[2:01] justice for all.
[2:11] Once again, thank you all for joining us
[2:13] today. Um, we have quite a few items on
[2:16] the agenda, but we'll start out with the
[2:18] uh
[2:21] I'll take it back. We do have um
[2:25] we'll start with the uh canvas. We'll go
[2:27] ahead and and do the administration then
[2:29] come back to the office. All right. They
[2:32] are in that order. I just didn't read
[2:34] them. At this time we'll have the uh
[2:36] canvas of the election and administer of
[2:39] office with follow
[2:44] [Music]
[2:58] the whole set.
[3:01] Okay. It goes down and comes back. If
[3:05] you do them one by one and then send
[3:07] them back. Yeah,
[3:11] expedited.
[4:01] This was the last
[5:58] looking
[6:02] for. Yeah, I think everybody's been
[6:05] struggling with internet.
[6:10] having a really hard time covering all
[6:13] of my conversations.
[6:48] Yeah.
[6:53] [Applause]
[6:56] Okay. At this time, can we get a motion
[6:59] to accept the canvas of the election?
[7:02] A motion to accept the canvas. Second.
[7:07] Okay, it's been moved and second. All in
[7:08] favor?
[7:10] Motion carries. Okay, it brings us to
[7:12] item number two. Administr administer
[7:15] office oath of office to the mayor.
[7:21] Take the glasses off.
[7:46] All right, mayor. I'm going to state the
[7:48] first line and then after that I'll ask
[7:50] you to repeat after me. Please raise
[7:52] your right hand. In the name of
[7:54] authority of the state of Texas, repeat
[7:55] after me. I Dr. I am the officer I Dr. I
[7:59] am the official do solemnly swear do
[8:01] solemnly swear that I will faithfully
[8:03] execute that I will faithfully exeute
[8:06] the duties of the office the duties of
[8:08] the office of mayor of the state of
[8:10] Texas of mayor of the state of Texas and
[8:12] will to the best of my ability and will
[8:14] to the best of my ability to preserve
[8:16] protect and defend preserve protect and
[8:18] defend the constitution and law the
[8:20] constitution and law and laws of the
[8:23] United States and laws of the United
[8:25] States and of this state and of this
[8:27] state so
[8:31] You can sound right here.
[8:35] Is there
[8:56] Here
[9:11] you go.
[9:19] [Applause]
[9:21] Thank you so much for trusting me a long
[9:23] time.
[9:41] This is where you said my how the time
[9:43] flies. It's hard to believe the time has
[9:46] passed that quickly. But thank you so
[9:48] much, city of Crockett and all of you
[9:50] that uh cared enough to uh engage in
[9:53] voting. Thank you so much. And at this
[9:56] time it brings us to our recognition of
[9:59] visitors.
[10:01] And like I said once again, thank you so
[10:04] much for all attending. I thank my
[10:05] husband for coming in to cheer his wife
[10:07] on.
[10:13] He's glad to be here after 45 years with
[10:16] He's just glad to be here.
[10:19] If he's not here, you have to pretend
[10:21] it.
[10:24] Thank you so much for everything for all
[10:26] of you being here. So, at this time we
[10:27] uh we do recognize our visitors. We know
[10:29] that it takes a effort to come out each
[10:31] council meeting and we know that it's
[10:34] because of you that we get business done
[10:36] and we get it done effectively because
[10:38] we hear what you have to say. And so
[10:40] with that being said, we're uh
[10:42] recognizing of our visitors. We're now
[10:44] to the comments from the audience. And
[10:46] we do have one uh listed from Diane
[10:49] Rome. And as in past, for those of you
[10:51] that are not familiar, we do a
[10:53] threeminut limit and no one on the
[10:56] council will respond either way because
[10:59] it's not an agenda item. Thank you.
[11:01] Thank you, madam.
[11:03] On November 4th, Citizens of Crockett
[11:06] voted to terminate
[11:09] economic development, which is
[11:11] approximately 2 million dollar in debt.
[11:15] It passed over and after the debt is
[11:17] paid off in about three years, the
[11:20] halfent sales tax will continue to be
[11:22] collected and will go toward property
[11:24] tax relief. This was voted on passed by
[11:28] the citizens of profit on November 4th,
[11:30] 2024.
[11:32] This opposition will help the 50% of
[11:35] profit citizens who actually pay their
[11:37] property taxes.
[11:39] That being said, I don't know how many
[11:41] of y'all realize, but really truly only
[11:43] 50% of taxpayers pay their taxes and all
[11:48] of us here.
[11:51] So, I'm here tonight to request the city
[11:54] to give a monthly report on how the
[11:56] funds of economic development is being
[11:59] used.
[12:00] How much of the monthly sales tax is
[12:02] going to pay off the $2 million debt?
[12:06] When economic development was in
[12:07] operation, questions were asked many
[12:09] times about why there could not be a
[12:11] monthly report. That never occurred. I
[12:15] realize it might be something different
[12:17] and to give this report, but hopefully
[12:19] you will see the need to keep the
[12:21] citizens informed. It is the taxpayers
[12:23] money.
[12:25] Now, I see a problem making this
[12:27] request, and this is because, as the
[12:30] mayor said, we're only allowed three
[12:31] minutes to make a comment. And as she
[12:34] reminds us, they can respond. You all
[12:36] cannot respond to us in any way council
[12:38] meeting about our concerns.
[12:41] So I guess the only way that we will
[12:43] know this can be done is if you do it.
[12:47] If for some reason you cannot make it
[12:50] and we need to know that as well. I
[12:52] thank you for allowing me the time to
[12:54] say this and I look forward to your
[12:57] decision regarding this matter. I think
[12:59] it's extremely important that
[13:03] be
[13:05] thank you. Thank you. Um that is at this
[13:09] time and that was the only uh
[13:12] request from the audience. So with that
[13:15] being said it brings us to to the next
[13:18] item approve of the minutes item number
[13:20] three regular session May 19th 2025.
[13:24] All of you had an opportunity to view
[13:27] them. I make a motion we approve the
[13:30] minutes. I second. It's been moved and
[13:32] second. All in favor?
[13:34] Motion carries. That brings us to the
[13:37] reports. Item number four, police
[13:39] department manpower and criminal
[13:41] incident report for May 2025.
[13:45] Good evening, Mayor City Administrator.
[13:48] Police department manpower and criminal
[13:50] activity report for May of 2025. Total
[13:53] of 16 officers, worked 2,800
[13:58] hours, manh hour hours, responded to 461
[14:01] calls for service, investigated nine
[14:04] traffic accidents, made 54 arrests,
[14:08] issued 490 traffic citations, completed
[14:11] 83 reports, responded to 32 alarm calls,
[14:15] 29 of those were false alarm. I
[14:18] entertain any questions you may have
[14:19] about a report.
[14:25] Does anyone have any questions?
[14:30] If not, thank thank you so much. Thank
[14:32] you. Thank you, Chief. Appreciate it.
[14:34] Okay. Uh bring us to item number five,
[14:37] fire department monthly activity and
[14:39] status report May 2025.
[14:46] Good evening, Mayor, council members.
[14:49] For the month of May, uh we had a total
[14:51] of 46 calls. 33 of those being in the
[14:54] city and 13 in our county response area.
[14:58] There's a further break down
[15:00] question.
[15:04] One thing we had a little rain to help
[15:06] you out a little bit.
[15:08] But over the 33 calls, half of them was
[15:11] storm related last night. So probably
[15:14] ran probably 15 calls so far during this
[15:17] last weather event. So we've been busy
[15:22] weather trees falling
[15:24] fire lines. Oh, I forgot about that part
[15:27] of it.
[15:30] Did y'all help with any of the the
[15:32] flooding? Any of the u community?
[15:37] We had a couple
[15:40] high.
[16:04] Thank you. That's good.
[16:07] Okay. All right. Any other questions?
[16:10] No. Thank you for your service. Okay.
[16:12] That bring us to item number six.
[16:14] Receive as information the Houston
[16:17] County Appraisal District fiscal year
[16:19] 2024 financial audit and fiscal year
[16:22] 2026 operating and collection uh
[16:26] budgets.
[16:28] Mayor and council. Those um I put those
[16:31] in your packet and it's under tabbed
[16:33] under uh the number six there. Yeah, to
[16:36] relate to agenda item number six. Um
[16:39] those are your a copy of the budget from
[16:42] the appraisal district um that they
[16:46] adopted for this upcoming year. As you
[16:48] know, we all contract ourselves and
[16:51] other government entities, taxing
[16:53] entities in the county contract with
[16:55] them for appraisals and uh for
[16:58] collections as well. So we all share in
[17:00] the cost after the budgets are adopted.
[17:04] And then I also have um one hard copy of
[17:07] the audit. It's available for council's
[17:10] review at any time here at city hall.
[17:15] How many people work out there?
[17:22] Does it show on here? Yes, sir. Um
[17:24] employment. Okay. Yes, sir. You got one,
[17:27] two, three, four, five.
[17:32] Uh, six
[17:38] looks like eight employees. Eight
[17:40] people. Okay.
[17:44] Has so we got salaries going to
[17:46] 514,4757?
[17:50] Yes, sir. Um, on eight employees, they
[17:53] had a uh 4 and a.5% uh cola that they
[17:58] provided this year and that's what
[17:59] caused that increase.
[18:03] That looks pretty good.
[18:07] Hopefully we can afford one like that. I
[18:09] know. I agree. 100%.
[18:14] So, we just got a caller last year, did
[18:18] 2%.
[18:23] So, we go from 485 to 514.
[18:37] When does this need to be? It's already
[18:41] It's approved. Um that's their adopted
[18:43] budget. It's for information. Okay.
[18:47] Their board already
[18:49] um has adopted. So we pay for this out
[18:52] of our tax revenue. Yes.
[18:58] If you go further down, it'll there's a
[19:00] breakdown. I think it's on the maybe the
[19:02] last page or the second to the last page
[19:04] of the share split between all the
[19:06] taxing entities
[19:11] since there's two budgets. One's for
[19:12] operations, one's for operating and
[19:14] one's for collections.
[19:47] This is strictly for information. Yes,
[19:49] ma'am. For information. There's no
[19:50] action. There's no action required on
[19:53] Pretty good. pretty good. Since
[19:55] it'sformational, you have a time to go
[19:58] over in details with that.
[20:05] And I'm sure if you have any questions,
[20:07] you can contact them directly.
[20:12] Thank you. Would that do any good? Huh?
[20:16] Would that do any good? Well, they've
[20:18] approved it. I wouldn't say that they
[20:20] reapproved it, but I have no I'm sure if
[20:23] they the board has approved it, but it
[20:25] might help in the next time that they go
[20:28] to it. Number seven. No, ma'am. Okay.
[20:31] It's just for discussion with if nothing
[20:33] else on that one, that moves us to the
[20:36] next item,
[20:38] our business. Item number seven,
[20:42] consider and approve a recommendation
[20:44] from the planning and zoning commission
[20:46] to hold a public hearing regarding a
[20:48] proposed zoning district's change from M
[20:52] manufacturing warehouse and wholesale
[20:56] selling district to R2
[20:58] family residential district with a strip
[21:01] of properties bordered by Martin Luther
[21:03] King Bullet King Jr. Boulevard on the
[21:07] east Sycamore Street or Sycamore Street
[21:10] right of way on the west and west
[21:13] goladed Avenue on the north and Berles
[21:16] Avenue on the south.
[21:19] Mayor and council, um I have Miss [name]
[21:23] [name] here, um who is our
[21:25] administrative assistant, has been
[21:26] diligently working on this project. um
[21:29] she provided a a report in y'all's
[21:31] packet as well that that y'all have had
[21:34] time to look over. But we also have
[21:36] additional information to try to help
[21:39] council understand why we're deciding to
[21:42] do this in in a bigger block instead of
[21:45] peacemailing it with spot zoning. has
[21:48] we've gotten a few requests for some
[21:50] spot zones for residential use and we
[21:53] found out that our zoning map for this
[21:55] district is uh manufacturing which
[21:59] precludes that. So, we'd have to
[22:01] individually address each request for
[22:03] new homes. And we have an issue with all
[22:07] of the existing homes that are in that
[22:09] district who may run the risk of having
[22:11] a commercial business move in right
[22:13] beside them and with no with no way to
[22:16] stop it because it's it's all currently
[22:17] zoned as manufacturing uh district. And
[22:21] so, Miss [name], if you don't mind talking
[22:24] a little bit or and [name], I do have a few
[22:28] of the things that you sent me that I
[22:29] can share or show. But, hi, I'm a
[22:33] assistant for the city of Crockett and I
[22:36] act as the planning and zoning
[22:38] commission. Secretary [name], you know him
[22:40] as our code enforcement officer. We work
[22:43] together to develop this report. Um, I
[22:46] hope there's a lot of information in
[22:48] here. A lot of it self-explanatory, but
[22:51] if you have any questions, I'm just
[22:53] going to be here to help answer those
[22:54] questions.
