[0:01] I'll be famous are we're ready okay um
[0:06] at this at this time we now officially
[0:09] call our meeting to order we have a
[0:10] forum and we were open with um a
[0:15] invocation and a pledge I have a prayer
[0:18] in me today I dear Father in heaven we
[0:22] thank you we thank you for this
[0:23] opportunity to come together and to be
[0:26] able to address the needs but to address
[0:28] the business of our city we ask that you
[0:30] keep us focused that you give us wisdom
[0:32] knowledge and then most of all an
[0:34] understanding and Lord we just pray for
[0:36] those that are struggling in our city
[0:38] those that are ask us for help in need
[0:41] and Lord we know that you supply all
[0:43] things and God we just trust you that
[0:45] everything is going to work for the good
[0:47] of us because we love you and we're
[0:49] living according to your will and we
[0:50] give you the praise and the glory in
[0:52] Jesus name amen amen
[0:57] amen to the flag of un States of America
[1:01] and to the Republic for it stands one
[1:05] nation God indivisible liy and justice
[1:09] for
[1:12] [Music]
[1:13] all once again thank you so much all
[1:16] those that came ladies that the sisters
[1:20] that came in spite of the Wayne we
[1:22] appreciate you coming and all of you
[1:24] that are here uh with that being said we
[1:26] have uh uh we do recognize every
[1:29] everybody else that's on it we go to our
[1:32] comments uh from the audience and we
[1:34] have one presentation one speaker
[1:37] Scott will be coming and sharing with us
[1:40] all of three
[1:43] minutes you let me get
[1:46] little here and I'll
[1:49] start mayor council members and uh
[1:53] audience it's good to see all of you I
[1:55] hear and I stand before you uh with a
[1:58] extreme concern in my heart
[2:01] um I have a tremendous disappointment
[2:03] and a few council members again that now
[2:06] stand in the way of a great opportunity
[2:08] for the citizens of our community this
[2:11] incredible Community to be a part
[2:14] planning that leads to
[2:16] progress yes asking our
[2:19] citizens your constituents to come to a
[2:23] meeting that is designed for their
[2:26] Council District that has City
[2:29] department heads and dialogue with each
[2:32] other about
[2:33] caring and things that they really would
[2:36] like to see and their particular
[2:39] precepts we've had the first one it was
[2:41] a tremendous success but now it is my
[2:46] understanding that my pre too and then I
[2:49] believe there's another prip that is not
[2:52] having their particular meeting and I
[2:55] just stand before you and go why is that
[2:58] because
[3:00] it slows the progress down of the 123
[3:05] being able to ask folks about their
[3:08] ideas to share at least and be
[3:11] informative to them I feel that that's a
[3:14] pulse of our PRS our
[3:18] constituents negatively thats you things
[3:22] that negatively Hal us anymore and this
[3:25] could be construed in that way that
[3:29] there is
[3:30] a feeling that they that they don't need
[3:33] to be a part and that's to me it's
[3:36] disappointing so what I ask is is
[3:40] that when you have a major issue or when
[3:43] we have the opportunity to share with
[3:46] our
[3:48] constituents that's extremely important
[3:51] it is my understanding that y'all have
[3:52] not done that very often in the past and
[3:56] I think that it's a great Progressive
[3:58] State because when you plan together you
[4:01] have the opportunity of saying Teamwork
[4:04] Makes a dream work so now it is us it is
[4:09] up to us to be able to see those
[4:12] particular meetings to come to fruition
[4:15] and us to have a greater understanding
[4:17] of those who elect
[4:20] us what are their needs and how we as
[4:25] Representatives can fulfill those needs
[4:28] in those particular precepts and we're
[4:30] going to see some unique different
[4:32] perspectives but at the same time it
[4:35] will allow you to come up with a plan
[4:38] that we can do together to make this
[4:41] community a
[4:43] tremendous
[4:45] strong and healthy Community for us to
[4:48] raise our children and future
[4:50] generations to be a part of thank you
[4:53] very much mayor I appreciate your the
[4:55] opportunity for this to talk thank
[4:57] you uh that was the only one from the um
[5:01] that we had from the audience but I'd
[5:04] just like to take a moment uh I don't
[5:06] know we mentioned it last time the uh
[5:08] United Methodist AR Army uh that they're
[5:11] going to be in the city uh there are
[5:13] some flyers they're both English and
[5:15] Spanish if you know of an elderly person
[5:17] or someone that's in need of uh repairs
[5:22] and they've been through our community
[5:24] before I know some of you are familiar
[5:26] with them and if you know if you would
[5:27] like to pass them to your church but
[5:29] they will will be working basically in
[5:31] the city they won't be going outside of
[5:33] the city limits and so I'll just leave
[5:35] those here I think I carried them back
[5:37] home last time I put them back but if
[5:39] you need any extra just let us know if
[5:41] you know somebody that might need that
[5:43] service and they basically do ramps and
[5:46] those kind of things but they don't get
[5:48] on the roof I think I mentioned that
[5:50] last time and so with that being said
[5:52] does anyone else have a come in uh yes
[5:55] mayor uh my understanding is is uh it
[5:57] says in all your uh uh and y'all you're
[6:00] getting you get an understanding so um I
[6:04] would like for um I know that I had
[6:07] asked um Mr angenstein to do a town hall
[6:10] meeting so from the town hall meeting
[6:13] the round table uh
[6:16] evolved so it's not a specific way or a
[6:22] spe specific
[6:24] um order am I correct that um council
[6:29] members have to address the round table
[6:32] am I correct so in other words if you
[6:34] would be so kind to explain how you you
[6:37] are organizing the uh Roundtable so the
[6:41] people can get an understanding of how
[6:43] that actually works so uh I don't think
[6:46] that's been explained I will um as part
[6:48] of my city manager's update we have and
[6:51] I'll include that that way it's not in
[6:53] response thank you so
[6:55] much okay
[6:58] um so at this time um if there are no
[7:01] other comments from the council we'll go
[7:03] to uh the minutes regular session
[7:07] February 3rd 2025 special session
[7:09] February 10 10th 2025 uh approve of
[7:14] minut minutes you've had them in your
[7:17] possession I make a motion to approve
[7:19] the minut I second okay it's been moved
[7:21] in second all in
[7:23] favor there's a there's a a question on
[7:26] the on the minutes um I know one one
[7:30] area um number for on page
[7:34] seven where it says as a result the city
[7:36] was required to retain an outside legal
[7:40] counsel for this matter uh we were not
[7:42] required we were given the option to
[7:45] retain a outside legal
[7:50] representation I I don't think you uh
[7:52] yes ma'am okay right here where right
[7:55] here where it says Mr [name]
[7:56] explained to that the city had 20 days
[7:59] to respond to the lawsuit after it was
[8:02] filed and the Texas the tml would not
[8:06] provide legal coverage of for breach of
[8:09] contract lawsuits as a result the city
[8:12] was required we were not required we
[8:15] were given the option to retain outside
[8:18] legal representation required and option
[8:21] is totally different they didn't require
[8:23] us um so the courts will um tml does not
[8:27] require they offer as coverage um
[8:30] representation for defense um in that
[8:33] case that they did not um offer any
[8:35] coverage for us the courts would require
[8:38] us to
[8:39] retain Council in order to respond to a
[8:42] lawsuit so if there is a concern about
[8:45] the the result uh I feel like it would
[8:48] probably be a requirement you know if
[8:50] we're going to if we're going to abide
[8:52] by the court uh deadlines of a 20-day
[8:54] response for attorney well it was
[8:56] suggested because the the the uh um the
[9:00] legal attorney suggested and and asked
[9:03] for uh permission through Miss Casper if
[9:07] she would give us options to receive um
[9:11] oh you propos you saying that we don't
[9:13] have to have legal counsel no no no no
[9:15] I'm saying it was the wording but I'm
[9:17] saying the wording is it said it was
[9:19] required that's up to council if y'all
[9:21] would like um in your motion to accept
[9:23] these minutes if y'all want to change if
[9:25] y'all feel like well I mean it was
[9:26] stated in that's what we were given was
[9:28] an option not requirement the well I'm
[9:31] saying it said that I say an attorney
[9:33] what it was what what it's saying here
[9:35] the minute say that I explained this
[9:38] process um and in me explaining that
[9:40] process I feel like that was pretty
[9:43] accurate um is that the courts require
[9:47] retaining of counsel in order for you to
[9:50] I'm not an attorney and I wouldn't other
[9:51] if we did not retain counsel we would
[9:54] not have but option and requir is two
[9:56] different things requirement I mean I
[9:58] know that but it's a requirement I mean
[10:01] we will have to but they give us an
[10:03] option to not retire or re uh because
[10:08] when we were well I can't either we're
[10:11] going to have an attorney that's for the
[10:14] minutes we were given an option cuz if
[10:16] you if someone to go back and read it
[10:18] they would say we were required that
[10:19] means you say they though who are you
[10:21] saying they gave us an option tml or no
[10:24] courts um Daniel mention
[10:27] it but he doesn't he's not he doesn't
[10:30] overed no but he he he makes suggestion
[10:33] right but when it comes to
[10:35] requirements he suggest we're required I
[10:38] know but the 20-day requirement is a a
[10:40] response required by The District Court
[10:43] when a when a petition for a law suit is
[10:45] submitted or a citation is issued you
[10:47] have 20 days to issue your response and
[10:51] if we fail to issue that response we
[10:54] would have um been in in bad we would
[10:57] have fallen back and we would have had a
[11:00] a problem with the courts if we did not
[11:02] meet that deadline so I see it as a
[11:04] requirement that you have to retain
[11:06] counsel in order to
[11:09] respond uh to the to the lawsuit it
