] Okay. cuz I was wondering with that
[31:15] being said, I was wondering if it need
[31:17] needed to be reszoned or if the
[31:22] >> No, it's just No, it's got to be in the
[31:24] zoning that is required according to the
[31:26] ordinance like you discussed. This is
[31:28] just adding stipulations to where
[31:30] >> they can be in relation to that zone.
[31:34] >> Okay.
[31:34] >> Because at the edges of that zone you're
[31:37] talking about, you could have
[31:39] residential next door, but you can't put
[31:41] one of these in if it's within 300 ft.
[31:43] Mhm.
[31:44] >> Okay.
[31:46] Any
[31:46] >> I'll make a motion we approve it.
[31:48] >> Okay.
[31:49] >> Second the motion.
[31:50] >> It's been moved and second. All in
[31:52] favor?
[31:54] >> Motion carries.
[31:56] Brings us to
[31:59] >> Oh,
[31:59] >> our executive session.
[32:04] I need I guess I need to read uh item
[32:07] five and six will be covered in
[32:09] executive session.
[32:11] uh government code section 551071
[32:14] and government code 551.072
[32:19] consultation with attorney regarding the
[32:21] value and recapture of real property
[32:24] described as for lot one Crockett
[32:27] Industrial Park phase 1 portion number
[32:30] 29760
[32:32] from Midland Estate LLC. Uh item six uh
[32:37] government code section 551.072 072
[32:41] deliberation regarding the purchase,
[32:43] exchange, lease, or value of real
[32:45] property with ANA Texas Capital being
[32:48] described as partial number 16374.
[32:53] With that, we will
[32:58] uh go into executive session. Since it's
[33:01] just a few, we'll remain in here
[33:04] and we'll let you part depart.
[33:11] Did anyone need to take a break before
[33:13] the session?
[33:16] >> All good. It shouldn't be long,
[33:18] >> huh?
[33:19] >> It may not be too long. It shouldn't be
[33:21] that long.
[33:21] >> I looking at I was like,
[33:22] >> well, we're holding. It shouldn't be.
[33:23] >> I looked at it today. It shouldn't be
[33:24] that long. So with dead being saved,