[22:57] We do see this as an improvement to the
[22:59] area. As the court said, this was made
[23:03] manufacturing probably in the 1980s
[23:05] before the profit industrial park
[23:07] existed. So, at the time, it seemed like
[23:09] manufacturing would have been a good
[23:11] idea along the railroad, but um there
[23:14] were already houses especially to the
[23:16] north around West We have the first
[23:19] couple blocks are older homes. Uh
[23:22] there's a lot of vacant properties. Most
[23:24] of the property is vacant. So obviously
[23:26] it's not being used for manufacturing.
[23:28] There's not much interest. And new
[23:30] companies coming in are going to go to
[23:32] the industrial function. They're not
[23:34] going to come here. Uh the residents
[23:38] uh this would give them an opportunity.
[23:40] Right now they're non-conforming use. Um
[23:43] so sometimes if they want to sell the
[23:45] property or make improvements it is a
[23:47] hindrance and this would bring them into
[23:49] performance use. Uh also the
[23:52] infrastructure there is streets for
[23:54] residential or sewer for residential.
[23:57] It's not made for industrial use. Some
[23:59] of the u uh parcels might remain
[24:03] manufacturing. Uh I want to emphasize
[24:06] all we're requesting all the is
[24:08] requesting is that this be considered in
[24:10] the public hearing. So before they can
[24:12] have a public hearing and it's their
[24:14] idea to change a zoning district, city
[24:18] council has to approve. They have to
[24:20] submit a report to you and city council
[24:22] has to approve allowing them hearing to
[24:26] have the property owners come voice
[24:28] their opinions and including the
[24:30] property owners within 300 ft of this
[24:33] strip will also have the chance to voice
[24:36] their opinions changes. They will be
[24:38] provided. We're planning on providing
[24:40] each the owner the packet of information
[24:43] be as transparent as possible along with
[24:46] actually the little map of their
[24:48] property showing exactly what we're
[24:50] proposing plus uh not only mailing the
[24:53] packet public will go knocking on the
[24:55] doors talk to them make sure they
[24:57] receive the packet and have the
[24:59] opportunity to come speak at a public
[25:01] hearing and then public uh planning
[25:04] zoning will make their recommendation to
[25:06] the city council and y'all will have a
[25:09] public hearing also receive
[25:11] addition input if property owners want
[25:13] to come at that public hearing. They'll
[25:15] be advised of those public hearings. So,
[25:17] it's a lot of time to uh and we're not
[25:19] planning on having the PNZ public
[25:22] hearing until
[25:23] uh July 15th and then hopefully the city
[25:28] council public hearing unless it's
[25:29] tabled by PNZ instead of making
[25:31] recommendation will be uh July 21st.
[25:34] That's a lot of time to further look at
[25:36] the report and be familiar with
[25:41] is being recommended
[25:43] because I think there have been a lot of
[25:46] requests for residential and not
[25:49] manufacturing and that's the way that
[25:51] we've heard and since it is residential
[25:53] in front if people were wanted to do it
[25:56] the street would have on both sides and
[25:59] I think in terms of building communities
[26:03] it would be more beneficial than having
[26:06] a manufacturing in front of someone's
[26:08] house and So I I you know just from
[26:12] looking at it and knowing that area how
[26:14] long it's been vacant and how
[26:17] well if you have a nice house over here
[26:19] it's not very beneficial to you if you
[26:21] have something in front of you that's
[26:22] not very nice and so I think as a
[26:25] community now because I believe that Dr.
[26:28] [name] you're only strong as the weakest
[26:31] part of your community and so to look
[26:33] like a community you want people to have
[26:36] similar communities. So if you're trying
[26:39] to do it to improve your community, it's
[26:42] very hard if you have a diff a business
[26:45] right in front of you as opposed to your
[26:48] home area. And it kind of hinders what
[26:51] we like to think of as neighborhood
[26:54] community. And so in order to prove that
[26:57] has been an area because of the location
[27:00] that it's been hard to to grasp the
[27:02] community aspect because of how it has
[27:05] been developed in the past. So I'm
[27:08] thinking that anything you know that can
[27:10] bring it in more align with being a
[27:13] community instead of manufacturing
[27:16] community and that it would really add
[27:19] to enhance our community as a city so
[27:23] that we would know that this is a
[27:24] community and then they would be able to
[27:26] dialogue and develop what they want it
[27:28] to look like because it's very hard you
[27:31] know when you have too many diff
[27:33] different stations taking place and I do
[27:36] think we need to work on and since it's
[27:38] in a minority area, it just need to be
[27:41] kind of addressed in that sense that it
[27:44] can be more synchronized.
[27:47] That's [name]'s take on it.
[27:50] Is um his choice still available to the
[27:54] resident or the property owner as far as
[27:56] whether they wish to have a
[27:58] manufacturing zone or resident
[28:00] residential zone or would that just go
[28:05] as far as the the zoning?
[28:09] What the preliminary report is
[28:11] recommending is that the first two
[28:14] blocks from Goad uh down to Howard that
[28:18] all
[28:19] R2 residential duplexes. Yes, ma'am.
[28:23] Correct me if I'm wrong. Down to um
[28:28] down to
[28:31] you.
[28:34] Yes. Mhm. First half a block north
[28:39] um manufacturing and then the first
[28:42] block south stay manufacturing. South of
[28:44] that R three, north of that R two.
[28:47] Gotcha. Thank you. And the the process
[28:51] like uh like you had asked if one this
[28:54] hall current our goal is to align it to
[28:57] what the current uses are. So if
[28:59] somebody's living with a home there,
[29:01] they're likely going to want it to stay
[29:03] to become residential so they don't
[29:05] become a non-conforming use and have
[29:07] somebody move in beside them. So, but if
[29:10] there is another desire, say for a few
[29:12] parcels or or whatever, the public
[29:15] hearing process, if there's more people
[29:18] that come to it that are against it than
[29:20] that are for it, that's how that pro the
[29:22] public hearing process is divided out
[29:24] and we put it back in a report and bring
[29:26] it back to council and say, "Here's all
[29:29] the here's what the people wanted, okay,
[29:31] that are going to be directly impacted
[29:34] and within 300 ft on both sides." So
[29:36] moving all the way over another block at
[29:38] least in both sides direction everybody
[29:41] will have input is this what they want
[29:43] is this good okay or are there other
[29:45] considerations to take okay and then the
[29:48] planning and zoning makes a
[29:49] recommendation back to council and says
[29:51] hey this is this is what we need what we
[29:53] come up with and then y'all so there's
[29:56] multiple layers of of input from the
[29:58] community and then council okay so you
[30:00] will have a couple of areas that in uh
[30:03] in that location that will stay
[30:05] manufacturing along Bell where there is
[30:08] some current manufacturing or commercial
[30:10] type uses. Okay. Automotive. Yes ma'am.
[30:14] That is manufacturing.
[30:16] Again with reaching out to property
[30:18] owners
[30:20] he has expressed interest in buying the
[30:23] properties adjacent to his. And uh then
[30:26] the property next south of that that's
[30:29] where the old there's a huge commercial
[30:32] building there. Tabers. Tabers
[30:36] [name] Deere. Yeah, Tabers. We'll be ask
[30:43] you. He might want to tear down a
[30:45] commercial building and change it
[30:47] to keep it commercial. So that's the one
[30:49] block that we said on report M2
[30:53] because what's a shop next to it? So
[30:55] even that that barn area over there
[30:57] across from Tabers. Are you y'all
[30:59] looking at that as well? The water bar.
[31:02] Yeah. So that that's the railroad that's
[31:04] off of it. That's um that's what 300
[31:09] Martin King is their address. That's
[31:12] owned by the railroad. We're trying to
[31:14] get the railroad themselves to tear that
[31:15] down. Okay.
[31:18] The uh the one below it is the one she's
[31:21] referring to 1170.
[31:24] So partial 117 um right there. Yeah.
[31:30] [name] here. Yeah. Yeah. Okay. Butters
[31:34] that's actually quarters. Yeah. Carters.
[31:38] So, um Okay. So, even like I said, the
[31:42] location where actually where Tabers is
[31:44] across the street where Mr. Odds live
[31:48] 462 right there on this
[31:53] board.
[31:55] Yeah. Like it's like a barn or whatever.
[31:57] Okay. So, what are what are we making
[31:59] it? Uh technically right now fall into
[32:01] the R2 one until he decides what he's
[32:03] going to do with it because right now I
[32:04] just use it for storage of agriculture
[32:06] equipment. It's currently zoned as R2.
[32:09] So it would match up with what we would
[32:11] like to move the rest of it. Well, it's
[32:13] currently manufacturing. It would fall
[32:15] into what we're recommending for R2
[32:17] because it is just a barn and the only
[32:19] thing that's in there is egg equipment.
[32:20] Okay.
[32:22] He's not right here manufacturing with
[32:24] it. This right here is is white not is
[32:28] white not R2. Yeah. It doesn't even show
[32:30] the road right there on that. Right.
[32:31] Okay. So, I think it could be based on
[32:35] that. We could zoom in and see it, but
[32:37] understand it's hard to say. It could be
[32:40] half the building on it. Yeah. Okay.
[32:42] That building covers close to that wall.
[32:43] Right. Right.
[32:46] Yeah. Okay. So, what we're doing right
[32:49] now is just deciding if we want to go
[32:52] forth with it and open it up so that the
[32:54] community would have their actual say on
[32:56] it. Okay. Are y'all just trying to
[32:59] just approving.
[33:01] Yes, ma'am. Any not trying to make it
[33:03] all residential? Most of it. Most of is
[33:07] currently being used as residential
[33:10] except for that's that would stay the
[33:14] same. That would stay commercial. That
[33:16] would stay commercial. Okay. That's the
[33:18] recommendation. Okay. And so even with
[33:21] the recommendation of be the hearing
[33:23] would start and everybody would get a
[33:24] the people themselves would have an
[33:27] opportunity to come in because what
[33:29] we're looking at is what the overall
[33:31] recommendation is but it will be done in
[33:33] hearings to initiate the process is what
[33:36] we're asking. Yeah. So the very bottom
[33:38] of it all the way at the bottom of the
[33:40] list of the bars we're looking at on all
[33:43] of those were added since this was
[33:44] change manufacturing but we don't know
[33:47] like I I haven't found where their
[33:51] permits came in residential homes in
[33:53] that area for in manufacturing. So so
[33:58] that was oh that was part of
[33:59] manufacturing as well.
[34:02] manufactur.
[34:13] I guess one of them was, but I don't
[34:15] know all at least one of them was
[34:16] through specific use permit, but it
[34:18] still puts it residential. So, people
[34:20] are still, even with it being
[34:22] manufacturing, people are just finding a
[34:24] way to make it res anyway. It makes more
[34:27] sense to make
[34:30] what the city wants. Yeah, I think that
[34:32] like you said, we're at a good point.
[34:34] Everybody's seeing what direction we
[34:36] would like to take and with that in
[34:38] mind, we're going to leave it up to the
[34:40] people what direction they desire, they
[34:43] plan to take. We're projecting and
[34:45] they're going to vote on what they
[34:46] really want. So, I think that this give
[34:48] but like I said, I think it's a good way
[34:50] of synchronizing a community because the
[34:53] more neighborhoods you have, the better
[34:54] off that you are and they're all on the
[34:57] same agenda.
[34:59] Uh, does anyone else have any direct
[35:01] question that won't be answered by? You
[35:03] said it's a lot of vacant property over
[35:06] there. Yeah. Yes. Yes. I think y'all
[35:09] going to try to y'all plan on doing
[35:10] something with it or just see right here
[35:12] all of these. It would be the community
[35:15] that would decide or how they're being
[35:16] used. Yeah. Somebody own the owners.
[35:20] Yeah. These are all the owners and this
[35:22] is what currently being vacant. And
[35:24] those will be the people that will come
[35:26] forth and decide what they want, how
[35:28] they would like their their property to
[35:30] go. Yeah. So, it's not Yeah. It's not up
[35:34] to just the city to decide. It's own the
[35:37] property is owned. So, that's why the
[35:39] people are going to have to come in and
[35:40] vote on what they want to do with it and
[35:43] continue with it. And like I said, the
[35:47] the closer we get to it and the
[35:49] recommendation, we'll keep having the
[35:51] hearings until we come to consensus.
[35:54] Signs posted at every intersection a
[35:57] being considered with our phone number
[35:59] so that people can call in and say,
[36:01] "Hey, what's up?" On my property, I want
[36:04] mine to be this, of course. Yeah. Okay.
[36:06] Uh any other uh general comments?
[36:10] If not, we need
[36:14] I uh mayor a motion to I make a motion
[36:19] to consider an approved recommendation
[36:21] from the planning and zoning board uh
[36:24] commission to hold a public hearing uh
[36:26] regarding the the proposed zoning
[36:30] district change from M manufacturing
[36:34] warehousing and wholesaling district to
[36:37] R2 to family residential.
[36:40] etc.
[36:42] I second. Okay, it's been moved and
[36:45] second. All in favor? Motion carries.