[11:12] requires an attorney so at if you if you
[11:16] but we were given an option though to
[11:18] retain or not nobody gave us an option
[11:20] it wasn't I mean it wasn't anybody's
[11:22] give we had discuss he discussed it but
[11:24] he could the courts required not not Mr
[11:27] Daniel or not tml or not even me the
[11:30] court it's the it's a pro it's a lawsuit
[11:33] process so but and that being said I
[11:36] don't believe it changes any of the
[11:38] intent so if you feel like and and
[11:40] Council agrees that we should adopt
[11:44] these minutes as written with the
[11:45] exception to change requirement
[11:49] to the city
[11:53] was any I don't know we got an Atty
[11:56] right he passed right but this is is the
[11:59] minute this is the minutes to document
[12:01] what actually happened all right I'll
[12:02] make a motion that we accept
[12:06] the minutes and you can strike that
[12:09] sentence and
[12:11] strike
[12:13] uh as a result the city was required to
[12:15] retain requirement to an option we got
[12:19] one so we got an attorney so it don't
[12:21] matter so you would like to amend your
[12:23] moot motion to that order yes okay thank
[12:26] you
[12:29] okay any any other
[12:32] discussion I second okay second it's
[12:34] been moved in second all in favor motion
[12:37] carries okay that brings us to item
[12:39] number two a fire department monthly
[12:42] activity and status report for January
[12:45] 2025
[12:47] Chief
[12:50] May for month of January we had a total
[12:53] of 27
[12:54] calls U sorry we had a total of 37 calls
[12:59] 27 of those being City and 10 of those
[13:03] in our respon that we covered with
[13:06] count there was no structure fires in
[13:08] the city and I hope to maintain that get
[13:11] in the next couple days hope
[13:14] everybody does everything
[13:17] right not suppos to be using and Stu
[13:20] like that there's a f
[13:27] breakdown thank you
[13:31] okay any
[13:33] comments good I did want to make a okay
[13:36] a mention here bring the council's
[13:39] attention as it as the first of the year
[13:41] rolls around by by requirements U by the
[13:45] bylaws of the fire department and
[13:48] requirements of maintaining membership
[13:51] with the uh volunteer me uh retirement
[13:54] program um you're required to to in
[13:59] order to be a volunteer of the fire
[14:00] department to to maintain a certain
[14:03] status of calls you can't say you're a
[14:05] volunteer and never show up right so I
[14:07] think it's
[14:08] 25% and uh 25% of the calls you should
[14:11] have made those calls showed up at least
[14:13] 25% of the time
[14:16] and that's reflected in the drop in
[14:19] volunteers right now with total
[14:21] volunteers and paid staff he's at 15
[14:23] MERS it is okay that's with all the paid
[14:27] staff and volunteers he total of 15
[14:30] total people on the fire
[14:32] department always been that way right
[14:35] it's not been that bad at the first of
[14:39] at the first of the a certain percentage
[14:42] correct but it it usually hasn't
[14:44] impacted you to where you're falling
[14:45] down to 15
[14:47] people so that okay means we're we need
[14:50] to encourage volunteers we're slim okay
[14:53] any got any Grand ideas how to attct
[14:55] people get with me and I'll be more than
[14:57] happy to purs that uh we tried several
[15:00] things in the past it's just like I said
[15:02] it's not just us it's Nationwide for as
[15:04] volunteerism across the so what what is
[15:07] the age 18 18 yes ma'am 18 and a
[15:13] driver's license and a clean record and
[15:17] um we will put you to work and train you
[15:21] and if you want to pursue a career in
[15:23] fire we got grants and stuff that we can
[15:25] get you where you can get certified as
[15:27] fire fire fire
[15:29] that maybe we need to make another
[15:30] appeal to the
[15:32] school as probably our strong this year
[15:35] and I'm hoping toit him up again at the
[15:37] end of the year
[15:39] too well do we have any homeschoolers or
[15:42] are any of those I I don't know what the
[15:44] population I know one while we had a a
[15:47] moderate population I need I know
[15:49] there's a couple here in town I need to
[15:51] go visit like I said I hit the schools
[15:53] up at the beginning of the year yeah
[15:55] probably with the schools would be and
[15:57] then I'm going try to hit it up like in
[15:59] the high school I hit the junior high
[16:01] first of year and to hit the high school
[16:03] up toward well one thing that the
[16:05] schools do have they have a safety
[16:06] director now maybe that's one of the
[16:09] people you can contact to dialogue with
[16:12] I don't
[16:13] know okay thank you so much I appreciate
[16:16] it thank you Jud at this time let's
[16:19] bring us to item number three Police
[16:22] Department Manpower and criminal
[16:24] incident report for January 2025 and
[16:27] presentation of annual racial profiling
[16:29] report good evening mayor council City
[16:32] administrator the police department
[16:34] mower criminal activity report for
[16:36] January of 2025 have a total of 16
[16:39] officers work
[16:42] 2584 Manpower hours responded to 382
[16:46] calls for service investigated 16
[16:49] traffic accidents made 57
[16:53] arrests uh stop
[16:56] 396 uh Motor Vehicles completed 64
[17:00] reports and responded to 30 alarm call
[17:02] 26 of those were F wow You'll see a
[17:05] breakdown I'll entertain question you
[17:07] may have on our criminal incident
[17:12] report just for
[17:15] conversation did
[17:17] the while the DPS officers were visiting
[17:20] us in Mass a couple of weeks ago did it
[17:23] impact anything in terms of so it did
[17:27] create a lot of phone calls from
[17:29] received a lot of phone calls
[17:30] questioning what was going on while they
[17:32] were here most of those phone calls were
[17:34] directed to the DPS Sergeant uh but we
[17:37] appreciate them being in town they were
[17:39] highly visible um and their goal is um
[17:43] the traffic enforcement and creating an
[17:47] atmosphere where people abide by the
[17:49] wall so I know that they worked here for
[17:52] a week solid uh they were very visible
[17:54] here in the city and not just in the
[17:56] city outside the city on the state US
[17:59] Highways too um but as far as creating
[18:02] any issues there was no issues but there
[18:04] there were a lot of questions because it
[18:05] was so sudden and I really I'm always
[18:08] amazed If people really don't understand
[18:10] the difference between the department
[18:12] that y'all are not one big family they
[18:15] so some people kind of categorize law
[18:17] enforcement all together but there are a
[18:19] lot of people that are able to
[18:21] differentiate the to so it didn't create
[18:23] a huge problem for us I think it was a
[18:25] positive deal
[18:27] overall okay well we're good that that
[18:30] work
[18:32] well I want to
[18:34] mention and I bring this up to uh going
[18:38] forward to keep this in mind we've
[18:40] talked before about um black party
[18:44] ordinances and the issues that uh these
[18:47] black parties sometimes because there's
[18:50] nothing that that allows us to control
[18:52] them um just over the weekend we had an
[18:54] incident where some gentleman went into
[18:57] one of these parties this known
[18:59] to have a lot of people um they went in
[19:02] with guns and ski masks and they robbed
[19:05] everybody at that party made way a
[19:08] little over
[19:10] $8,000 this was at a residence or no
[19:13] this was this was at a location that we
[19:15] frequently have block parties it's just
[19:17] really a piece of property uh that
[19:19] people come together up and and and hang
[19:21] out on I'm not saying that a city
[19:24] ordinance would have completely
[19:25] prevented that the time of morning and
[19:29] when this incident occurred um if we
[19:32] have an
[19:33] ordin um that that party wouldn't have
[19:36] been open or that incident wouldn't have
[19:38] been going on so um I would like to work
[19:41] with each one of y'all we can talk about
[19:42] an ordinance um come up with a good
[19:45] ordinance for the city where it's not
[19:46] too um too restrictive but it's fair to
[19:50] everybody um so we can get that in place
[19:52] going forward so in the coming weeks and
[19:54] months I'll be reaching out to each of
[19:56] you to uh to discuss orance on on
[20:00] something relating to block until nobody
[20:03] was actually
[20:04] heard so there were some injuries
[20:07] nothing serious um there were some
[20:09] weapons
[20:10] discharged um and like I said the
[20:14] suspects made away with over
[20:15] $8,000 in in cash they weren't
[20:18] apprehended yet sir were they
[20:20] apprehended they they are not they have
[20:23] not been apprehended yet uh our
[20:25] investigators are currently working
[20:27] active investigation on
[20:30] well we're glad that nobody got
[20:32] seriously hurt or
[20:34] anything cuz what when you do have a
[20:37] party a lot of the people are not your
[20:39] locals they are not people from the
[20:42] community and our this now it's very
[20:45] hard to there are certain ordinances
[20:48] that allow us to that we can act on but
[20:52] there very little when it comes to a
[20:54] party or a block party for instance a
[20:56] lot of cities hadan place to uh to
[21:00] restrict that do you know why there so
[21:02] much money
[21:04] there I will comment on that at this
[21:07] time okay yes we do know why okay but
[21:10] that's part so somebody else knew that
[21:13] too yeah okay I'm trying to remember was
[21:16] it in the city I yes in the city I'm
[21:20] trying to remember you know we talked
[21:21] about that at one time had a
[21:24] discuss is there a per do they have to
[21:26] have a permit for a block party
[21:29] we that was one of the things we talked
[21:30] about was U that ordinance ended up not
[21:34] passing um but that was one of the
[21:36] things in that ordinance to to require
[21:38] if they wanted to have a block party
[21:40] that they would come to City Hall get a
[21:42] permit that way we have a contact person
[21:44] we know who's responsible um and they
[21:47] have a certain number of of people that
[21:49] that can attend um we we've seen at
[21:52] times where we've had um up to 500
[21:56] people at a single block party um and
[21:59] that's like the mayor said earlier a lot
[22:02] of times people from out of town so um
[22:06] like I said that's something I'll work
[22:07] on and I will bring y all that we can
[22:09] all you know agree on and everybody's
[22:12] okay with and then we can bring back
[22:14] bring that back before the I've got some
[22:16] ideas on that okay well that sounds like
[22:20] a plan to put it on a future agenda when
[22:23] you get us some information kind of
[22:25] together what need to be discussed we
[22:27] can bring it in as an item
[22:29] if there's no other questions I'll move
[22:30] on to our
[22:32] annual report each of you know this is
[22:35] required by the state each year for us
[22:38] to present this report um so this is our
[22:43] 2024 annual racial profiling report I'll
[22:47] start out on the top we'll go down by
[22:49] race
[22:51] africanamerican total of
[22:54] 898 Asian Pacific Islander total of 80
[22:59] white total of
[23:02] 2216 Hispanic
[23:06] 641 in Native America
[23:10] 13 overall total
[23:14] 3,848 below that you'll see a breakdown
[23:17] of of different U topics and I won't go
[23:20] through all those a lot of those are
[23:22] redundant uh if you look at location of
[23:24] the stop um you have City street 7 60
[23:29] stops were made on city streets US
[23:32] Highway
[23:34] 155 State highways
[23:38] 2,784 County Road three and private
[23:43] property are other
[23:47] 146 wow I'm going to move move down to
[23:52] uh the very bottom on the left hand side
[23:55] race known prior to stop um that's a
[23:59] question that comes up
[24:01] sometimes you'll see under the box yes
[24:04] we had
[24:06] 728 and under no
[24:11] 3,120 um just for informational purposes
[24:15] there something that we train the
[24:16] officers to do and make them understand
[24:18] that it's okay if see know the race
[24:21] prior to the stop um was so much going
[24:24] on in the world a lot of people think a
[24:26] lot of officers think that I can't know
[24:27] that perfectly legal because there are
[24:30] certain times and certain situations
[24:32] where you're going to see that driver
[24:35] you're going to see that they don't have
[24:36] their seat belt on you're going to know
[24:37] their race and it's okay to check that
[24:39] box um obviously if that number was
[24:43] reversed that might be an area of
[24:45] concern but that's that's not a concern
[24:48] that we have at this time and one other
[24:51] place I want to call your attention to
[24:52] is use of force resulting in bodily
[24:54] injury um there's a number one there
[24:57] that was the suspect um suspect was
[25:00] found in possession of 3 kilos of
[25:02] methampetamine and when the officers
[25:04] attempted to place him under arrest he
[25:06] fled and fought the officer uh during
[25:09] that scuffle they did have to take him
[25:11] to the ground he started complaining of
[25:14] sorness and so they took him to the
[25:16] emergency room to have him checked out
[25:18] he was medically cleared he was okay he
[25:20] was not harmed but because he made that
[25:22] claim that's why you see that number
[25:24] there and for future purposes that
[25:27] number could also include officers that
[25:29] were injured on those traffic stops okay
[25:33] that's a good any question you may
[25:36] have there a seem like it's a better
[25:40] explained breakdown than it's been in
[25:42] the past it's it's I like break I like
[25:46] to break down it's a lot easier to
[25:48] follow it was kind of lumped up last
[25:49] time but just you can see where you are
[25:51] thank you so much anybody else have any
[25:53] comments I want I just want I want to
[25:56] visit with you all next week um um or
[25:58] this week sometime so we can kind of
[26:00] look at like the city streets kind of
[26:02] see look at that and give more of
[26:05] explanation of you know where the actual
[26:09] stops or things like that are being the
[26:11] nature of them and what where they're
[26:13] being done one thing we try to do is we
[26:15] encourage the officers to move
[26:17] throughout the town not spend too much
[26:19] time in one location um and that uh a
[26:23] lot of times like you see the uh the
[26:25] state highway number is so high because
[26:28] the loop is the state highway so there's
[26:30] a lot of time they spend on that's what
[26:32] it is the state highway yes I'll be glad
[26:34] to meet with
[26:35] you thank you okay any other comment I'm
[26:40] sorry thank you bu thank you so much
[26:46] appreciate okay uh that bring us to item
[26:50] number four update from the city
[26:52] administrat on City construction
[26:54] projects new business projects and
[26:56] alamore shelter mayor and counsel um
[27:00] every once in a while like to bring
[27:02] everybody into the loop I do speak with
[27:04] everybody off and on individually and
[27:07] but in order to speak on these projects
[27:10] um where everybody gets the same
[27:12] information I think it's good to talk
[27:14] about some of the the things going on in
[27:15] the city um and I've I've U highlighted
[27:21] a few of them here so in following up
[27:23] with our South Fifth and Bell Street
[27:25] project that we approved um at our last
[27:28] meeting
[27:29] to to uh redo the uh storm drains and
[27:32] curbing on those materials are ordered
[27:35] in construction uh will begin as soon as
[27:37] every all the materials are in um South
[27:41] 7th Street from
[27:43] buoy um up to
[27:47] golad from the Methodist Church down to
[27:49] uh the flly shop there all those water
[27:52] lines have been completed great um those
[27:54] have all been installed what they're
[27:56] wanting to do as they're moving forward
[27:58] once they get a good block of some good
[28:00] weather construction weather um they're
[28:04] want they're going to do multiple
[28:05] streets on the construction re
[28:08] restabilization and and Paving of those
[28:10] streets so right now they're working
[28:12] through and kind of getting ahead of
[28:14] themselves on some waterline projects um
[28:17] South 7th is complete uh South 10th
[28:20] Street is it has a couple
[28:24] last uh projects on Valves and some
[28:27] hydrant connect and stuff but South 10th
[28:29] Street is complete they're working on
[28:32] gry Street currently they're beginning
[28:34] the process of pulling pulling all the
[28:36] water lines installing valves and
[28:38] getting South Grey Street uh completed
[28:41] then they'll um move across Houston and
[28:45] do North Grace that'll be the next uh
[28:48] water line continu continuation of
[28:52] construction
[28:53] um we have a a new round of cdbg funding
[28:59] that has been opened up and we have
[29:01] until uh April I believe it's April 1st
[29:05] to um put in our pre-application it's a
[29:09] basically a saying that we're interested
[29:11] in applying so it's a preapp they do a
[29:13] first round of scoring and once you're
[29:16] scored and allowed to apply then you can
[29:18] go through the process of actually
[29:19] applying for the cdbg project our last
[29:22] cdbg project was uh
[29:25] MLK the the P the portion of MLK that we
[29:28] did the first round before we followed
[29:30] up with our sib
[29:32] construction um so that was that was our
[29:35] last round of cdbg funding so it can do
[29:37] anything from streets to water lines
[29:40] good to sewer sewer projects um in the
[29:43] past we've done a couple cdbg projects
[29:45] for sewer line
[29:47] replacement um we're under a current
[29:49] sanitary sewer overflow initiative
[29:52] plan um and within that plan we
[29:57] committed to doing
[29:58] several uh sewer line
[30:01] projects um to address II so to to
[30:05] address infiltration and inflow whenever
[30:08] it rains our Wastewater plants are
[30:12] filled up with storm water so it means a
[30:14] lot of the water that we're treating is
[30:16] not sewer it's it's a it's storm it's
[30:20] storm water and we're having more and
[30:23] more problems that you know in my I know
[30:26] that the the one that we see the most
[30:28] the biggest problems that we see the
[30:29] most are the streets we see Street
[30:31] problems that really need a lot of
[30:33] attention but waste water needs a
[30:36] continued a a continued uh you know
[30:39] focus on um we have several more
[30:42] projects where we know we have some old
[30:45] clay tile pipes and some of them are big
[30:48] Interceptor lines that we know that just
[30:50] needs to be replaced um we're taking in
[30:52] lots and lots of water through those uh
[30:55] lots of old manholes we have one that
[30:57] we're fixing the replace on South gry
[30:59] Street um right where we're doing some
[31:02] of the street construction uh the
[31:04] manhole is basically collapsing on us so
[31:07] we're going to do that you know out of
[31:09] our own Pockets replacing those manholes
[31:11] but there's just all those manholes now
[31:13] we have an SSO guy that are inspecting
[31:16] all those manholes they're entering them
[31:18] into our GIS system taking pictures of
[31:20] them recording them so we're getting
[31:23] lots and lots of good data of all of our
[31:25] priorities out in the field that need to
[31:27] be addressed
[31:28] but anytime we get opportunities for
[31:31] funding um those are some of the things
[31:33] that we can apply for however next month
[31:36] we'll bring it back to you I'll get some
[31:38] input from Council on some of the items
[31:40] that y'all want me to apply for and it's
[31:43] in a pre-application if we do get scored
[31:46] we will have a public hearing and go
[31:48] through the full process but um sewer
[31:52] lines water lines streets sidewalk
[31:55] projects those are all things that we
[31:57] can apply
[31:59] for
[32:02] East are you done uh not yet I can I can
[32:06] stop take a question um yeah I uh with
[32:09] with CBG project and I think you and I
[32:13] had some discussion this week about uh
[32:16] MLK so I was asking about the Grant on
[32:19] MLK what um why is why I mean do we
[32:24] apply for partial grants or do we apply
[32:27] for full Grant
[32:28] and I remember you said something to the
[32:30] fact that you apply for the maximum so
[32:34] but MLK runs from the loop 304 all the
[32:38] way down to what golad West golad West
[32:41] yes West golad so did we get a grant to
[32:45] do the do MLK meaning from the loop to