[36:48] Okay, so we all go
[36:52] asking.
[36:58] Okay. Okay.
[37:02] Okay. At this time, since we do have our
[37:04] attorneys and they're on the clock, we
[37:07] don't know if they're on the clock
[37:08] officially yet, but they are here. Uh,
[37:11] can we get a recommendation just to go
[37:12] into our exeive executive session at
[37:16] this time
[37:18] just and then we'll come back and finish
[37:20] the remainder of the agenda. Mayor, I
[37:22] recommend that we go into executive
[37:23] session. Okay. Do we have to vote on it?
[37:26] We just recommend You don't have to
[37:28] though, but Okay.
[37:30] All right. Okay. If it's at that time,
[37:33] we're going to ask uh you can sit down
[37:35] and y'all even get to sit in here. We're
[37:37] going to leave
[37:40] and we need to bring Okay, we will go
[37:43] into executive session because they're
[37:45] attorney
[37:47] and then we'll come back.
[37:50] But if you would like to go get a a
[37:53] drink or a bathroom break, it'll be a
[37:55] minute.
[37:58] Come on.
[38:04] [Music]
[38:09] No. What? Oh, excuse me.
[38:32] All right.
[39:01] medicine.
[39:19] I can't
[39:29] 15.
[40:06] Hallelujah.
[40:20] Engage.
[40:33] $600.
[41:18] Why would you
[41:53] Yes,
[41:57] you may come
[41:59] They
[42:08] And that's
[42:14] what
[42:31] won't
[42:51] get whatever.
[43:00] because
[43:07] her
[43:24] we have
[43:33] One of the things when I was president
[43:55] 639
[44:21] certain
[44:34] This is what
[44:44] we discussed.
[44:49] could be in there. Yeah.
[45:10] Nations
[45:13] and human
[45:24] This is what this is from. This is what
[45:34] number
[45:49] Don't preach that
[45:51] fruit.
[46:12] Well, let's put this,00
[46:45] We'd like to start
[46:55] mass. Yes.
[47:14] This is
[47:59] Yeah.
[48:08] [name]
[48:13] starting two miles down.
[48:19] That's all about
[48:47] always
[49:04] know how long this won't be in there.
[49:35] Anders.
[49:42] Guess what?
[50:07] position.
[50:22] You should go
[50:37] It's also
[50:39] obvious.
[51:03] So the
[51:30] Turn to the ground.
[51:32] We have
[51:44] records.
[52:04] Everybody
[52:23] Stop.
[53:17] Your hair looks Beautiful.
[53:24] Your hair looks great. Oh, thank you.
[53:28] I didn't understand why.
[53:31] Thank you.
[54:07] Do you recognize?
[54:16] and he goes out
[54:19] and then he does supervis
[54:44] understand
[55:05] insist
[55:22] or chat.
[55:50] I don't know.
[56:20] told her
[56:24] Just
[56:46] That's why
[57:34] So
[57:59] There were 15,000 kids on Facebook
[58:04] And on the radio,
[58:16] she said what?
[58:40] This was a consultation with the
[58:42] attorney regarding litigation
[58:52] police.
[59:11] The counties
[59:24] not
[59:26] good.
[59:55] Can I just one
[1:00:02] Yeah. represent
[1:00:25] as long as this has been going on.
[1:00:49] Thursday morning.
[1:00:51] So when does that text
[1:01:29] Thursday
[1:01:47] colors.
[1:01:57] more than a month.
[1:02:20] Not
[1:02:22] that
[1:02:40] you're coming in.
[1:02:50] A lot of stuff
[1:03:08] instead.
[1:03:20] driving.
[1:03:43] It is crystals.
[1:04:18] This is where we get our
[1:04:32] scarcity.
[1:04:37] should be done by council because in the
[1:04:40] first
[1:04:42] You know,
[1:04:59] they're also
[1:05:30] That's been the whole thing from
[1:05:34] start.
[1:05:44] And your favorite
[1:06:05] All right.
[1:06:24] possibly
[1:06:39] shoulder musles
[1:06:50] Don't
[1:07:03] [Music]
[1:07:09] ship already.
[1:07:23] and
[1:07:33] centuries.
[1:07:39] I'm sorry. All
[1:07:43] right.
[1:08:02] [Music]
[1:08:04] You're not doing what we should do.
[1:08:19] officers.
[1:08:26] Yeah.
[1:08:34] something
[1:08:50] just
[1:09:08] Everybody's
[1:09:18] She was pushed.
[1:09:43] I think
[1:10:08] would not get in trouble.
[1:10:22] and not return.
[1:10:33] And that's our state capital.
[1:10:38] They're
[1:10:46] not here.
[1:10:58] There's
[1:11:10] a big
[1:11:23] Congress
[1:11:50] today.
[1:11:52] towers
[1:12:07] came out. So they're all
[1:12:16] And he said
[1:12:38] Yeah.
[1:12:53] All kinds of educational areas.
[1:13:01] cartoons.
[1:13:24] There's a list.
[1:13:32] were like
[1:13:36] also Obvious
[1:14:06] Yeah.
[1:14:14] long
[1:14:24] before
[1:14:41] take it
[1:14:50] Star Wars
[1:14:55] like a Star Wars guy. What does he
[1:15:18] They're
[1:15:30] like
[1:15:45] Sure.
[1:16:09] I think I haven't seen that.
[1:16:15] Yes.
[1:16:20] [Music]
[1:16:43] doesn't
[1:17:12] speech.
[1:17:22] understand
[1:17:35] [Music]
[1:17:41] that American
[1:17:53] That's right.
[1:18:18] olives. The tree of olives
[1:18:47] One of the last pictures
[1:19:02] long long long time ago.
[1:19:03] before.
[1:19:25] She had
[1:19:37] What are they talking?
[1:19:55] And raises evacuation.
[1:19:59] Plus evacuation.
[1:20:26] department.
[1:20:53] [Music]
[1:21:13] They should be able to have
[1:21:17] and you go through it and it's when you
[1:21:25] evaluation
[1:21:42] that was last
[1:21:47] four different
[1:21:53] members to receive this.
[1:22:01] way
[1:22:05] and they were slow
[1:22:10] to
[1:22:15] get
[1:22:27] in contact or
[1:22:40] August.
[1:22:47] that I'm sure
[1:23:09] I don't
[1:23:30] Are we afraid?
[1:23:39] [Music]
[1:23:48] Chris
[1:23:59] tell you my experience
[1:24:02] and how possible
[1:24:12] tell you
[1:24:23] change it.
[1:24:31] So that it's yours. It's not something
[1:24:34] else.
[1:24:44] Oh, hell no.
[1:24:48] And then you said, "Okay,
[1:25:18] I don't know why he was
[1:25:32] Well, I understand
[1:25:42] members.
[1:26:13] You got two years.
[1:26:19] Maybe
[1:26:21] she will
[1:26:23] now.
[1:26:37] We had
[1:26:39] the day before
[1:26:44] we also
[1:26:55] thought
[1:26:57] One last
[1:27:25] technology. Sure.
[1:27:39] Captain
[1:28:19] Well, they should tell you
[1:28:22] not in
[1:28:27] We had two items.
[1:28:38] [Music]
[1:28:47] mayor's question.
[1:29:17] up here.
[1:29:37] Like
[1:29:47] chance
[1:29:53] to find
[1:30:08] Now seated
[1:30:14] [Music]
[1:30:34] like
[1:30:53] sat in the car.
[1:30:57] It is cold in here. Oh, well, last time
[1:31:00] was too hot and then too cold.
[1:31:03] I guess when all the body heat went out,
[1:31:04] it got cold. I got to go.
[1:31:08] Trying to keep us from passing out.
[1:31:13] [Music]
[1:31:21] My pen go. Somebody took my ink pin.
[1:31:26] Huh?
[1:31:31] Oh,
[1:31:33] you know, but you know what? They trying
[1:31:36] to get the word from around the world.
[1:31:38] Tower here, they sucking water from
[1:31:40] anybody. You know, we think Trinity.
[1:31:44] They're just they preparing for all that
[1:31:46] suck. You know that that big suck that
[1:31:49] building I mean, you know why can't go?
[1:31:53] They have a war. They came water. So you
[1:31:58] they thought they could use their own.
[1:32:01] All right. So we come back to it's
[1:32:02] covered under all of this. There's no
[1:32:04] more free water.
[1:32:06] They drain that lake to go all the way
[1:32:09] up to other. So we got to have some kind
[1:32:13] of protection. It's bad in California
[1:32:15] though. Oh yeah. It's bad. Like I said,
[1:32:18] when they suck all the ground water,
[1:32:20] we're going to all be in trouble. Okay.
[1:32:22] Is everybody everybody
[1:32:25] get
[1:32:29] [Music]
[1:32:30] back? What item was that?
[1:32:33] Yeah. What? Oh, that was our executive
[1:32:35] session.
[1:32:44] Okay.
[1:32:46] Who's missing?
[1:32:48] Well, Lord, you know, one would have
[1:32:50] thought we'd be fighting over water, but
[1:32:52] you know, Wild West fought over the
[1:32:53] whale and put up fence. Watch us stir
[1:32:56] the day. I said, "Oh, you know, we've
[1:32:58] been fighting over water for a long
[1:32:59] time."
[1:33:10] Okay. One, two. Who's missing? Oh, Gary.
[1:33:14] Here come Mr. Gary.
[1:33:18] I don't know why I call him Gary.
[1:33:19] [name]. I don't know where Gary. It is a
[1:33:22] Gary.
[1:33:24] Okay.
[1:33:27] Yes. Some caffeine is good.
[1:33:31] It's cold. So, we just on 17.
[1:33:35] We come in. We vote on 17. Is that where
[1:33:38] we were?
[1:33:42] What did he say? We just come back to
[1:33:44] just go through the rest. Oh, okay. Then
[1:33:47] we come to Okay. I think when we got we
[1:33:49] were we were on number eight for council
[1:33:51] just to move the table the
[1:33:55] time. Yeah, that's what I'm saying.
[1:33:57] Okay.
[1:33:59] Um
[1:34:01] Okay, we're officially back in session.
[1:34:03] We're up to item number eight. Consider
[1:34:06] and approve a resolution supporting city
[1:34:08] of Crockus application to the Texas
[1:34:10] Department of Transportation 2025
[1:34:12] transportation alternatives set aside TA
[1:34:16] call for projects. Mayor Council, I have
[1:34:20] um under your tab there number eight. Um
[1:34:26] I I'll give you just a quick update and
[1:34:28] on your in your packet as well um under
[1:34:32] item number eight. Um, I left mine in
[1:34:36] here.
[1:34:38] That's the We'll pull it up here. So,
[1:34:41] it's over there. Every year the uh
[1:34:45] every year the uh actually it's every
[1:34:47] two years. Tex comes out with a new
[1:34:49] budget and a and a application period.
[1:34:52] They set aside text funds that you can
[1:34:56] request um grant grant funds from for
[1:35:00] something called traffic alternatives.
[1:35:01] Usually that's um to pay for uh
[1:35:04] sidewalks or bicycle lanes. Um usually
[1:35:07] cities apply for bicycle lanes or
[1:35:08] sidewalks. Uh and we usually put in for
[1:35:11] it. Some years they call us back or they
[1:35:14] give us notice and say, "Hey, you're in
[1:35:16] the running. Go ahead and send in an
[1:35:18] application." Um the last time we got
[1:35:20] the funding for it was in 2019 when I
[1:35:23] got uh the grant for the sidewalks down
[1:35:26] East Golad. Um, and so that was funded
[1:35:30] from this traffic alternatives uh
[1:35:32] project. Uh, we've put in since then and
[1:35:35] haven't got the notice to call or the
[1:35:37] call for applications. Um, they gave it
[1:35:39] to us this time.
[1:35:41] However, this time our
[1:35:45] which I'm I've asked them to to look
[1:35:47] into it for next year, but this year
[1:35:50] we've already been categorized
[1:35:53] in a we did not get all the credit
[1:35:55] points due to our unemployment rate.
[1:35:58] Everything else met full granting 100%
[1:36:01] grant except for our unemployment rate
[1:36:03] and we didn't we didn't get those
[1:36:05] credits and due to that we have a 20%
[1:36:08] match
[1:36:10] since we did not get full credits. So
[1:36:13] any grant funds that we I can continue
[1:36:15] and I can go ahead and ask for um we
[1:36:18] have two projects that are already uh
[1:36:20] Texot has provided some pre preliminary
[1:36:22] engineering on both roughly um close to
[1:36:26] a million dollars and that's with
[1:36:28] easement acquisition engineering and
[1:36:31] everything for sidewalks for buoy from
[1:36:34] the square all the way to the loop and
[1:36:37] then um for Austin from South Fourth
[1:36:41] street
[1:36:43] um down out to the school. The red flag
[1:36:46] on that one is they will not approve any
[1:36:50] TA funds for crossings of railroads
[1:36:52] unless it includes engineering and the
[1:36:55] money for an overhead or an under
[1:36:59] that that you know they're not going to
[1:37:00] lead people up to the railroad tracks
[1:37:01] and cost and and and so we're going to
[1:37:03] have to include that into the budget.