[32:49] West Goliad
[32:51] or got to explain that cuz I'm I'm
[32:54] getting questions about that because so
[32:56] like I broke it down in the email email
[32:58] um in my response was we applied for the
[33:01] maximum however um last year's maximum
[33:04] was 500,000 they increase it to 750
[33:08] 500,000 when it goes into Street
[33:10] construction is pretty limited you MLK
[33:14] is a little over a mile I believe if
[33:16] last time we checked it was right at 7
[33:19] or 8,000 ft so it's about a mile and a
[33:21] half of Street
[33:24] 500,000 um only got us that so we have
[33:27] applied for the maximum but there was no
[33:29] remaining grant funds left and
[33:32] so uh we had a qualif uh the sib the
[33:36] state infrastructure bank that was a was
[33:38] a bond it was a loan that we
[33:40] borrowed that money was MLK was
[33:44] qualified from the loop up to Bell
[33:46] Street the smaller portion that used to
[33:49] be called Commerce
[33:50] Street from it Bell to West
[33:54] golad um in the state's system system
[33:58] does not show did not show the rest of M
[34:00] as a qualified Street and so that's why
[34:03] I sent that map that it shows that
[34:05] there's only from Bell to the loop that
[34:07] is uh qualified for sib funding so we
[34:10] used bond funds uh borrowed money to
[34:13] finish out MLK up to the amount that the
[34:17] project allowed the money to go into
[34:19] okay if we're to to to do the rest of M
[34:22] which it it needs it as well um we're
[34:24] going to have to use other sources sib
[34:26] will not fund money or if y'all want
[34:29] like I said we do have 750,000 that we
[34:31] can apply for we can do the other the
[34:34] the remainder of MLK out of the next
[34:37] round of cdbg funding to complete the
[34:40] full length of uh
[34:43] MLK um but maximum but it's not that we
[34:46] applied for part of the street we
[34:47] applied for the maximum amount of the
[34:49] ground and it only it only cover mean
[34:52] it's going to pay for the entire street
[34:53] right and so uh we went shopping with a
[34:57] known dollar amount and it only LA and
[35:00] it only addressed a portion of MLK out
[35:03] of the grant funds so we used borrowed
[35:05] funds to complete MLK up to uh Bell
[35:08] Street and so if we want to do the rest
[35:11] of it it'll have to be out of a new
[35:13] source of funding okay so what about
[35:17] cedar cedar how how we going to address
[35:20] Cedar it we have to be new sources of
[35:22] funding uh we did we did preliminary
[35:24] engineering we applied for it out of our
[35:27] sib
[35:28] project um but once again the SIV
[35:30] project we only borrowed $6
[35:32] million and so Council
[35:35] decided they picked and prioritized
[35:38] which
[35:39] streets are the worst or the most
[35:42] traveled and that's how the you know
[35:44] that's why MLK was selected over Cedar
[35:48] and so um you know there were several of
[35:51] them that were not able to be done
[35:53] within that within the SIV Project
[35:55] funding so if we want to do the rest of
[35:57] this the streets that we did the
[35:58] preliminary engineering on we would have
[36:00] to go and borrow more through the SIV
[36:03] program um or another source of funding
[36:07] but at Clark
[36:09] Sano there were uh Cedar there were
[36:12] several streets that were
[36:14] not that were left off the project
[36:16] because we ran out of of funding okay uh
[36:20] stat so um
[36:23] Sycamore we did not apply Sycamore was
[36:26] not applied for in the sib
[36:28] project it is a qualified street though
[36:30] so those are all streets we can apply
[36:32] for those all have to be paid paid back
[36:34] though they're not grants okay we have
[36:36] to borrow money against our tax rate you
[36:39] know just to add one of thing the
[36:41] council had the option of picking the
[36:44] street it wasn't that [name] got to pick
[36:45] the street everybody was giv the list
[36:48] and they went through and decided which
[36:50] streets they actually wanted to what
[36:52] percentage it wasn't just a it was based
[36:54] on I get I don't know the strongest
[36:57] Council what but it was based on
[36:59] distributed on what the council
[37:00] themselves we tried to distribute across
[37:02] the city to where each Precinct had some
[37:04] project percentage of the
[37:06] pro um and then we have uh so we we've
[37:11] just got approved for a categor
[37:13] categorical environmental exclusion
[37:15] through Texas water development board
[37:18] and essentially there's another whole
[37:20] process that we got approved to exclude
[37:23] having to go through we did not we do
[37:24] not have to go through that process of
[37:26] an environment a full environmental
[37:29] design and review for East Houston and
[37:31] East goad when we're doing the water
[37:33] lines because we're using current water
[37:36] lines we're replacing existing Disturbed
[37:39] grounds we're not putting in new water
[37:41] lines or disturbing new grounds um and
[37:45] so after a lengthy process that's the
[37:49] the main reason that well that's the
[37:51] only reason that we've been waiting up
[37:53] until now so this week we got approval
[37:55] for um exclusion of the environmental
[37:58] process because they verified that we're
[38:00] only using existing uh Disturbed ground
[38:05] you know as our work area um so we're
[38:08] going we published that in the newspaper
[38:10] we're required to publish that in the
[38:11] newspaper that TW Texas water
[38:13] development board um excluded us from
[38:15] that requirement and they're finalizing
[38:19] engineering and we'll probably U we hope
[38:21] to be going to bid in the next 3 to four
[38:23] months probably sooner that's the worst
[38:25] case scenario but um Houston and East
[38:28] goad for new water lines um will be
[38:30] going out to bid in the next few months
[38:32] probably early late late spring early
[38:35] summer um after that that's one we we
[38:39] got to get the water line done for the
[38:41] state the state I met with the state um
[38:44] and I have that here but so I'll go
[38:45] ahead and touch on that the state we met
[38:47] with them a couple weeks ago they're
[38:49] moving up uh their plans are to move up
[38:51] South four Street um and get that done
[38:54] they're doing current construction
[38:55] projects on 287 and and on um uh south
[38:59] 19 so they're going to continue that
[39:03] inside the loop and there will either
[39:05] continue up to Bell Street or up to the
[39:08] square depending on the amount of change
[39:10] order and funding they're going to go
[39:13] ahead and do that since we replaced that
[39:14] water line uh down south four Street
[39:17] that's all been replaced with all brand
[39:19] new water lines that we did a couple
[39:21] years
[39:22] ago then the rest of them um is going
[39:25] into their next fund that they're
[39:26] putting in their in their next funding
[39:28] year which will be roughly 2026 and 2027
[39:32] that'll give us all of 2025 to do the
[39:34] waterline
[39:36] construction and hopefully get both of
[39:38] those highways done to allow that to be
[39:43] rebuilt um we met today with Engineers
[39:46] Wastewater Plant and water wells that's
[39:48] moving forward we did some we're they're
[39:50] trying to finish the preliminary
[39:51] engineering so they're uh they're doing
[39:53] site uh reviews of our Wastewater plants
[39:57] um as well as a lot of our Pro
[39:59] problematic areas of sewer line uh sewer
[40:02] Mains areas that we know that we're
[40:04] taking in a lot of water where the lines
[40:06] are collapsing or separating and we're
[40:09] bringing in storm water we're going to
[40:11] prioritize a lot of their Wastewater
[40:12] funding for those areas so we're we're
[40:15] trying to identify that first with some
[40:17] uh some smoke testing and uh we'll begin
[40:20] that process pretty quick
[40:23] um I also wanted to touch on
[40:27] I actually spoke with a council member
[40:29] the other day that was not had not been
[40:31] out on our South Loop and so I wanted to
[40:35] just bring this up to
[40:37] council um this is the state of
[40:40] construction as of today so it's a
[40:42] gloomy it's a gloomy cloudy day but um
[40:45] we have a really big building being
[40:47] built in the industrial park they um
[40:50] they expect this building to be
[40:51] completed in um kind of the May time
[40:54] frame and we'll be starting job fairs in
[40:58] in hiring process um in the spring um
[41:03] we're looking forward to that we did um
[41:05] as it relates to this we are also moving
[41:07] forward with the ftz application we've
[41:09] gotten letter of concurrences from all
[41:11] of our local uh taxing entities and
[41:14] submitted that and uh so we look forward
[41:17] to when Nancy Goes to Washington in a
[41:20] couple weeks for us to have
[41:24] a a good result on that um um we also
[41:29] this is the provalis building we've done
[41:31] some we've done a lot of landscaping and
[41:34] cleaning up of the building um there's
[41:36] still a few things that we want to touch
[41:38] on and kind of clean up a little bit
[41:40] more um the inside of the building well
[41:44] this is the outside again we have a
[41:45] generator the generator has been
[41:46] installed and it's connected to the
[41:48] building we're we're live on
[41:50] that
[41:52] um the inside of the building they're
[41:54] filling this up they've they've gotten
[41:56] big coolers to put right over here by
[41:59] the for people's lunches and whatnot so
[42:01] we have a
[42:03] cafeteria um that set up they begin
[42:05] setting all the rooms up they have all
[42:07] their data pulled uh all their
[42:09] workstations new new uh desks and uh
[42:14] computer
[42:16] monitors here's another room right now
[42:20] right now we're set up for the goal is
[42:23] for 60 people um for phase one phase one
[42:27] construction has been completed uh we
[42:29] finished that um that we agree to and
[42:32] now um I got an email from them today
[42:35] saying that they're moving forward to
[42:37] into the we they're wanting to meet to
[42:39] uh next week to schedule job fairs and
[42:43] and to put together a program to begin
[42:45] uh doing some heavy advertising and
[42:48] trying to bring in some Crews they
[42:50] they've got several contracts that are
[42:51] designated for the Crockett