[1:37:05] So, it'll be much more than a million
[1:37:08] dollars due to that um an overhead
[1:37:11] sidewalk crossing over the train tracks.
[1:37:15] So, that being said, now that we have to
[1:37:16] come up with 20%.
[1:37:19] I don't know that, you know, we're in a
[1:37:21] position right now that I think if we're
[1:37:22] spending 200 plus,000, we have other
[1:37:26] things that we need to spend it to in
[1:37:28] infrastructure outside of sidewalk. That
[1:37:30] being said, if it was state funding, I
[1:37:33] would highly recommend let's move
[1:37:34] forward with the sidewalks. So, the
[1:37:37] other project that I have, the other
[1:37:40] project that I have is a downtown master
[1:37:43] plan that was funded um also for another
[1:37:46] city in their last round. The city of
[1:37:48] Huntington got funding for a downtown
[1:37:50] master plan. All of my discussions with
[1:37:53] Texot
[1:37:54] end up with where's your downtown master
[1:37:56] plan? when I'm looking at leveraging and
[1:37:59] bringing in uh texttop funds to help us
[1:38:02] on sidewalks, crossings, parking,
[1:38:05] um lightings, stop signs, any changes to
[1:38:09] our downtown to make it safer. We need
[1:38:12] to have a downtown master plan that is
[1:38:14] developed by architect and engineers
[1:38:18] where they sit down and they look at the
[1:38:21] widths, the roadway widths, the speeds.
[1:38:23] How can they make it safer and come up
[1:38:26] with lots of different options to
[1:38:28] improve on parking, on traffic flow, on
[1:38:32] pedestrian safety, on sidewalks and
[1:38:34] crossings and things of that nature.
[1:38:37] um
[1:38:39] using u the city of Huntington's and
[1:38:41] their develop their project and the cost
[1:38:44] um if if you look in your packet that
[1:38:47] tab number eight is what our cost
[1:38:50] estimates that we're that we believe we
[1:38:53] should apply for what we did was that
[1:38:55] was two from two years ago so we added
[1:38:57] another 10% on top of that this is the
[1:38:59] budget that I'd like to apply for and
[1:39:02] then we would go through the process if
[1:39:03] if getting the grant if we do get the
[1:39:06] grant then we'll have to go out and, you
[1:39:09] know, call for engineers and find
[1:39:11] someone to do the project for us and
[1:39:12] I'll bring that back to council as well
[1:39:14] with an estimated cost.
[1:39:16] Um, but we would have a responsibility
[1:39:19] of 20% of that. I feel like with Tex
[1:39:23] having given us already quite a bit of
[1:39:26] they've already told us that they have
[1:39:28] construction budget monies in their 2026
[1:39:32] year and 27 28 fiscal years. They they
[1:39:36] do a a two-year fiscal for construction
[1:39:39] for all of our downtown streets. If we
[1:39:42] can get this downtown plan done in time,
[1:39:45] they'll commit more money to our
[1:39:47] downtown. Right now, all stay on those
[1:39:50] streets. Yes, ma'am. Right now, all
[1:39:52] they've committed to is restriping
[1:39:54] and putting pedestrian LED LED
[1:39:57] pedestrian flashing signs at the
[1:39:58] existing crosswalks. They have said that
[1:40:01] they'll do that and they'll also put
[1:40:02] some they'll paint some turn lane arrows
[1:40:07] in front of you to where you know you
[1:40:10] can't go straight. You're supposed to
[1:40:11] turn right to go around the square.
[1:40:13] Right. So, they're going to do some
[1:40:14] safety things like that, but they're not
[1:40:15] going to invest into any infrastructure
[1:40:17] until we uh get us a downtown master
[1:40:20] plan. And that master plan will include
[1:40:23] in developing that. That'll include
[1:40:25] community stakeholder hearings, uh, you
[1:40:27] know, public participation, council
[1:40:30] meetings. They'll come to council
[1:40:31] meetings and talk to council. Hey,
[1:40:33] here's some of our thoughts. What do
[1:40:34] y'all like? Do some joint sessions
[1:40:36] between us and the county and so forth.
[1:40:39] Um, and so I would recommend that we go
[1:40:42] ahead and apply for through the TA
[1:40:46] um, for that project to try to get at
[1:40:48] least 80% of a downtown master plan
[1:40:51] covered.
[1:40:52] What's the what's the difference between
[1:40:55] uh the master plan and a strategic plan
[1:40:58] for the city? A strategic plan breaks
[1:41:02] down a master plan. You know, if we get
[1:41:05] you're supposed to have master plans and
[1:41:07] then you can break it down into in this
[1:41:09] year, you know, year one we're doing
[1:41:11] this, year two we're doing this. It
[1:41:14] breaks down a a larger plan into sizable
[1:41:18] pieces. A downtown master plan is pretty
[1:41:21] specific to the downtown traffic. It's
[1:41:23] not a like a citywide master plan. Uh
[1:41:27] what we've developed is a comprehensive
[1:41:30] uh 3 years ago we did a comprehensive a
[1:41:33] city comprehensive plan which addressed
[1:41:35] a lot of the big needs such as housing
[1:41:38] um planning and zoning, parks and wrecks
[1:41:41] infrastructure. And that's just
[1:41:46] um very
[1:41:49] far side, you know, it's long range long
[1:41:52] range. These are the things we need to
[1:41:54] be concerned about. This is the money
[1:41:56] that we should start looking at setting
[1:41:57] aside for these projects, but it's not a
[1:42:00] strategic plan brought brought down that
[1:42:02] I can say, hey, we've adopted this
[1:42:04] strategic plan and this year we've
[1:42:06] committed to setting this much money
[1:42:08] aside for this, this much money aside
[1:42:10] for this.
[1:42:11] So would it be beneficial for us to to
[1:42:13] to um look at is send a strategic plan
[1:42:17] where we would focus on the city as a
[1:42:19] whole instead of one part of the city
[1:42:22] you know. Yeah. I think if if we develop
[1:42:24] this down this master plan then we could
[1:42:27] talk about a strategic plan. Yes ma'am.
[1:42:29] Most of it's just implementation. I just
[1:42:31] said one of the things that we had been
[1:42:32] work working on was looking at the
[1:42:35] downtown because of the number of
[1:42:38] streets that run through that don't
[1:42:40] belong to the city of Rocky even though
[1:42:42] we do it any funding we can get first to
[1:42:45] work with them that that's sort of
[1:42:47] cross-section and then when we broaden
[1:42:48] out like you said around the city we
[1:42:51] won't have that extra support and
[1:42:53] funding because all you know all the
[1:42:55] roads lead through Crockett you know
[1:42:57] sounding cute but those are textile
[1:42:59] roads there they don't belong on to
[1:43:01] Crockett. So any this is additional
[1:43:03] funding that we're we're going to be
[1:43:05] allowed to go after that's not directly
[1:43:08] from ours funding, but but the what we
[1:43:11] found out if we don't do our part with
[1:43:14] what we are capable of doing, we don't
[1:43:16] get their part and that's where we kind
[1:43:19] of bumped heads on. Even when they
[1:43:21] wouldn't fix the roads, they said until
[1:43:22] we fix our sew and our lines on it, they
[1:43:25] wouldn't even run the roads. That's why
[1:43:27] they kept getting a little more
[1:43:28] deteriorated until we were able to do.
[1:43:31] So, what we're proposing is, you know,
[1:43:34] what can we do that they're do their
[1:43:37] part and then we can go back. But we do
[1:43:39] have a plan, a strategic plan. We've we
[1:43:41] we've had them come in and look at it
[1:43:43] and it has been a longterm. It probably
[1:43:45] needs to be updated, but we've been
[1:43:47] hitting and missing at it simply because
[1:43:49] of the emergency of the roads and things
[1:43:51] that we've had busted lines have to
[1:43:54] address and those kind of things. So,
[1:43:56] where we are right now is addressing
[1:43:59] with this money even with the match 20%
[1:44:03] is better than the other 80% up to 100.
[1:44:06] If we can get the 80% from them, we can
[1:44:09] work back from that instead of just
[1:44:11] borrowing. We have to work where we can
[1:44:13] get the most money at this time. money
[1:44:14] is tight. We do know that. Uh so it
[1:44:17] would be beneficial for the city even
[1:44:20] though we we're going to do a long range
[1:44:22] plan but we have to work with where we
[1:44:23] are and if this grant is accessible and
[1:44:26] they've allowed us to apply for it again
[1:44:29] because they don't offer for you the
[1:44:30] invitation every year and I think it's
[1:44:33] to our advantage as a city to move
[1:44:34] forward what they're offering us and
[1:44:36] work around and then expand out to to
[1:44:39] core I mean to synchronize what we're
[1:44:42] actually getting from them. Yeah. Yeah.
[1:44:45] So, this is what the grant is about with
[1:44:48] the free money with 20% match if we're
[1:44:50] accepted. Downtown,
[1:44:53] it's when we're saying downtown is the
[1:44:55] surrounding area like the square which
[1:44:58] is considered
[1:45:00] what would y'all do downtown? No, not
[1:45:02] the not the building. We're talking the
[1:45:04] streets and the and the parking and the
[1:45:08] not development of the building so much.
[1:45:10] It's development of the transport the
[1:45:12] the routing more so than anything. I
[1:45:15] swear getting around it the best way it
[1:45:18] is. It's not doing individ individual
[1:45:21] businesses is doing how you get through
[1:45:23] Crockett with the least amount of
[1:45:27] danger. The square is dangerous
[1:45:29] sometime. But we do know that we've had
[1:45:32] um two different incidents just this
[1:45:33] past year of people getting hit. One
[1:45:35] woman had a lot of surgeries and
[1:45:39] recuperate, you know, rehab to go
[1:45:40] through. Um we've had deaths on the
[1:45:43] square where people have gotten hit.
[1:45:44] Yeah. Crossing um in our past and so um
[1:45:48] and lots of lots of close calls. Yes.
[1:45:51] Safety is an issue on the square. Well,
[1:45:53] you know, if you cross it if any this
[1:45:54] could be used to enforce the no trucks
[1:45:57] through, of course. Right.
[1:46:00] Okay. So, what we're looking for right
[1:46:02] now
[1:46:04] uh to a resolution supporting the
[1:46:07] application. Yes, we may or may not get
[1:46:08] it, but we at least can put an
[1:46:10] application for the money.
[1:46:16] I'll make a motion we approve the
[1:46:17] resolution.
[1:46:19] A second. Okay, it's been moved and
[1:46:22] second. All in favor?
[1:46:24] Okay, motion carries. That moves us down
[1:46:27] to number nine.
[1:46:29] consider and approve appointment of
[1:46:31] representative to serve on the board of
[1:46:32] directors for DP's Texas Council of
[1:46:35] Government.
[1:46:37] Uh mayor and council, this is um this is
[1:46:40] sent to us every year where we appoint a
[1:46:44] uh representative from the city of
[1:46:46] Crockett. The mayor, I believe since
[1:46:48] she's been here, has served in that
[1:46:50] position as representative. So, uh, this
[1:46:53] request for a nomination and
[1:46:55] appointment, um,
[1:46:58] back to that board.
[1:47:02] I nominate
[1:47:04] uh, Mayor [name] to continue to serve
[1:47:06] on the uh, decl.
[1:47:09] Okay, it's been moved and second. All in
[1:47:11] favor? Okay, motion carries. It brings
[1:47:14] us to item number 10. Consider an
[1:47:16] approved bid for phase two and three
[1:47:19] building renovation of the ProLis Center
[1:47:21] at uh 1505 South Street.
[1:47:26] Mayor Council, I have um bids
[1:47:30] um in your packet under items number 10
[1:47:34] as well as I have a couple additional
[1:47:37] umformational packets that I've put and
[1:47:40] it's under tab number 10. So,
[1:47:45] a couple months ago, we finalized all
[1:47:46] the engineering required for phase two
[1:47:49] and phase uh three construction of the
[1:47:52] uh Proalis building.
[1:47:55] If you look on that front page right
[1:47:57] there, and I was trying to pull it up,
[1:47:58] but it's timed out on my my screen.
[1:48:04] It's going to show you a bigger picture.
[1:48:06] So, if you see the darker area, that's
[1:48:09] phase three.
[1:48:10] If you see the hash marks over to the
[1:48:13] left with that front picture there,
[1:48:16] you see this
[1:48:19] right there. Um, if the hash areas,
[1:48:22] that's phase two. So, the goal is to do
[1:48:25] this because we currently have right now
[1:48:27] we have, as we speak, we have 42
[1:48:29] employees in there plus staff, local
[1:48:31] staff, but 42 locally hired people. Um,
[1:48:35] and they're trying to increase that by
[1:48:37] July. Their goal was to hire up to 60.