[42:53] location um and so they're ready to move
[42:55] forward they're excited and and we're
[42:57] really really
[43:00] excited
[43:03] um any questions on the Texas capital
[43:07] provalis um the last couple of things
[43:11] that I wanted to talk about um I wanted
[43:13] to bring notice to council
[43:17] today um in a more formal way but then I
[43:20] want y'all to begin thinking and
[43:22] preparing for discussions soon um when
[43:25] it as it relates to our um swimming pool
[43:30] we did get notice from the Texas uh
[43:32] Parks and Wildlife the grant that we had
[43:34] submitted for a swimming pool to to to
[43:38] uh combine with our match was denied um
[43:42] well it wasn't deny we right we did not
[43:45] rank high enough uh out of 60 I believe
[43:47] it was 68 applications we came in at 32
[43:50] and they only had enough funding for 22
[43:54] so we fell out of the funding bracket so
[43:57] we have options that we need to discuss
[43:59] so I need to know what from Council how
[44:01] to move forward with the swimming pool
[44:05] project
[44:07] con con bring it in bring the project in
[44:10] make it smaller project borrow more
[44:13] money or do another project or you know
[44:16] spend the money elsewhere council's
[44:18] going to have to just make some
[44:19] decisions on and I'm going to try to
[44:20] present y all as many options valid
[44:23] options that we can uh move forward with
[44:26] um
[44:28] the uh animal shelter I also wanted to
[44:30] touch on that um we we finalized we
[44:34] we're we're trying to finalize in the
[44:35] next day or two the job description for
[44:38] the shelter attendant or shelter
[44:40] technician um so we can bring somebody
[44:42] in and begin getting that person trained
[44:45] and helping us in the initial
[44:48] implementation of our animal shelter and
[44:49] getting that um running of we have we've
[44:54] been meeting with our with a
[44:56] veterinarian that is is willing to
[44:57] assist us um she has um provided us more
[45:01] insight and and we've been able to work
[45:03] together to come to better agreement on
[45:05] what our our relationship or partnership
[45:07] with her will be um she has affirmed
[45:11] that she's not wanting to come in and
[45:13] compete with other veterinarians she's
[45:14] not wanting to uh set up and necessarily
[45:17] use our Clinic as a private practice uh
[45:20] to where we're you know we we want to be
[45:22] able to support all of our local
[45:25] veterinarians without spending tax
[45:27] dollars um inappropriately or
[45:30] competitively to help somebody with a
[45:32] competitive Advantage she's very very
[45:34] helpful um and is is wanting to assist
[45:37] us on this project and so I'll be able
[45:39] to bring Council some some options as it
[45:43] comes to our partnership agreement with
[45:45] her um but we do want to post that
[45:47] position within the next uh few days uh
[45:49] for a for a shelter attendant to help us
[45:52] get this ball moving forward because
[45:54] right now we don't really have somebody
[45:55] in that position so we're trying to take
[45:57] care of it on our own and it's been hard
[46:00] with all the other projects going on
[46:02] would it be would it be available would
[46:04] she be available to come I mean to meet
[46:07] with Council to yes that'll be part of
[46:09] it yes' okay perfect for sure um the
[46:12] last two items uh Community Round Table
[46:15] uh we've been doing uh we started the
[46:16] community round table and so um the goal
[46:19] from Council that that we've been
[46:22] requested by Council this
[46:24] is um this is a push
[46:28] from the city that we've been wanting to
[46:30] support it's it's difficult sometimes in
[46:33] a council meeting for us to have candid
[46:35] discussions and to answer when people
[46:39] speak for three minutes we're not
[46:41] allowed to respond Community round table
[46:43] gives an open Forum to where we do not
[46:45] have um a quorum of council there we
[46:48] have a council member representing his
[46:51] his or her Precinct and then we have all
[46:53] the city leaders that may or may not
[46:54] have the questions but can get the
[46:56] questions answered right and so that's
[46:58] that was our goal and it to be spurred
[47:00] and and supported by that council member
[47:02] so a lot of it's going to be at that
[47:04] council members uh at that Council
[47:07] member's
[47:08] um speed or you know at that Council
[47:11] member's Direction you know discretion
[47:13] as discretion as hey this is when I'm
[47:16] available this is what I can or can't do
[47:18] hey I would like to have it at this
[47:19] church or I would like to have it or I
[47:21] talked to a friend of mine that has a
[47:23] venue we're going to do it over here so
[47:25] we want it to be led and supported by
[47:28] the host Precinct uh council member and
[47:32] so and that being said our goal was
[47:35] between now and through May to do all
[47:38] five precincts and use that as a big as
[47:41] a big
[47:43] tool approaching our our budget
[47:45] workshops and go getting into our budget
[47:47] workshops in May and June we have a lot
[47:50] of information that we' received from
[47:51] our Precinct um up until then so we did
[47:55] not want to delay at least having one
[47:58] every month we wanted to have one at
[48:00] least every month that way we did not
[48:01] push it off and finish up some in June
[48:04] July and so um at this time there there
[48:07] was some scheduling conflicts and so
[48:11] that's why we moved on to Precinct 4
[48:12] currently we do hope that um each
[48:16] council member will be able to work with
[48:18] us and provide dates and um and let us
[48:22] know when they when they can uh be
[48:25] available thank you and so we'll use
[48:27] that moving forward oh I just said in
[48:30] this I think it's when it was broken
[48:33] down like that it's going to be so much
[48:35] more effective Town meetings are
[48:37] wonderful but basically it's a
[48:40] collaboration of it's just a group of
[48:42] people but you're really not getting
[48:44] what they want to hear specifically to
[48:47] the area you know you go to a lot of
[48:49] meetings and you hear a lot but you
[48:51] really want to know what are you going
[48:52] to do for me what have you done for me
[48:54] lately like that but uh and so I I think
[48:57] the first one kind of gave us a frame of
[49:00] what it could be what people really
[49:01] cared about even to the point of what
[49:05] can we do spe specifically for our to
[49:08] get our streets fixed Maybe by another
[49:10] source and it was some sources
[49:12] introduced that I I wasn't aware of and
[49:15] I'm sure they weren't so the one thing
[49:17] about it and we do appreciate uh council
[49:21] person woman we said woman person we all
[49:24] good but when she brought up up a
[49:27] community I mean a a town meeting it it
[49:30] sounded really good at the time but
[49:33] getting everybody a good representation
[49:36] of the town is a it's really hard CU
[49:40] you're going to get pretty much the same
[49:42] cross section of the people that kind of
[49:44] come to the council so I think it's just
[49:47] so important that somebody actually can
[49:50] stand up and hear what's happening in
[49:52] their area with the person that's like I
[49:56] said the council does have the power to
[49:57] make the recommendation even when we
[49:59] talked about the streets just in they
[50:02] decide which ones they kind of want and
[50:06] why they want and which ones are so they
[50:08] know more about the areas so I think
[50:10] that's it's a real strong thing and and
[50:13] like I said I did see it we saw saw it
[50:16] the first one went very well and as we
[50:18] grow and learn and we'll be able to put
[50:21] them on a stronger Tim table so that
[50:23] it's not conflicting with anything you
[50:26] know as always going to be a conflict
[50:28] but to the best of our abilities we'll
[50:31] be able to hear what every Precinct
[50:34] heads and what their priorities are and
[50:37] I think that's awesome especially as you
[50:39] prepare to go into the budget no shock
[50:42] no surprise everybody pretty much know
[50:45] where we are thank you thank you well I
[50:48] just want to thank [name] for make making
[50:50] it come to fruition because that's
[50:53] pretty much you know what I was looking
[50:55] at in and he made it um happen so thank
[51:00] for that thank
[51:02] you was that that's it all right thank
[51:06] we thank you for the update uh it's
[51:07] always good to have a update so we can
[51:09] worry about what we need to do
[51:11] next so we know that things are being
[51:14] done okay at this time it bring us to
[51:16] item five discussion regard regarding
[51:19] Solid Waste
[51:21] agreement mayor and
[51:23] Council so we have a um
[51:27] what I what I hope to result out of the
[51:29] out of this um agenda item is for
[51:32] Council
[51:33] to um we've given you some time to go
[51:36] through our uh franchise agreement with
[51:39] Pineywoods
[51:40] sanitation um and at the end of this I
[51:43] would like some direction from Council
[51:45] on whether um this is an agreement that
[51:48] y'all want to review and and pinpoint
[51:51] and highlight some areas of focus that
[51:53] we need to adjust in our contract to in
[51:56] order to move forward into a renewal
[51:58] process or if y'all feel like it's time
[52:00] to go out and go go out for bid and so I
[52:04] need direction from Council um before I
[52:08] start the bidding process I need Council
[52:10] to tell me so um or if they feel like
[52:13] we're getting a good service that might
[52:16] need
[52:17] some some little tweaks or some
[52:19] massaging on that we
[52:21] can uh move forward with our current
[52:24] provider um then obviously
[52:27] um there's some benefits in that as well
[52:29] and so I wanted to touch on just just a
[52:31] few of those um we also have
[52:33] representatives from Piney Woods um
[52:37] sanitation here that can answer
[52:38] questions talk to us and maybe they have
[52:41] some more things that they want to add
[52:44] um so just to recap quickly in in 2016
[52:50] when I came when I came on we were
[52:53] dealing with we had just recently
[52:55] underwent a into contract with Waste
[52:58] Connections they were bought out I
[52:59] believe from