[1:48:40] Um, so they're continuing to hire people
[1:48:42] out there. They're currently situated in
[1:48:45] that white area in that white area. And
[1:48:48] over there, there's another building or
[1:48:50] there's another room that they're
[1:48:51] currently situated in for current
[1:48:54] operations. So, our goal is to go in and
[1:48:56] build out phase two, which is the hash
[1:48:59] marked area to the left. Okay. Build
[1:49:02] that out. Once that's complete, we move
[1:49:04] all current employees into phase two.
[1:49:07] while we do phase three. That's so we
[1:49:10] didn't have to wait for a year for all
[1:49:12] this construction and then go hire
[1:49:15] people. They were willing to hire people
[1:49:16] right away. And so it's kind of a phased
[1:49:19] approach to where we can work with
[1:49:20] people in the building while we're doing
[1:49:22] construction. So we hired Don Hill
[1:49:25] Architecture and Engineering Firm to go
[1:49:27] and put these specifications together,
[1:49:29] the bid specs. We went out for bid. We
[1:49:33] were talking to four different firms.
[1:49:35] Two of them ended up not putting a bid
[1:49:37] in due to the timeline. Provalis is is
[1:49:40] has really um requested.
[1:49:44] They have uh lots of of
[1:49:49] uh contracts
[1:49:51] that they can fulfill and hire more
[1:49:53] people.
[1:49:55] And
[1:49:57] I forgot where I was going with that. Is
[1:49:59] it that they did they not put a bid in
[1:50:02] because of Okay, that's where I was.
[1:50:04] That's where I was going. They needed
[1:50:06] for those two, right? So, those two
[1:50:09] contractors said they couldn't meet the
[1:50:10] the timeline. That's where I was That's
[1:50:12] what I was trying to tell you. They did
[1:50:13] say timeline or because of uh we hired a
[1:50:18] architect.
[1:50:19] We're required by law to hire an
[1:50:21] architect.
[1:50:22] We're required by law if we spend if we
[1:50:24] spend over $100,000 in public funds for
[1:50:27] a public building, we have to hire
[1:50:28] architect and um engineering.
[1:50:32] Um so that means the price doubles.
[1:50:36] Not in this case. Um using square
[1:50:39] footage, using the footage. Um, I do I
[1:50:42] do agree that if there's something that
[1:50:43] doesn't require architectural
[1:50:45] design and specifications that
[1:50:49] uh we can look at from a common sense
[1:50:50] level and go in and just paint a
[1:50:52] building or reheat rock it or doing
[1:50:54] things of that nature. But this we're
[1:50:56] changing the structure of a lot of this
[1:50:58] building, removing lots of walls to open
[1:51:00] it up. Their initial buildout of this
[1:51:04] building was right at 125 employees. By
[1:51:07] removing these walls, their goal is to
[1:51:10] increase it to 180.
[1:51:13] Um, by removing a bunch of the walls,
[1:51:16] and you're not trying to limit yourself
[1:51:17] to small rooms. Is there any walls out
[1:51:19] there that's that's uh loadbearing?
[1:51:24] None of them are loadbearing. None of
[1:51:25] them are loadbearing. However, they're a
[1:51:28] lot of them are fire rated and required
[1:51:30] by Well, we're ultimately we're taking
[1:51:33] the fire rating out.
[1:51:36] No, cuz you still have to engineer for
[1:51:38] fire and and escape routes. I'm not
[1:51:42] buying it. I understand. Um, however, if
[1:51:46] we go back to what's the legal
[1:51:49] requirement is over 100,000, we have to
[1:51:51] have architecture and engineering.
[1:51:55] Um,
[1:51:58] so that being said,
[1:52:01] we got two quotes. We got two bids that
[1:52:05] were submitted to our bid request. Uh we
[1:52:08] had the bid we had a hear the public bid
[1:52:10] opening uh last week and
[1:52:14] um there were two
[1:52:18] let me get it right here.
[1:52:25] Um
[1:52:27] on page 28 we received two bids. One of
[1:52:31] them was incomplete.
[1:52:35] They only bid on phase two. They didn't
[1:52:37] bid on phase three.
[1:52:40] And then there was other incomplete
[1:52:42] material items that were not included in
[1:52:44] the package such as bid um bonding. Uh
[1:52:47] their performance and bid bonding was
[1:52:49] not included. Um so it was an incomplete
[1:52:53] uh bid. However, if we look at just for
[1:52:56] phase two and we compare it to
[1:52:59] the other uh bidder, their phase two
[1:53:03] bid,
[1:53:05] Langston is still cheaper. Langster
[1:53:07] Langston Industrial Group out of Lufkin
[1:53:11] was the only fully qualified and
[1:53:13] complete bid. Um
[1:53:17] and it came in well our budget on the
[1:53:19] this buildout as you recall in our
[1:53:22] resolution and clo and closure of the
[1:53:24] EDC when we um designated funds uh for
[1:53:28] this construction uh we set aside
[1:53:30] $550,000
[1:53:31] to to dedicate towards this project and
[1:53:34] the bid with those alternates
[1:53:41] is um 300
[1:53:45] I'm sorry. Here it is right here. It's
[1:53:47] in that packet right under item number
[1:53:49] 10. Um,
[1:53:52] uh, 391,400
[1:53:55] for all construction. That's redoing
[1:53:58] everything from the floors, grinding the
[1:54:01] floors down and all the old old flooring
[1:54:03] off, repainting everything, new walls,
[1:54:05] new HVAC,
[1:54:07] um, everything that is included in that.
[1:54:09] Have we allocated 550? Yes, sir.
[1:54:16] and he came in at 3 550 was my
[1:54:21] my best educated personal guess at it
[1:54:25] just using by the square footage and so
[1:54:27] I was very uh pleased to see that it
[1:54:30] came in under that um because we didn't
[1:54:32] have time to hire an engineer to give us
[1:54:34] a preliminary cost estimate. Yes. And
[1:54:37] so,
[1:54:40] um, and I do have these here.
[1:54:45] These packets here show many of their
[1:54:47] other projects.
[1:54:50] Oh, you see, you don't you don't get to
[1:54:52] see it. Anybody that you just pass it
[1:54:54] on. You don't these are some of their
[1:54:55] other projects here and back that
[1:54:57] they've currently been involved in in
[1:54:58] Lin area.
[1:55:01] And they've done construction in
[1:55:02] Crockett area too as well.
[1:55:11] Okay.
[1:55:16] So, in that agenda item,
[1:55:18] um if it they did they were able to get
[1:55:21] um
[1:55:24] contract in in time.
[1:55:27] I would I would request that we when we
[1:55:29] award the bid that we approve the moving
[1:55:32] forward with that price amount. The the
[1:55:35] 39 391. Yes, sir.
[1:55:40] Award the bid to Langston Construction
[1:55:44] and approve the contract notice.
[1:55:48] Yeah.
[1:55:53] Any more questions, concerns?
[1:56:19] Is there any more question concern?
[1:56:23] Are we ready for motion?
[1:56:28] And they said that they could start.
[1:56:30] They would mobilize right away. I
[1:56:32] believe they were planning on starting
[1:56:35] officially by the end of the month, 1 of
[1:56:37] July, and being done by the last of
[1:56:40] September. 100 days, a 100 day
[1:56:42] construction period. Do we do we have a
[1:56:45] guarantee for that? And by their
[1:56:47] contract? Yes, sir.
[1:56:50] They don't they pay us?
[1:56:53] Okay. Any sounds
[1:56:55] other concern, questions?
[1:56:58] Can we get a motion? I'll make a motion
[1:57:00] that we consider and approve the
[1:57:01] construction of the administration of
[1:57:03] services. Uh that's Oh, we're on number
[1:57:06] 10. I'm sorry. That too. Okay. Number
[1:57:10] 10. Okay. Number 10. I'm sorry. Uh
[1:57:12] consider and approve the bid for phase
[1:57:14] two and three building renovations of
[1:57:17] the Provalis Center at 1505 Southport
[1:57:20] Street. I second. Okay. It's been moved
[1:57:23] and second. All in favor?
[1:57:26] And I would at not that you can get in
[1:57:28] the building, but you might after
[1:57:30] looking at the picture know some of the
[1:57:32] people that are working out there.
[1:57:33] They're really excited about it and they
[1:57:36] like their job.
[1:57:39] So I was really excited for them to have
[1:57:41] that many jobs close to home. Okay, that
[1:57:45] bring us item number 11. Consider and
[1:57:47] approve construction administration
[1:57:48] services of Dunb Hill Architect, Inc.
[1:57:52] for PLAL space phase 2 and three
[1:57:54] construction project maning
[1:57:58] this back with the the scope of this
[1:58:00] project
[1:58:02] um I would like the person that designed
[1:58:06] these specifications and bid them out
[1:58:07] and the same person that built this
[1:58:10] building in 2009 and 2010
[1:58:14] uh work with us to ensure that um draws
[1:58:18] when bid when drawdowns are submitted um
[1:58:21] that those are signed signed off on that
[1:58:22] the amount of work is being completed
[1:58:24] according to the percentage of the draw
[1:58:26] down and to ensure that the work is
[1:58:28] getting completed as
[1:58:30] as it was designed and engineered and
[1:58:32] that there's not any things that slip
[1:58:34] through the crack. We have a pretty good
[1:58:36] eye for it, but it you need an arch, you
[1:58:39] need a an engineer and an architect to
[1:58:41] sign off on those things to reduce our
[1:58:43] liabilities. And I would really like to
[1:58:46] have him there for those processes to
[1:58:48] take care of all the inspections so the
[1:58:50] city doesn't have to and take that
[1:58:52] liability upon ourselves because we're
[1:58:54] signing off on something that is
[1:58:55] complete and if we miss something, we
[1:58:59] bear the liability.
[1:59:01] A firm to do that and I have that in
[1:59:04] your packet as well. He's willing to do
[1:59:06] um all bid all inspections and bid
[1:59:10] administration or uh contract
[1:59:11] administration services uh for the
[1:59:14] 14,500 for over the period of the next
[1:59:17] 100 days.
[1:59:20] It's a small price to pay for guarantee.
[1:59:23] Yeah.
[1:59:25] Okay. Any questions?
[1:59:33] dollar.
[1:59:36] Okay. Um, like I said, it's you
[1:59:38] guarantee we see what we see. They know
[1:59:41] what's really there. So, yes, ma'am.
[1:59:43] We're covered.
[1:59:44] Okay.
[1:59:46] Can we get a motion? I move uh mayor to
[1:59:49] consider and approve the construction uh
[1:59:53] administration services of Mr. Don behel
[1:59:56] the architect uh in company uh for the
[1:59:59] puralis phase two and three construction
[2:00:01] project.
[2:00:04] And we get a second. A second. Okay,
[2:00:07] it's been moved and second. All in
[2:00:08] favor? Motion carries. Item number 12,
[2:00:12] award bid, Texas Division of Emergency
[2:00:14] Management Hazards Mitigation Grant
[2:00:17] Program, DR44850313,
[2:00:22] storm warning siren.
[2:00:25] Mayor, if you mayor and council, if
[2:00:27] y'all will go to y'all's packet again.
[2:00:29] Um, starting on page third
[2:00:33] 32
[2:00:36] 32,
[2:00:38] right? Let's see here. I believe it's
[2:00:40] 32.
[2:00:42] Um, we have the bid
[2:00:45] the bids for the storm warning sirens.
[2:00:48] Um,
[2:00:52] and then on page
[2:00:55] uh 34. It shows the map
[2:00:59] and I wish I could pull it up on here,
[2:01:00] but it timed out again on us. Um so
[2:01:06] we got two bids
[2:01:11] and when going through the process, we
[2:01:12] were pretty excited about one
[2:01:15] uh looking at the cost. Um this is all
[2:01:18] um paid for under hazard mitigation
[2:01:21] grant program that we applied to using
[2:01:23] FEMA rollover funds.
[2:01:26] Um
[2:01:28] and when we started looking at the
[2:01:29] specifications, they were half the size
[2:01:32] of what the specified
[2:01:35] um or the required specifications were
[2:01:38] when we bid them out. They weren't the
[2:01:40] right sizing. Um we asked
[2:01:44] um
[2:01:45] different ways to go about it.
[2:01:46] Essentially TDM, Texas Department of
[2:01:48] Emergency Management confirmed um that
[2:01:52] we would have to go with the lowest
[2:01:55] qualified bidder or you know that met
[2:01:57] specifications. Mhm. The next contractor
[2:02:01] that met the specifications
[2:02:04] was um
[2:02:06] Crockett Construction and he'll be using
[2:02:08] Hullbrook
[2:02:10] for all the electrical and pulsating and
[2:02:13] uh Brandon Enus and his firm for company
[2:02:16] for all the electrical and software and
[2:02:20] programming and installation of the
[2:02:22] sirens themselves.
[2:02:24] um they use Crop Construction as the
[2:02:26] general contractor, but they won't be,
[2:02:28] you know, doing the work. They're
[2:02:30] overseeing the project and covering the
[2:02:32] bid bonds and performance bonding as
[2:02:35] required by law. Um and that would be a
[2:02:38] local a local contractor.