[53:01] Progressive and then so we worked with
[53:04] Waste
[53:05] Connections without bringing in without
[53:08] talking too much about that what we
[53:10] experienced during that process this was
[53:13] a big Corporation a big company uh
[53:17] probably worldwide we know that it's
[53:19] throughout the US whenever we asked for
[53:22] certain accommodations or certain
[53:24] specific things they were un able to
[53:27] accommodate um we asked in order to go
[53:30] into a renewal process with them we
[53:33] really want smaller trucks you are
[53:35] tearing up our streets our streets are
[53:37] getting destroyed by these massive
[53:39] trucks that come in with one driver from
[53:42] out of town they're they bring the truck
[53:45] in service the that entire area and then
[53:49] leave town with that same
[53:51] truck um we need smaller trucks with
[53:54] smaller loads and what I really liked
[53:57] about the rear loading process is not
[54:00] only that it provides more jobs but it
[54:02] also provides a truck that only goes
[54:05] down that road once it's not required to
[54:08] go down three-point turned around and
[54:10] come back down the same street twice in
[54:13] one day that's twice the load on our
[54:16] street they're hugging the curbs they're
[54:18] riding right up against our the edges of
[54:20] our road where our road is the most
[54:22] vulnerable and softer it's that's the
[54:25] weakest point of the road is up against
[54:26] that curb and if you drive around town
[54:29] that you see
[54:30] curbs like the waves of the
[54:32] sea that did not help that was one of
[54:35] the biggest contributors to that process
[54:37] they're stopping in the same locations
[54:39] every time picking up that same can
[54:41] within the same probably two
[54:44] feet that truck stopped every time that
[54:47] came there at the same place so you have
[54:48] big ruts digging in a request like that
[54:51] even at a request we know that it might
[54:53] cost us more but let's it wasn't
[54:57] that wasn't feasible so that's why we
[54:58] went out for bid and we got a better
[55:01] price with our current
[55:03] provider um what we currently have now
[55:07] we went into an agreement um our
[55:09] Economic Development also entered into
[55:11] an agreement where Pineywoods was
[55:14] willing to agree to bring jobs local
[55:17] instead of being serviced out of
[55:18] Huntington they have a big office in
[55:20] Huntington MH um instead of servicing it
[55:24] out of Huntington they wanted to create
[55:25] a local Hub here and service other
[55:27] communities from Crockett so they agreed
[55:29] to bringing in 12 jobs if we would build
[55:32] them a an office building so it was
[55:34] almost it was the our our agreement with
[55:37] them was we would provide the office
[55:39] building but yet it's still on our
[55:41] property it's our you know if if they
[55:43] leave it's still our our facility to
[55:45] continue using for other service and
[55:47] other
[55:48] contracts um currently they're at um the
[55:52] last time I spoke to them they were at
[55:53] 22 employees instead of 12 um of local
[55:56] employees that they service quite a few
[55:58] other contracts with um if we do go out
[56:03] for bid we do stand a risk
[56:06] of losing what we have primarily because
[56:11] if we go out for bid this is going to go
[56:13] through their corporate office um the
[56:15] bid requests are going to go to their
[56:16] corporate office where they use an
[56:18] entire different pricing
[56:20] Matrix and uh we may end up in a
[56:23] situation where we're not able to Main
[56:26] maintain our current
[56:27] contract
[56:29] um I'm not aware they we had two other
[56:32] bids when we went out for bid last time
[56:34] and both of those companies were
[56:37] purchased by live o so they're all the
[56:39] same company currently so if we do go
[56:42] out for bid there is a there's a couple
[56:45] options that
[56:46] I would like to eliminate one is that I
[56:49] want to go out for bid for a company
[56:51] that is willing to address the specific
[56:54] needs that we have and and not give us a
[56:56] one cut a size fits all and then
[56:59] secondly that it's not a new standup
[57:01] company that looks at a contract and say
[57:03] well you know hey I can throw a company
[57:05] together I can begin a garbage pickup
[57:09] service and it be we be their new
[57:12] training grounds that we and so those
[57:15] are my concerns moving forward with a
[57:17] couple with with with bidding this out
[57:20] is that we we're able to maintain a a
[57:22] solid reputable um Service uh for for
[57:25] garbage
[57:27] the the economic development contract
[57:30] that's that expires this year so they're
[57:32] they're not under that Economic
[57:34] Development performance agreement um
[57:36] they have me fulfilled it and superseded
[57:39] it they've also brought in a mechanic
[57:42] shop um and they've moved a lot of their
[57:45] light
[57:45] mechanics work here locally instead of
[57:49] keeping that in Huntington as well so
[57:50] they're leasing another building from us
[57:53] um on top of their current contract to
[57:55] provide mechanicing uh servicing work
[57:58] there um that being said we have until
[58:02] May
[58:05] um we have May the 5th is our deadline
[58:09] to provide them notice that we do not
[58:12] wish to renew that we're going out for
[58:14] bid um so if we're going to start the
[58:16] bidding process we need to start that
[58:18] pretty quick so we can have an answer
[58:20] before May the 5th um that way they know
[58:25] whether they need a Wrap Up up their
[58:27] services and another company is going to
[58:29] require quite a bit of time to develop
[58:32] to develop their services to buy the
[58:34] vehicles and and the carts and and move
[58:36] everything in so that being said you've
[58:40] had the contract um that we currently
[58:43] have with Pineywoods are there items
[58:45] that you would like to go over um when
[58:48] we have Representatives here uh with
[58:50] Pineywoods we also have their local site
[58:53] manager here um Mr uh Terry um and Mr
[58:59] Sunny hubard he's the municipal manager
[59:02] with Piney Woods and live o and so this
[59:06] is a t time to talk to them about if you
[59:08] do have concerns or things that we want
[59:10] to develop into a new into our renewal
[59:14] process this would be the time that we
[59:16] could do that um so you say by May um
[59:20] when I was reading the contract it said
[59:21] something about we need to issue them
[59:24] notice within 18 days yeah so may is the
[59:28] 180 day de deadline deadline cuz the
[59:30] contract is
[59:31] November U November the 1st and so 180
[59:35] days prior to that would be May 5th okay
[59:37] concluding okay
[59:39] oober
[59:41] may things that you brought
[59:44] okay first off Tim Terry is our manager
[59:47] here now y'all know JD JD had a
[59:50] replacement and he's out for a month or
[59:52] two till his knee heels up over the
[59:56] complete operations of
[59:58] it we have 2016 and 22 people we're like
[1:00:02] everybody else like the fire department
[1:00:04] getting people to come in is difficult
[1:00:07] sometimes so it kind of goes up and down
[1:00:09] uh what we have done as a company is
[1:00:13] we've spent over
[1:00:15] $100,000 on these carts that were
[1:00:18] brought into the city we spent over A4
[1:00:21] million dollars on containers that we
[1:00:24] brought into the city we have over a
[1:00:27] million dollars worth of trucks here and
[1:00:30] we spent
[1:00:31] $380,000 on the transfer station so you
[1:00:35] see this is not a small project and I
[1:00:38] would rather y'all I mean the city can
[1:00:41] do what it wants to but you don't need
[1:00:43] to go to bed yours cheap now is what
[1:00:45] you're ever going to get the people that
[1:00:47] would actually come in and take our
[1:00:49] contract would buy have to buy what I
[1:00:51] told you we spent on new materials and
[1:00:55] y'all seen the pricing has done on
[1:00:57] everything so uh you know to get as
[1:01:00] cheap RO as what you have right now I
[1:01:02] don't think it's going to be possible
[1:01:04] simply because we're using equipment
[1:01:07] appreciating we're not having to buy a
[1:01:09] lot of new equipment and the uh in the
[1:01:12] contract it says we can give you up to
[1:01:14] 10 30 yard containers for clean up well
[1:01:18] through talk and conversation we'll go
[1:01:21] to the transport station really to put
[1:01:23] four five or six containers somewhere to
[1:01:26] dump in you're going to have a mess
[1:01:27] you're going to have to have Logistics
[1:01:29] to where will handle that many
[1:01:31] containers when this transfer station is
[1:01:33] perfect just have them go H you don't
[1:01:36] have to have any containers nothing gets
[1:01:38] out nothing blows it all stays in
[1:01:40] container in the G
[1:01:43] station the containers that he's talking
[1:01:45] about uh what we've primarily been using
[1:01:48] those on are um either code enforcement
[1:01:51] or cleanup projects of abandoned homes
[1:01:53] that are collapsed and falling down
[1:01:56] different uh different projects like
[1:01:58] that um they'll bring in several
[1:02:00] containers we we use our bulldozer and
[1:02:02] skid steers and clean that property up
[1:02:05] but on our clean up the city clean up so
[1:02:07] the people clean up house they just come
[1:02:09] to the transport station there's no real
[1:02:12] reason to set these containers in where
[1:02:14] you have to man them because y'all know
[1:02:16] as well as I do if you have a place to
[1:02:18] put trash and nobody's watching you know
[1:02:20] what's going to happen we know where it
[1:02:22] goes transfer station alleviates that
[1:02:24] situation one other thing that we do uh
[1:02:28] forever house that we pick up here y'all
[1:02:31] get about $1.50 a month on it for every
[1:02:35] house that's a franchise Fe forever
[1:02:38] container that we have through
[1:02:40] commercial areas you get a uh a dollar
[1:02:45] for every $100 that they spend I mean I
[1:02:49] mean every $10 y'all get 10% on our
[1:02:52] commercial so if we do $20,000 a month
[1:02:55] month y'all get 10% of that on all of
[1:02:58] our rolloff stuff of the big
[1:03:00] construction containers whenever it's
[1:03:03] set out depending on the size 20 30 or