[2:02:41] alternate bid one. If you see if on page
[2:02:45] uh on page 35,
[2:02:49] you have alter alternate bid one and
[2:02:51] two. Alternate bid item number one we're
[2:02:55] not asking for. That is we were actually
[2:02:57] after talking with the contractors and
[2:03:00] our engineers.
[2:03:02] Alternate bid number one is a standalone
[2:03:05] solar system that provides the
[2:03:08] electricity for these sirens. They're
[2:03:11] not wired directly to electricity.
[2:03:14] Solar systems and batteries don't last.
[2:03:18] It's new technology and just batteries
[2:03:20] in in of itself just don't last. And
[2:03:24] we're looking at a cons consistent
[2:03:27] maintenance cost to this. If we went
[2:03:30] with the silver option, it's a it's a
[2:03:32] good idea if it's out in the middle of a
[2:03:34] field where there's never going to be
[2:03:35] any access to electricity or whatever.
[2:03:38] However, this these these are all on
[2:03:40] sites that have access to electricity
[2:03:42] and already have generator backups. We
[2:03:44] already they're on generators. So, even
[2:03:46] if electricity goes down, our storm
[2:03:48] sirens will still have access to
[2:03:49] generators. And so, we would we would
[2:03:53] recommend not going with alternate bid
[2:03:54] number one. However, alternate bid
[2:03:56] number two for an additional $2,000
[2:04:00] allows logging and report back systems
[2:04:04] that allow us to not have to go out
[2:04:06] there every 3 months or 6 months and run
[2:04:09] tests on the sirens and and set them
[2:04:12] off.
[2:04:13] It does an internal feedback and reports
[2:04:16] back since they're electronic. Mhm. Um
[2:04:21] it reduces someone liability as well and
[2:04:24] is not a interruption every few months
[2:04:27] for audio testing and people calling
[2:04:31] city hall and wondering what what
[2:04:32] happened and then they get used to it
[2:04:34] maybe and they stop calling city hall
[2:04:36] because they think it's another test.
[2:04:40] So our recommendation would be for that
[2:04:42] total package, the total base of 423
[2:04:45] plus alternate bid number two for a
[2:04:47] total of 425 to Crockett Construction.
[2:04:51] And our engineers did provide a letter
[2:04:52] in there as well. Um and they uh they
[2:04:57] agree that this meets this does meet
[2:04:59] specifications. This is a 100% grant.
[2:05:03] This is a uh 10% grant and we've already
[2:05:07] paid most of that in the upfront
[2:05:08] engineering costs already.
[2:05:11] Okay. So, we we we're responsible for
[2:05:14] 10%. 10%. Yes. And we've already done
[2:05:16] most of that. Okay. The upfront cost of
[2:05:19] engineering and bidding and everything
[2:05:21] usually eats up that initial match.
[2:05:24] I'll make a motion we'll go with
[2:05:26] alternate bid number two. Uh base bid
[2:05:29] and alternate bid number two. base bid
[2:05:32] and alternate bid number two with proc
[2:05:35] construction. Croc construction. Yes,
[2:05:37] sir. Thank you. I see. It's been moved.
[2:05:40] Second. All in favor?
[2:05:42] Motion carries.
[2:05:44] Okay, that brings us to
[2:05:48] 13
[2:05:50] to item
[2:05:53] 13.
[2:05:54] Oh, you said I thought you said what
[2:05:56] else did you say? I thought you said
[2:05:58] open it back up. My bad. Uh consider and
[2:06:01] approve a resolution of the city of
[2:06:02] Crockett, Texas acknowledging the
[2:06:04] satisfaction of conditions of one and
[2:06:07] two in the few simple
[2:06:09] determinable condition of contained in
[2:06:13] the deed to ANA Texas Capital and the
[2:06:16] tax abatement and incentive agreement
[2:06:19] affirming the city's intent not to dis
[2:06:21] dispute the fulfillment of said
[2:06:24] condition and directing that condition
[2:06:27] three and paragraph three recapture for
[2:06:31] default be stricken from said documents.
[2:06:35] Mayor and council, um if y'all have
[2:06:38] questions, please stop me and ask me.
[2:06:40] Just uh just to re
[2:06:43] re uh restate this resolution. Um we
[2:06:48] placed for the first time in any of our
[2:06:50] negotiations with a a a
[2:06:54] business proposal that was saying, "Hey,
[2:06:56] we're going to do all of these things.
[2:06:57] They're making these promises to us when
[2:07:00] we negotiated with them on the land that
[2:07:02] they built the buildings out there on uh
[2:07:06] in the industrial park, the the big
[2:07:07] buildings. Um we put some clawback
[2:07:11] clauses that if they did not perform
[2:07:14] these three conditions that the title
[2:07:17] would the t the deed to the property
[2:07:19] would revert back to the city with no
[2:07:21] action necessary. That's something that
[2:07:23] we hadn't done in the past. And usually
[2:07:26] then it requires us going back and
[2:07:27] negotiating with them after they've
[2:07:29] decided to move on to another city or
[2:07:31] not come to Crockett. Then we're trying
[2:07:33] to buy the property back or you know get
[2:07:35] so
[2:07:37] in doing that it was a it was security
[2:07:40] for the city and remove the liability or
[2:07:42] the risk of them choosing to move away
[2:07:45] and then selling the property off or
[2:07:47] doing something else with it that we had
[2:07:48] no control over. Um, however, ANA Texas
[2:07:52] Capital moved in rapidly and achieved
[2:07:56] those conditions.
[2:07:58] Um, they're not in they're not in any
[2:08:00] default of those conditions currently.
[2:08:03] However, just as a short recap, and I do
[2:08:06] have their Mr. Gary White, their CFO
[2:08:08] here to also expound on anything that
[2:08:10] you guys have. Um, condition one says
[2:08:15] that within 12 months they they will
[2:08:17] begin construction. they did that.
[2:08:20] Condition two says within 3 years,
[2:08:22] within 36 months, they will have
[2:08:24] invested a capital investment of at
[2:08:26] least $3,630,000.
[2:08:29] Um, they've already done that to date.
[2:08:33] To date, and obviously the three years
[2:08:34] are not up, but to date, they've
[2:08:36] invested over $7 million. And Mr. Gary
[2:08:39] can talk about that.
[2:08:42] Condition number three,
[2:08:45] as I've said, they were expecting to
[2:08:47] invest somewhere between three to five
[2:08:49] million dollars initially when they came
[2:08:51] and proposed this project to us.
[2:08:54] As market conditions have changed,
[2:08:57] tariffs, whatever it may be, and they've
[2:08:58] decided, we're going to expand the
[2:09:00] project in Crockett to a greater extent,
[2:09:03] we're going to make that building even
[2:09:04] bigger. they've they're wanting to bring
[2:09:07] in local lending a bank to also help
[2:09:11] them to um to expand their project even
[2:09:14] more than they have currently done. a
[2:09:18] bank and looking at that deed with that
[2:09:20] pretty significant recapture clause. The
[2:09:24] recapture clause number condition number
[2:09:26] three says that if they if such
[2:09:30] default is the result of failure of
[2:09:32] developer owner to use the real property
[2:09:34] exclusively
[2:09:36] for a functioning facility to
[2:09:37] manufacture materials that enhance the
[2:09:39] durability of wood products.
[2:09:42] that clause
[2:09:44] is what they've asked and that what I
[2:09:47] personally agree is probably overly
[2:09:50] restrictive. If the market continues
[2:09:52] changing and they want to expand their
[2:09:54] product to something outside of wood
[2:09:58] preservation, they want to do some steel
[2:10:00] manufacturing or anything else, any
[2:10:02] other
[2:10:05] lines that they want to add and invest
[2:10:07] even more money and hire more people, we
[2:10:09] say they can't. So, if they've invested
[2:10:12] their money and the bank has invested
[2:10:13] another few million dollars and we say,
[2:10:16] "Hope, that's our property because you
[2:10:17] decided to expand even more, which is a
[2:10:20] good thing in all reality at this point
[2:10:23] with that major the amount of investment
[2:10:25] that they currently have out there. We
[2:10:26] don't want that property back because
[2:10:27] they're going to be paying taxes. Even
[2:10:28] if they don't hire jobs
[2:10:31] and they don't follow through, we don't
[2:10:33] want that property back. We don't want
[2:10:34] that much investment, capital investment
[2:10:37] or assets to worry about and become non
[2:10:40] and become tax exempt at that point. Now
[2:10:43] that they are fully invested in the city
[2:10:45] of Crockett and their funds and they
[2:10:47] want to further invest with bank
[2:10:49] lending,
[2:10:51] they're going to have to requitable.
[2:10:56] Well, how do you hold them to how do you
[2:10:58] hold them accountable to perform? I
[2:11:00] understand that you they're going to
[2:11:02] have to perform, but what is in the
[2:11:05] agreement to hold them accountable. Is
[2:11:07] there any way that we could go back in
[2:11:09] there and give other options for the
[2:11:12] clause? Because all the performance
[2:11:14] clauses remain in there. Okay. There's
[2:11:16] still performance clauses in there that
[2:11:17] says that they have to hire and be
[2:11:21] functioning for the next 10 years or
[2:11:23] they have to pay back um all tax
[2:11:25] abatements as well or any other
[2:11:27] incentives incentives that we provided
[2:11:29] them. So the recapture clauses are still
[2:11:32] in there. It's just this condition that
[2:11:33] says we're going to take the property
[2:11:35] back, right? We don't want the property,
[2:11:37] right? Okay. So basically, so just like
[2:11:40] I'm going to give you an example. So
[2:11:42] just like we have like Lincoln Lumber
[2:11:44] like right now Lincoln Lumber is no uh
[2:11:46] longer in business. Um and my
[2:11:49] understanding is they are so and and we
[2:11:52] went into agreement a partnership with
[2:11:54] the county. Right. So at this point in
[2:11:57] time when I looked at the recapture
[2:12:00] clause we're recapturing that property
[2:12:02] and the equipment. No ma'am.
[2:12:05] What what what are we doing? Cuz we did
[2:12:07] not provide them their property or their
[2:12:09] equipment or their building. So we can't
[2:12:11] recapture. So with it it this this um
[2:12:16] relates to the issue. So I'm I don't
[2:12:18] want to get too far off topic because
[2:12:20] this is talking about another contract,
[2:12:21] but Lincoln Lumber.
[2:12:24] So the Lincoln Lumber, they decided to
[2:12:27] close their business down. Now they have
[2:12:31] to repay us all tax abatements that
[2:12:33] they've that they've been provided,
[2:12:36] right? because they did not fulfill
[2:12:38] their full 5-year um
[2:12:42] agreement. So, they have to pay us.
[2:12:44] We're recapturing all incentives and
[2:12:45] abatements that we provided them.
[2:12:47] Incentives. Incentives because they did
[2:12:49] not perform for the full 5 years like
[2:12:51] the contract said. That's the clawback.
[2:12:54] Okay. However, even with that building
[2:12:57] empty, now they're going fully on the
[2:12:59] tax roles.
[2:13:00] And so it's it's their it's even though
[2:13:03] they decided to shutter their current
[2:13:05] business, it's in their best interest to
[2:13:07] find another company to move in and take
[2:13:10] that load off of them because they're
[2:13:12] paying taxes and they're pay they're
[2:13:13] keeping a few people out there just to
[2:13:15] keep the place mode and presentable to
[2:13:17] show to other
[2:13:20] potential businesses. So what exactly we
[2:13:24] have with that? Yeah. But with that well
[2:13:27] with with that being said though I mean
[2:13:28] I I mean kind of did a little research.
[2:13:30] I was just looking and uh I was looking
[2:13:33] at a TML uh the 2017 um the uh
[2:13:39] uh 380 agreement basically. 380
[2:13:41] agreement. Yeah. I'm looking at that and
[2:13:43] it was basically um giving us um
[2:13:49] approval or or let's see for protection
[2:13:53] uh approval for protection. Let me see.
[2:13:55] Let me read this to you here. Um, it
[2:13:58] says the agreement should be provide
[2:14:00] remedies for the city if if the program
[2:14:03] fails to serve the for public purpose.
[2:14:06] Right. So, what I'm what it's saying is
[2:14:08] giving us an opportunity to recoup or
[2:14:10] recover that that property. Now, from my
[2:14:13] understanding as we talk, we didn't even
[2:14:15] get that property appraised and
[2:14:19] uh sold it for a little nothing. So that
[2:14:22] property could be possibly we possibly
[2:14:25] have uh approximately 2 million probably
[2:14:29] invested who in that in that property
[2:14:32] giving them that property. Yes. Matters.