[1:03:06] 40 you'll get anywhere between 40 and
[1:03:09] $75 per load franchise Fe so see y'all
[1:03:13] make a lot of money off of us
[1:03:15] also and the fact that we pay taxes on
[1:03:18] all of our properties you know every can
[1:03:20] sits out every container that sits out
[1:03:22] every truck that runs we pay personal
[1:03:24] property tax on so you know it this
[1:03:27] thing works both directions we are
[1:03:30] wanting to keep this business we don't
[1:03:32] want to get rid of it we had 15 more
[1:03:35] years left on a contract for our
[1:03:36] transfer station what the transfer
[1:03:39] station allows us to do as a business is
[1:03:43] we can take our trucks and one of the
[1:03:46] situations we ran into when we made the
[1:03:48] B and believe me I like these guys
[1:03:51] they're garbage people U they're just as
[1:03:54] good as the weage were but I can tell a
[1:03:56] lot of people y'all never met Mr Weber
[1:03:59] and you never met the guy that owns the
[1:04:01] company now you just see us but
[1:04:06] um we we want to keep this y'all are
[1:04:09] very important to us Tim and his MCH do
[1:04:12] as much as they can for the community we
[1:04:14] try to be involved every way that we
[1:04:16] possibly can and uh although that a
[1:04:19] bigger company owns us we still are a
[1:04:22] small company and we're here and we also
[1:04:25] picked up the county we have the county
[1:04:27] contract so we run everything out of
[1:04:30] here and you know it's just there's no
[1:04:34] real reason to bid it out because we're
[1:04:35] getting you everything that you need
[1:04:37] we're paying you a lot of money and
[1:04:39] paying a lot of taxes and all the people
[1:04:41] that
[1:04:45] work okay what I oh I'm sorry what what
[1:04:49] can we do about people trying to get a
[1:04:52] hold of y'all and and you can't get a
[1:04:54] hold of you we are going to put in a
[1:04:57] phone one number that is nothing except
[1:05:00] for the city of Crockett and when we get
[1:05:03] it in place I'll give you all the
[1:05:05] information y' y'all divide up y'all can
[1:05:07] put it out however you want to but there
[1:05:09] will be one person that answers this pH
[1:05:11] if she has to BU to the power room and
[1:05:13] go eat lunch somebody else will take it
[1:05:15] but it will be specifically for the C
[1:05:17] okay what can we put in there if that
[1:05:20] don't happen there's re we do have that
[1:05:24] um we currently have well we currently
[1:05:27] have it and they can't do it no I'm
[1:05:28] saying we have if if their contract
[1:05:31] requires certain things we have
[1:05:33] Provisions for everything from misc
[1:05:35] collections um even to the uh item that
[1:05:38] you had mentioned a few days ago of of
[1:05:40] collection prior to 6:00 in the morning
[1:05:42] 4:30 in the morning um that's been
[1:05:44] addressed but like I say if that
[1:05:47] continues to happen it's a that there's
[1:05:50] a fine in here that we can assess them
[1:05:53] okay you know so there there are some
[1:05:56] ways for to us to ensure that that does
[1:05:58] happen well we need to put that in there
[1:06:00] it's yes and I just I don't think we
[1:06:02] have invoked it well you know one thing
[1:06:04] that I think backing up from the very
[1:06:06] beginning that we really have to
[1:06:08] consider when we talked about economic
[1:06:10] growth for our community we talked about
[1:06:12] bringing in a a company this is a
[1:06:15] company that came into our community
[1:06:17] they met our guidelines they they
[1:06:19] provided they took not their people but
[1:06:22] our people so they B jobs through our
[1:06:25] City they bought close connection and
[1:06:28] they have done a lot of things y'all
[1:06:30] know where my real spill I was so
[1:06:32] impressed that they would take your junk
[1:06:34] off your porch and it's a if it's a
[1:06:36] senior person with a couch they would
[1:06:38] pick it up and put it in a dumpster for
[1:06:40] you those are personalized services that
[1:06:43] they made us people and they here and I
[1:06:46] like you said we have called and they
[1:06:49] used to have a designated person there
[1:06:50] that you could call and so I know that's
[1:06:53] something that we can work out but
[1:06:54] economic
[1:06:56] what has been brought to the city that's
[1:06:58] what we're doing we're trying to find
[1:07:00] company they have a station here that
[1:07:03] they build and they are preserving our
[1:07:05] roads so we didn't have them before they
[1:07:08] had trenches I walk in the morning
[1:07:10] you'll slide off the curb where they
[1:07:11] were digging those holes in the Just
[1:07:14] Between the road uh just from walking
[1:07:16] you couldn't walk on the edge because of
[1:07:18] that and so the the and then when you go
[1:07:21] out 5:30 Walker you see people you greet
[1:07:25] them and you know who they are and
[1:07:27] you're comfortable that they're in your
[1:07:28] yard and walking and doing and can they
[1:07:31] help and they pick up stuff I know
[1:07:33] people leave stuff that's not supposed
[1:07:35] to be on the side of the street those
[1:07:38] guys will just pick it up if it's not in
[1:07:40] that that that we're supposed to be in
[1:07:44] the can and they do a good job so what
[1:07:46] I'm saying is if it's something that we
[1:07:49] can work out we're getting personal
[1:07:51] service and personal service wasn't what
[1:07:54] we were getting in the in the beginning
[1:07:56] so we have a company not only have they
[1:07:59] moved here but they build an additional
[1:08:02] part and that's a permanent part pretty
[1:08:04] much and then the building that the
[1:08:07] crcket work with and that's what we're
[1:08:09] doing with their bit men and working
[1:08:10] together as a group that's nothing more
[1:08:13] but they quet still owns the building
[1:08:16] after they leave so it's been a
[1:08:18] partnership and it seemed like to start
[1:08:21] from scratch when we have a building and
[1:08:24] that's what we are we've been trying to
[1:08:25] get here that we ought to be able to
[1:08:27] work out of The Kinks because things are
[1:08:30] not going to be cheap if you go back to
[1:08:31] bid nothing you can't even by the same
[1:08:33] thing that the same price last week I I
[1:08:36] know anything that you buy now is
[1:08:39] additional within the last year so if we
[1:08:42] can work out the fine details and like I
[1:08:45] said they're there for us with the roll
[1:08:47] offs they they've given us comple a lot
[1:08:49] of complimentary things and most of all
[1:08:51] they have hired our people people that
[1:08:54] live in this this community people that
[1:08:56] spend money in this community so there
[1:08:58] might be some things that we do need to
[1:09:00] work out the details but I am confident
[1:09:04] in knowing how things change that we
[1:09:06] probably won't get the of the deal that
[1:09:09] we have now I guess you want to use that
[1:09:11] terminology but we probably won't get
[1:09:13] all of the accommodations that we have
[1:09:15] at this point cuz we know where you live
[1:09:17] we'll call
[1:09:19] him we hunt him down no so is the so
[1:09:22] basically overall is the only issue that
[1:09:24] we're having having with um with your
[1:09:27] company is just uh getting in touch with
[1:09:30] with them or so to to clarify that
[1:09:33] before Sunny says something um the city
[1:09:37] administrates this contract the city the
[1:09:41] the city hall or the water office when
[1:09:44] you call and you want an additional
[1:09:46] pickup or you want to order a new can or
[1:09:49] a new service or hey I I didn't get my
[1:09:51] trash picked up today you call City Hall
[1:09:54] and we will answer you
[1:09:55] so we're the um primary point of contact
[1:09:58] okay and we know how to get a hold of
[1:10:00] pony Woods the problem and like Mr [name]
[1:10:02] was saying that there the one service
[1:10:05] that we do not manage or administrate is
[1:10:08] the rolloff service we do not collect
[1:10:10] funds for roll off and pass it on to
[1:10:12] them we do that with the residential and
[1:10:14] the and the Commercial Services because
[1:10:16] we're already in a billing mode every
[1:10:18] business and every residence gets a
[1:10:20] water bill from us so that's an easy way
[1:10:22] for us to administrate that process the
[1:10:24] roll office has one they're oneoff here
[1:10:27] projects and so they take care of the
[1:10:30] orders of the rolloffs and they build
[1:10:33] that person directly for rolloff
[1:10:35] services so we're left out of that Loop
[1:10:37] of communication and that's one of the
[1:10:39] biggest concerns of communication is
[1:10:43] ordering rolloffs hey I've been trying
[1:10:45] to get it picked up for a few days right
[1:10:48] now the those the the the phone system
[1:10:50] when you call that number it will roll
[1:10:52] over to potentially anywhere within
[1:10:54] their system all their phones ring at
[1:10:57] the same time so anywhere somebody from
[1:10:58] ssby could pick it up or you know bman
[1:11:01] or Tyler could pick it up and so there's
[1:11:03] just lots of
[1:11:05] little things that fall through the
[1:11:06] cracks on that communication um secondly
[1:11:10] the county does not have the city so the
[1:11:14] county they're direct customers of pony
[1:11:17] Woods if you live outside the city
[1:11:18] limits you get build directly by by um
[1:11:21] Pineywoods that has also been a
[1:11:23] communication problem and I think
[1:11:24] there's a a lot of overlap of complaints
[1:11:27] when people say I've been calling for 2
[1:11:30] days well did you call the city no I
[1:11:32] don't even live in the city well that's
[1:11:33] a county you're you're a direct customer
[1:11:36] call us if you're in the city and we'll
[1:11:38] fix we'll we'll make sure that
[1:11:39] Pineywoods shows up and if not we have
[1:11:41] ways to make sure that they follow
[1:11:44] through with it by by our contract so I
[1:11:46] think that's a big one is having a
[1:11:49] dedicated phone Ser phone
[1:11:51] line to someone here local and if they
[1:11:54] don't pick up where we can drive out
[1:11:55] there and and look at them in their face
[1:11:58] and ask them to help us on certain
[1:12:00] things you know having a dedicated phone
[1:12:02] line is going to be a big
[1:12:03] one the problem