[2:14:34] No matter being that we didn't have that
[2:14:37] property appraised, we don't even know
[2:14:38] what we have in it, right? Yeah. At 10
[2:14:42] acres. So,
[2:14:44] yeah, but it was it's 19 acres out there
[2:14:46] either way either way on the loop that's
[2:14:48] currently I think appraised at
[2:14:50] approximately $2 million, right? So, so
[2:14:53] right now and that's the values the
[2:14:55] values that we assessed at it was it was
[2:14:58] an empty piece of property and we had a
[2:15:00] business owner that was wanting to make
[2:15:01] investments in it. So, and and hire jobs
[2:15:05] all of which they've they've they've
[2:15:08] kept their end of the bargain. When
[2:15:10] you're talking about you said remedies,
[2:15:13] it says this this tax abatement has all
[2:15:16] the remedies still in there. All the
[2:15:18] recapture clauses that you're talking
[2:15:19] about are still in there on on page
[2:15:22] number 43 of the tax abatement. It still
[2:15:25] has all the recapture clauses left in
[2:15:27] there. All we're saying is we don't want
[2:15:29] to take that property back if they
[2:15:31] decide to expand it even greater and do
[2:15:33] something in steel production or
[2:15:36] plastics or something else. We're not
[2:15:39] going to play a legal game and and take
[2:15:42] that property back when they're when
[2:15:44] they owe money to the bank and they've
[2:15:45] already made investments of over 7
[2:15:47] million because at the end of the day,
[2:15:48] so the recaptures are still there. Isn't
[2:15:50] that is that the issue we started with
[2:15:53] here is is that we're limiting them to
[2:15:56] what they can manufacture. Well, is
[2:15:58] there and we we've gotten off track
[2:15:59] here.
[2:16:00] So with that being said, when if we're
[2:16:03] limiting them with what they can
[2:16:05] manufacture, why can't we go in with a
[2:16:08] recapture clause and amend that
[2:16:10] recapture? No, no, the recapture is
[2:16:12] here. But a it's amend the recapture
[2:16:16] cost. Mayor, I I I move we that's a
[2:16:18] different we move on the previous
[2:16:20] question. I'm still in the discussion. I
[2:16:23] move we move on the previous question. I
[2:16:25] think we discuss but you can call it.
[2:16:27] Okay. You can go. No, I'm Yeah, but we
[2:16:30] in discussion though. Discussion is
[2:16:32] first. So, I mean I do have some I do
[2:16:34] have some questions. No, he said he can
[2:16:37] move to it if he Okay. Well, I'm I'm
[2:16:38] talking uh Mr. Mo. I'm I I'm doing the
[2:16:43] thing of it is Excuse me. Did they're
[2:16:45] calling for end of the discussion at
[2:16:47] this point. So, with that being said, I
[2:16:48] understand M Did you understand? I
[2:16:50] understand that. Okay. But right now,
[2:16:52] but you have the discussion. He can call
[2:16:55] to end the discussion to move to the
[2:16:58] question. Anybody can call to move to if
[2:17:00] you can get a a you can call and if he
[2:17:03] can get a second. The discussion is in
[2:17:05] and it can go to the vote. I second.
[2:17:07] Okay. It's been moved and second. It's
[2:17:09] time to go to the vote.
[2:17:14] All in favor? If we're in favor of
[2:17:16] moving to the vote. Okay. And they're in
[2:17:20] favor to move it to the vote. Okay. Now
[2:17:22] we're up to the vote.
[2:17:25] Okay.
[2:17:29] [Music]
[2:17:31] Do do we move on this or or on 14? This
[2:17:34] is the uh agenda item number um 13. Is
[2:17:38] it 13? Is it 13? Initially it's 13. This
[2:17:41] is the resolution that sets the premise
[2:17:44] on what the intent is. We're going to
[2:17:47] consider that item condition number one
[2:17:49] is satisfied that they started
[2:17:51] construction. Item number two that they
[2:17:53] invested over 38.6 million within 36
[2:17:57] months. We realize that that's um
[2:18:00] satisfied. Okay. Well, I'll make a
[2:18:01] motion we approve the resolution. I'll
[2:18:03] make a motion we approve the resolution.
[2:18:06] I second. Okay. Has been moved and
[2:18:08] second. All in favor?
[2:18:10] Motion carries. That opposes
[2:18:21] us to item number 14. 14. Uh consider
[2:18:26] and approve amending deed conditions and
[2:18:28] tax abatement and incentive agreement of
[2:18:31] ANA Texas Capital LP. This is just a
[2:18:34] little bit more uh detailed on that same
[2:18:36] item. council approved to do such, but
[2:18:40] I'm presenting you the red line on the
[2:18:42] deed itself and the red line on the tax
[2:18:45] abatement itself. Let me pull it up real
[2:18:47] quick. So, if you go to your I wish I
[2:18:51] was working on the laptop and it
[2:18:53] wouldn't have turned off. So if you go
[2:18:56] to page number 38, this tax abatement
[2:18:59] agreement
[2:19:01] on p on the second page of that
[2:19:02] agreement on page 39, well I have one
[2:19:05] red line that's going to be stricken
[2:19:10] which says and three. So item number one
[2:19:14] and number two stay in there, right?
[2:19:16] They stay in there. Item number three
[2:19:17] says use the real property exclusively
[2:19:20] for a facility to manufacture materials
[2:19:22] which enhance the durability of wood
[2:19:24] products for a period of at least 10
[2:19:26] consecutive years. We're striking that
[2:19:28] to not restrict them only to wood
[2:19:30] product preservation materials. Okay. On
[2:19:34] page, if you go to page
[2:19:37] um seven of nine, which is in your
[2:19:40] packet pa, which is page 44,
[2:19:43] page seven of the actual tax abatement
[2:19:45] agreement, this recapture for default
[2:19:48] clause
[2:19:50] of the tax abatement stricken, which
[2:19:53] says if such default is the result,
[2:19:57] our recapture our our requirement for
[2:19:58] recapture. If such default is the result
[2:20:01] of failure of the owner to use the real
[2:20:03] property exclusively for a functioning
[2:20:05] facility to manufacture
[2:20:07] materials that enhance the durability of
[2:20:08] the wood products that clause be
[2:20:11] restrict be be stricken which is the
[2:20:13] recapture clause. The other clauses that
[2:20:15] you had mentioned all remain all the
[2:20:17] performance agreements saying that they
[2:20:19] have to hire um x number of people they
[2:20:22] have to keep this many people on on
[2:20:24] payroll. They have to um invest a
[2:20:27] certain number. So all of those they
[2:20:29] have to keep in there and we're keeping
[2:20:30] it. We're not touching those. Okay. So
[2:20:32] basically so basically what I'm asking
[2:20:33] is so if if if
[2:20:36] you know which I understand we have to
[2:20:38] have a courting phase but if they uh
[2:20:41] decide to just pick up and leave and
[2:20:44] that means that all those people that
[2:20:46] they did hire will no longer have jobs.
[2:20:48] We don't have anything to hold that
[2:20:50] company actually accountable to stay
[2:20:52] here to the only thing that we can hold
[2:20:54] them accountable for is anything that
[2:20:57] we've invested into their business. All
[2:20:59] incentives that we provided them which
[2:21:01] be tax abatements. So within 10 years if
[2:21:04] by year 8 they say you know what we're
[2:21:07] moving back to Canada and we're shutting
[2:21:08] this down and we're going to sell it off
[2:21:09] to somebody else. Everything that
[2:21:11] they've been abated all the tax
[2:21:12] abatements that's been provided to them
[2:21:14] they have to pay those back. all
[2:21:15] incentives that we provided to them in
[2:21:17] um utilities, they have to pay those
[2:21:20] back. Um go ahead. I just had a question
[2:21:23] for Mr. Perry. Yes. Yes. Um would would
[2:21:28] you mind taking a stand, please? Just a
[2:21:31] quick question.
[2:21:33] So um and
[2:21:36] so in regards to
[2:21:39] um what I'm reading here under recap
[2:21:41] recapture for uh default it says um to
[2:21:45] be strucken if such default is the
[2:21:48] result of failure of developer owner to
[2:21:52] use real property exclusively for uh
[2:21:55] functioning facility to manufacture
[2:21:57] materials that enhance the durability of
[2:22:00] wood products etc. and and it reads
[2:22:02] further on um can you kind of give us an
[2:22:05] example of some products that you
[2:22:08] are processing or making?
[2:22:12] Okay. Well, the one of the primary
[2:22:15] products Yes, sir.
[2:22:17] Yes. a wrap that goes around.
[2:22:22] Yes, sir.
[2:22:25] Yes, sir.
[2:22:28] Right now we have a supplier
[2:22:31] that is providing us that mesh. Yes. And
[2:22:34] we would like to be able to bring in
[2:22:36] water and do that mesh ourselves. So
[2:22:39] that's that's steel. Yes sir. Steel. So
[2:22:43] with this clause that would denote you
[2:22:47] doing more than wood products would it
[2:22:49] not? Yes sir. I I understand. Thank you
[2:22:53] sir. And also with us amending that
[2:22:58] clause and adding extra products or
[2:23:00] extra whatever you're requesting to
[2:23:03] manufacture in that would also allow you
[2:23:07] to make other products. Am I correct?
[2:23:09] More capital. If if we if we could know
[2:23:12] how to forecast and and guess in 10
[2:23:15] years what what things they may want to
[2:23:17] manufacture. Yeah. We would be putting a
[2:23:19] catalog of information in there or just
[2:23:22] strike that re that restriction. Yeah.
[2:23:25] On them, you know, because
[2:23:28] Yeah, it could be done. It could be done
[2:23:30] either, you know, either way. For sure.
[2:23:32] Yeah. My main my main concern is is the
[2:23:34] um 380 agreement. uh where is where the
[2:23:38] TML recommends us to put place a rec
[2:23:41] capture clause in the agreement so if
[2:23:44] they decide to pick up those people are
[2:23:46] out of jobs that they no longer have any
[2:23:49] jobs and then the property they could
[2:23:51] end up selling it to someone we really
[2:23:53] don't care for them to be here in the
[2:23:56] city of they're under um that property
[2:23:58] is under deed restrictions so not just
[2:24:01] any property can come in there there's a
[2:24:03] lot of manufacturing properties that are
[2:24:05] not allowed in there under the deed
[2:24:07] restrictions. Um, secondly, like you
[2:24:10] said, the recapture clauses, all of
[2:24:12] those stay in there. It's just the
[2:24:13] recapture for them choosing to do
[2:24:16] something in addition to wood product,
[2:24:18] uh, you know, preservation. Um, so this
[2:24:21] one is more specific in that this this
[2:24:24] motion, what I'm requesting is, and I I
[2:24:27] wrote it down just talking to our
[2:24:29] attorneys, the things that the attorneys
[2:24:30] need in order to amend the deed and
[2:24:32] amend the tax abatement agreement is
[2:24:36] is to approve to amend the deed
[2:24:39] conditions
[2:24:40] the deed conditions as redlinined in our
[2:24:43] agenda packet and direct city staff to
[2:24:45] prepare a material correction deed to be
[2:24:47] recorded. So otherwise we're going to
[2:24:50] have to go through the process of a new
[2:24:52] closing. We're going to have to reclose
[2:24:54] on that property if if unless we do a
[2:24:57] material correction be where it's just
[2:24:59] striking
[2:25:01] wording within the deed and we keep that
[2:25:03] same deed on file. So, I wanted to
[2:25:05] clarify that as well. We're not wanting
[2:25:08] to just amend the deed. We're wanting to
[2:25:10] file a material correction to that deed
[2:25:13] that says we do not intend to recapture
[2:25:16] the property if they choose to do
[2:25:17] something outside of what we read the
[2:25:20] current wood products wood wood product
[2:25:22] preservation. Yeah. My whole thing is
[2:25:24] just holding the company accountable for
[2:25:28] uh providing the services in u for the
[2:25:31] community that they stated that they
[2:25:33] would would provide.
[2:25:34] All of those stay in the All of those
[2:25:36] stay in the abatement agreement. Well, I
[2:25:38] would like to make a motion to uh number
[2:25:41] 14, consider and approve uh amending the
[2:25:44] deed conditions and tax abatements and
[2:25:46] incentive agreements of ANA Texas
[2:25:49] Capital LP. I second. Okay, it's been
[2:25:51] moved and second. So, it's been a um
[2:25:53] moved and seconded. Can we amend that
[2:25:56] motion to Can you look at this and read
[2:25:59] it and and verify that you like the
[2:26:01] wording
[2:26:03] to make sure that I properly record it?
[2:26:09] Is that is that proper? Yes, that was
[2:26:14] under my attorney's adisement that we be
[2:26:16] sure to properly word it. It's only if
[2:26:18] he approves it.
[2:26:22] Understood. recommend a motion that we
[2:26:26] um move to u I move that we approve to
[2:26:31] amend the de um conditions as read as
[2:26:34] red line in our agenda packet and direct
[2:26:37] city staff to prepare a material
[2:26:40] correction deed to the to be recorded
[2:26:43] and I further direct city staff to
[2:26:46] prepare a first amendment to the a first
[2:26:48] amendment to the ANA Texas capital tax
[2:26:51] abatement and incentives agree ment as
[2:26:54] redlinined in our agenda packet to be
[2:26:57] executed by the mayor.
[2:27:02] So this this amends the lawyer it amends
[2:27:06] both our tax abatement and it amends our
[2:27:08] deed under a materials correction deed
[2:27:10] to strike clause number three. Okay.
[2:27:14] It's on the motions on the floor.
[2:27:18] Then I second it. A second. Oh it's been
[2:27:20] second. It's been moved and second. All
[2:27:22] in favor? All oppose.
[2:27:26] Okay. Motion carries. That brings us to
[2:27:28] item number 15. Consider and approve a
[2:27:31] resolution of the city of Crockett
[2:27:33] Council concerning groundwater
[2:27:35] withdrawal application by Redtown Ranch
[2:27:38] Holdings LLC and Pine Bliss LLC.
[2:27:46] Mayor and Council. Um,
[2:27:50] this is a resolution
[2:27:52] recapturing the events of this past week
[2:27:55] and what we've learned to be our highest
[2:27:57] concern um and probably one of the
[2:28:00] greatest concerns that we should be
[2:28:02] focused on over the next um and
[2:28:05] potentially even a few years um that
[2:28:09] this process is going to um impact our
[2:28:12] actions. Uh we need to
[2:28:15] um we have we just in short we've had
[2:28:18] groundwater well applications to drill
[2:28:21] wells in Anderson County and Henderson
[2:28:23] County.
[2:28:25] Um the wells that are planned for
[2:28:30] Houston County have not even are not
[2:28:32] even required to be uh permitted and
[2:28:35] application is not even required. Um
[2:28:38] that being said, this is put together.
[2:28:40] Um there's an investment firm that has
[2:28:43] purchased a big ranch and is wanting to
[2:28:46] drill a lot of wells that are very close
[2:28:49] to us that we have high suspicion that
[2:28:54] will impact our aquifers that we
[2:28:56] currently have municipal wells pulling
[2:28:59] water from. We currently also purchase
[2:29:02] water from uh surface water from Houston
[2:29:05] County Lake who is fed by artisian and
[2:29:09] springfed elements.
[2:29:11] We feel like that massive amount of well
[2:29:17] pumping from our aquifers will reduce
[2:29:21] aquafer pressures
[2:29:24] to impact our lake, our springfed lake.
[2:29:26] Once those pressures drop, then artisian
[2:29:29] and springfed capacities of the lake we
[2:29:32] feel will be directly impacted.
[2:29:35] We also feel like our municipal wells
[2:29:37] are going to be impacted. There was a
[2:29:40] project recently, it was called the
[2:29:42] Vista Ridge Saws project that
[2:29:44] transported water to San Antonio.
[2:29:47] After their exportation and their
[2:29:49] pumping, there was hundreds of wells
[2:29:52] that were impacted and went dry. There
[2:29:55] was many wells that required to be redug
[2:29:58] and and and redrilled
[2:30:01] um to reach the aquifer because the
[2:30:04] water table drops. The water tables
[2:30:06] shift up upon that massive amount of
[2:30:08] pumping. That being said,
[2:30:12] I'm requesting council to by this
[2:30:14] resolution allow myself to represent the
[2:30:18] city and legal counsel that we can bring
[2:30:22] on board to go and contest at the public
[2:30:25] hearing for these applications
[2:30:29] and make sure that the city to do our
[2:30:31] best to make sure that the city is
[2:30:34] recorded as an affected party that we
[2:30:37] have standing to go to a contested case
[2:30:39] hearing and fight this with
[2:30:42] representation coming from hydraologists
[2:30:45] and other uh geotechnical groups as well
[2:30:48] as an attorney that um can fight this
[2:30:51] and give us our best chance of survival.
[2:30:58] Everything that I'm hearing is there's
[2:31:01] not a good chance for us just to shut
[2:31:02] this down. These are really deep
[2:31:04] pockets, big investors, and they will
[2:31:07] steamroll us in a heartbeat. We're
[2:31:10] really reaching out to other counties
[2:31:11] and cities and water districts and water
[2:31:14] and supply corporations, and we're
[2:31:16] wanting to form coalitions after the
[2:31:18] fact, whoever gains admittance as an
[2:31:20] affected party. We would like to work
[2:31:22] together with these other organizations.
[2:31:25] And that's what this resolution also
[2:31:26] lets allows me to do is to reach out to
[2:31:29] these other organizations and work
[2:31:31] together to give us our best shot that
[2:31:34] we um that our concerns are mitigated
[2:31:39] whether it's by volume that they have to
[2:31:41] reduce the amount of water that they can
[2:31:43] pump out, they have to reduce the number
[2:31:45] of wells, whatever it is that gives us
[2:31:49] some insurance
[2:31:52] and can and help us know that our
[2:31:54] current water supply and or future water
[2:31:57] supply is not going to be negatively
[2:31:59] impacted by this potential export group.
[2:32:04] [name], you might should explain to to our
[2:32:07] audience and those who are watching why
[2:32:09] the 11 wells in Houston County don't
[2:32:12] have to be permitted. So, there's
[2:32:14] something called under under the um and
[2:32:17] and I have about two weeks worth of
[2:32:19] education on this, so please forgive me.
[2:32:21] I'm I'm going to be pretty limited. Um,
[2:32:24] we have I have utility superintendents.
[2:32:26] They have all the TCQ licensing and and
[2:32:29] understand local operations, but we know
[2:32:32] that where this water where our water
[2:32:34] comes from, it comes from the lake. And
[2:32:36] this water comes from our water comes
[2:32:38] from municipal wells. For the last
[2:32:40] couple of days, we've been on our
[2:32:42] municipal wells. We have not been buying
[2:32:44] water from the lake due to their plant
[2:32:46] being shut down from and receiving
[2:32:48] lightning damage. So, we need wells. We
[2:32:52] also need the lake, right? We want both.
[2:32:54] We want assurance that we are going to
[2:32:55] have water now and in the future.
[2:32:58] The local Houston County is not under
[2:33:01] something called a groundwater
[2:33:02] conservation district. A groundwater
[2:33:05] conservation district is not a fixall.
[2:33:08] People can still drill. As you see,
[2:33:09] people are drilling and or or or
[2:33:12] planning to drill in Anderson County and
[2:33:14] there's a likely very good likelihood
[2:33:16] they will proceed with those wells.
[2:33:19] However, in Houston County, there's not
[2:33:20] even a notification process required. If
[2:33:23] they want 11 or if they want 20 or they
[2:33:25] want 50, there's not a process that they
[2:33:29] have to go through to show that this
[2:33:30] prop this water is going to be used,
[2:33:33] what it's for, are they going to waste
[2:33:35] it locally? Are they wanting it for data
[2:33:36] centers? Are they want to export it? Are
[2:33:38] they wanting to
[2:33:40] water cows with it? And so there's none
[2:33:43] of this process is required when there's
[2:33:45] not a groundwater conservation district.
[2:33:47] Currently
[2:33:49] I can't tell you from a personal
[2:33:51] standpoint and you know from a legal
[2:33:53] stand we can't tell you that do we want
[2:33:56] a groundwater conservation district or
[2:33:57] not. However, we know that that was one
[2:34:02] layer of protection that we should
[2:34:03] probably consider, right? And and and
[2:34:06] find out if that's something that we
[2:34:07] want or not because they can start
[2:34:10] drilling the those wells in Houston
[2:34:11] County right now. And they may already
[2:34:12] have. I don't know. We're hoping that
[2:34:15] it's based on some metrics that they put
[2:34:18] together, costbenefit analysis that they
[2:34:19] need all of those wells to be, you know,
[2:34:22] to to be successful enough and make
[2:34:24] enough profit to be worth their while.
[2:34:26] and that if it's if and if it's delayed
[2:34:28] in Anderson County that they just don't
[2:34:30] start the ones in Houston County. That's
[2:34:31] our best hope, but we can't stop it.
[2:34:34] There's not a process to stop it. But
[2:34:36] right now, they're built they're
[2:34:37] drilling their their plans are to drill
[2:34:39] 54 wells. Um I'm sorry, 55 wells. 55
[2:34:44] highcapacity wells. the wells in Redtown
[2:34:48] Ranch that are really close to us.
[2:34:52] That's
[2:34:53] using their permit numbers that they've
[2:34:55] asked for is about 52 times the water
[2:34:59] consumption of the city of Crockett.
[2:35:00] It's about three and a half times the
[2:35:01] city of Tyler that they use on a on a
[2:35:04] daily basis. So, it's a lot of water
[2:35:07] coming out of our little bitty portion
[2:35:08] of our county. It's dangerous. Um, and
[2:35:12] so the goal is to go through this
[2:35:14] process,
[2:35:16] make sure we have a seating, a seat at
[2:35:18] the table to fight this to our best
[2:35:19] ability, to slow it down, to make sure
[2:35:21] that they provide all required processes
[2:35:26] to ensure to us that they're not going
[2:35:27] to be impacting our water supply. But
[2:35:30] also with the mitigation clause and and
[2:35:33] to try to provide some mitigation
[2:35:35] efforts in the event that they do impact
[2:35:38] our water supply.
[2:35:41] Okay.
[2:35:44] So, the resolution is everywhere. I make
[2:35:47] a motion we approve the resolution. I
[2:35:49] second. Okay. It's been moved and
[2:35:51] second. All in favor? Motion carries.
[2:35:55] Um, bring us to item number 16.
[2:35:58] Consider and approve engagement
[2:36:00] agreement with law firm for legal
[2:36:02] representation with water whale
[2:36:04] application.
[2:36:06] That was the discussion we had. Mayor
[2:36:08] and council, y'all received the uh an
[2:36:11] engagement letter of our recommendation
[2:36:14] for an attorney to represent us to draft
[2:36:17] it. And initially, my first steps that I
[2:36:20] I'm requesting of them is to draft our
[2:36:22] contest letter to make sure that we hit
[2:36:24] every checkbox available to make sure
[2:36:26] that we become an affected party and and
[2:36:30] can gain access to a contested case
[2:36:32] hearing. and then they will follow
[2:36:33] through with us on that process if we do
[2:36:36] get accepted as an affected party. Um,
[2:36:39] and they will also show up and represent
[2:36:41] us at Thursday's hearing. We have a
[2:36:44] hearing in Jacksonville.
[2:36:46] Um,
[2:36:48] I have I have the information for y'all.
[2:36:50] Um, anybody that wants to attend, we do
[2:36:53] feel like there's going to be a lot of
[2:36:54] people. There may be significantly more
[2:36:56] people than can fit in the room, and
[2:36:58] that's fine. Uh, we want as many people
[2:37:01] there
[2:37:02] if they have if y'all have adequate
[2:37:04] concerns that your water's going to be
[2:37:06] impacted, the hearing is going to be in
[2:37:08] Jacksonville and I'll get you the
[2:37:09] address. I'll get the address to anybody
[2:37:11] that wants to attend, but it's going to
[2:37:12] be at 1:00 this Thursday.
[2:37:17] Um, but that being said, I would like to
[2:37:20] retain the services of Matthews and
[2:37:22] Freeland attorneys at Law.
[2:37:26] I'll make a motion that we approve the
[2:37:28] engagement agreement with Matthews and
[2:37:30] Freeman Law Firm for legal
[2:37:32] representation with water well
[2:37:34] application. Okay, it's been moved and
[2:37:36] second. All in favor?
[2:37:39] Motion carries and that would conclude.
[2:37:43] Well, yeah, another consultation for and
[2:37:46] on item number 18. Can we get a We've
[2:37:50] talked about Yeah. Mayor and council, I
[2:37:53] would also like um due to the the time
[2:37:56] um I would request that we if there if
[2:38:00] council would be agreeable that we move
[2:38:02] that we uh table item number 18 to a
[2:38:06] next meeting. Um, [name], I want Well, I
[2:38:10] didn't I wasn't making I was asking. So,
[2:38:12] if somebody would like to make a motion,
[2:38:14] I'll make a motion. We table
[2:38:16] what? You did 17 and 18.
[2:38:20] 17. We've already been in. Yeah, we
[2:38:22] covered 17 already. 18. Table 18. I
[2:38:26] second. Okay. And now I guess
[2:38:28] discussion. Second. All in favor?
[2:38:34] Okay. Motion carries. Carries. Um, I
[2:38:36] would like to say something. I I'd like
[2:38:38] to ask um [name] to place on the next
[2:38:41] agenda a discussion of on leak and
[2:38:44] lumber. Give us an update on that and
[2:38:47] the um agreement on that so we can
[2:38:50] better understand how we're moving
[2:38:51] forward. I'm I'm preparing a report
[2:38:53] already to council. I'll have it for
[2:38:54] you. All right. So that was
[2:39:05] enjoyed a long length.
[2:39:11] Hey, that's all right. You're ahead of
[2:39:13] everybody else.
[2:39:16] What did you do? My evaluations. Look at
[2:39:20] you. I only did one. I had I had to get
[2:39:23] a hold of Tiny to make him remember his
[2:39:28] I just hold them.