[1:12:06] also same they can
[1:12:08] get that's a big that's a big problem
[1:12:11] for us that's a big problem for us too
[1:12:13] it's part of our business and and how's
[1:12:16] the deal on the is it
[1:12:19] still they have the right to go up 3%
[1:12:21] every year CPI so but all the contracts
[1:12:26] that when when we went out for bid um
[1:12:28] five years ago all the contracts
[1:12:31] um had a requirement for a CPI or
[1:12:35] automatic cap and so this
[1:12:38] one this one it was 5% and we negotiated
[1:12:42] them down
[1:12:44] to 3% was it three or three and a half
[1:12:47] 3% 3% so so 3% is the cap right even if
[1:12:52] the CPI is higher
[1:12:57] but they should come with okay deals
[1:13:02] went up this has went up that's why we
[1:13:04] got to do it if nothing's gone nothing's
[1:13:07] changed you know like the one year they
[1:13:10] didn't go up on us and the next year
[1:13:12] they went up on a
[1:13:14] 6% I didn't like
[1:13:17] that at
[1:13:19] all I mean you you skipped us a year
[1:13:22] when we first started out okay whatever
[1:13:25] everything's good everything we're not
[1:13:26] going to go up on y'all then the next
[1:13:28] year you went up on a 6% instead of
[1:13:33] three I I don't think you should be able
[1:13:36] to do
[1:13:38] that if you skip a year that's just it I
[1:13:42] mean
[1:13:44] so I that that's been a bird for a while
[1:13:48] on
[1:13:49] me okay so well you know details that
[1:13:54] what you can if we can either decide
[1:13:56] that we would do a
[1:13:58] yearly deal or if we skip it we won't do
[1:14:02] it that year we just pick back up where
[1:14:04] we are and those are things that can be
[1:14:06] worked out in the
[1:14:08] contract yeah I think yeah I and I
[1:14:11] understand what you were saying
[1:14:13] yeah so what I would propose at this
[1:14:16] time while we're going over it that we
[1:14:18] might just pick a pick a day go through
[1:14:22] the contract step by step and just
[1:14:25] revisit anything that we have because it
[1:14:28] is a business it's a business that's in
[1:14:30] our city we want to retain them but we
[1:14:33] want to retain them without without any
[1:14:35] conflict and so because we can go
[1:14:38] through the contract step by step and
[1:14:41] just have a workshop on it and that way
[1:14:44] we can iron now because it might be
[1:14:45] something that someone else might
[1:14:47] haven't had a chance but you'll be able
[1:14:49] to do it but like I said the heart of
[1:14:51] this business to me is that they're
[1:14:53] taking care of our people
[1:14:55] and that it is an economic development
[1:14:58] because the money they make we're going
[1:14:59] to get it back through in our and it's
[1:15:02] the dollars are being spent here rather
[1:15:04] than people that are coming out our
[1:15:06] streets are being better preserved
[1:15:08] because we have lighter trucks uh the
[1:15:11] equipment that they can work on is being
[1:15:13] worked on because they have the facility
[1:15:15] here and the supplies and things are
[1:15:17] basically here so when you look at that
[1:15:20] you're looking at who benefits we just
[1:15:23] need to work out to fine details
[1:15:26] and like I said I'm very comfortable
[1:15:27] with the personal service we just need
[1:15:30] the detail service taken care of so I
[1:15:33] would propose or recommend that we pick
[1:15:36] a date to revisit to sit down and after
[1:15:38] we've had a look and have our
[1:15:40] recommendations together and go them
[1:15:43] individually I don't know if that's
[1:15:45] something I I would prefer to do that
[1:15:47] cuz I did I did read through the
[1:15:49] contract and I did have some some
[1:15:51] questions in general but uh it's not I
[1:15:54] mean something that
[1:15:55] like say you need to fine tune and there
[1:15:57] nothing major or anything like that I
[1:16:00] just think it's something that we can
[1:16:01] work
[1:16:02] toward there nothing yeah there nothing
[1:16:05] yeah so we're in agreement that things
[1:16:06] we need to work out we can work out
[1:16:08] things that's what you want to hear we
[1:16:10] work out to find details and I don't and
[1:16:12] we have enough in that timeline we don't
[1:16:14] want to go out to bids because we do
[1:16:16] know it's going to be a change and then
[1:16:18] we're going to be there going to be some
[1:16:20] little hidden things that we won't see
[1:16:22] until after we start doing the service
[1:16:25] but we do know what you are where you
[1:16:27] are we do know the service we do know
[1:16:29] your personnel and we're appreciative of
[1:16:32] it so what we'll do is based on make a
[1:16:35] recommendation and then we'll set a
[1:16:37] designated time that works for everybody
[1:16:40] but what I will do in the meantime is
[1:16:41] I'll make arrangements for the telephone
[1:16:43] because okay they've got a guy in the
[1:16:46] corporate office that buys telephones
[1:16:47] for the whole company so we it'll take a
[1:16:50] week to get it and we'll have a phone
[1:16:52] number local number and uh
[1:16:56] y
[1:16:58] it Mr I think Tim Tim is U gave me his
[1:17:03] number before and I was able to reach
[1:17:05] him
[1:17:06] so that's what I want to tell y yes sir
[1:17:11] YN got personal work so call it don't
[1:17:16] matter yes sir he he was available we
[1:17:18] use it quite
[1:17:19] often well that's great that we're
[1:17:22] personalized say we even know we're
[1:17:23] going to knock on your no
[1:17:25] got my number also that's what they do
[1:17:27] at you around here but we appreciate it
[1:17:29] so with that being said we are we do
[1:17:32] appreciate the service that has gone
[1:17:34] forth and the impact that has had on our
[1:17:37] city good well that's great and so at
[1:17:41] this
[1:17:43] war yeah I would just ask Council that
[1:17:46] um y'all give us dire y'all in a motion
[1:17:49] give us direction to move forward with
[1:17:51] negotiations of the contract and set a
[1:17:54] set a date to to return for a uh
[1:17:58] discussion uh Slash Workshop or
[1:18:01] something okay to go over it just set it
[1:18:04] up so that we don't run into any kind of
[1:18:06] problems with the amount show up and
[1:18:10] that's the main thing is um that it be
[1:18:12] more of a workshop scenario and that we
[1:18:15] also I need to know that we're moving
[1:18:18] forward in this direction yeah to make
[1:18:20] sure that I don't have to miss any
[1:18:22] timelines on the bidding process if
[1:18:23] we're going in this direction so if
[1:18:25] y'all tell us that I think we can move
[1:18:27] forward with this one but move forward
[1:18:29] with negotiations of a contract contract
[1:18:32] okay so we're going to focus on this we
[1:18:33] won't be looking at the bid Parts as
[1:18:35] we're looking at um f tuning negotiating
[1:18:39] the contract that we have I don't think
[1:18:42] if there's going to be a whole lot of
[1:18:43] difference in this this is actually a
[1:18:44] pretty decent contract okay especially
[1:18:47] the 3% because this is we've got one
[1:18:51] other contract that limits it to about
[1:18:53] that much everything CPI and over the
[1:18:56] last three three years four years CPI
[1:18:58] has been at 9 6 and A2 6.8 4.8 so you
[1:19:04] see it's always been above that 3 you
[1:19:07] know it in your business watching prices
[1:19:09] of oil go up and down that's why I shop
[1:19:13] around
[1:19:15] so okay so with that being said uh can
[1:19:18] we get a
[1:19:21] motion you say you want to consider a
[1:19:23] workshop oh okay just yes ma'am request
[1:19:26] uh if you if you can just request that
[1:19:29] we begin negotiations for a con for an
[1:19:32] agreement renewal and set a
[1:19:35] workshop
[1:19:36] um that we're not going out for bid okay
[1:19:40] I make a motion that that uh Council
[1:19:43] consider not going out for me um and
[1:19:47] consider uh negotiating negotiation and
[1:19:52] um pre-plan for Workshop
[1:19:55] um to um revise the contract with
[1:20:00] exclusive franchise agreement um with
[1:20:03] the um solid waste disposal in solid
[1:20:06] waste um live o is that who o yes okay
[1:20:12] it's a motion on the table we had a
[1:20:14] second a second okay we've been moved in
[1:20:17] second all in favor motion carry thank
[1:20:20] you so
[1:20:22] much okay we'll give you a we'll set a
[1:20:25] date that's agreeable to you have any
[1:20:27] more questions if you have some
[1:20:29] questions give me a call yes sir I will
[1:20:32] I appreciate anything I can Tim yes JD
[1:20:35] he gets back just don't make fun of
[1:20:40] you thank you much appreciate it we'll
[1:20:44] see you guys later mayor I see you again
[1:20:47] thank you have a blessing reason that I
[1:20:49] need to stay because I live an hour and
[1:20:50] a half from here all right we appreciate
[1:20:55] you appreciate it thank you okay all
[1:20:57] right move us to item two consider an
[1:20:59] approve of resolution of the city
[1:21:01] council of the city of Crockett Texas
[1:21:02] authorizing the submission of the Grant
[1:21:04] [segment omitted]
[1:21:07] reader acquisition finalization to the
[1:21:10] office of the governor of Criminal
[1:21:12] Justice division they said criminal
[1:21:14] justice here come the pope
[1:21:16] P mayor
[1:21:19] council this is our the Final Phase of
[1:21:22] our project with LIC readers for the
[1:21:25] city uh we've been working on this a
[1:21:28] little over three years
[1:21:29] now uh we received the first one and
[1:21:32] then we just recently received the
[1:21:34] funding for the next three uh with four
[1:21:38] more we'll be able to cover the entire
[1:21:40] city every road coming into the city
[1:21:42] [segment omitted]
[1:21:45] ones that we're getting are uh quick
[1:21:47] deploy they're backed up with solar
[1:21:50] power um so they're a lot lot more uh
[1:21:55] energy efficient and easier to put out
[1:21:57] cost effective so uh this is a grant the
[1:22:02] last round of Grant is closed we
[1:22:04] finalized all those they reopen we just
[1:22:06] submitted this grant um right at 20
[1:22:11] actually I think $20,000 to be exact for
[1:22:14] four additional and it's 100% Grant so
[1:22:17] the city won we don't have to match it
[1:22:20] and that's what this resolution is for
[1:22:23] [segment omitted]
[1:22:25] or block these are Vigilant Solutions
[1:22:29] through
[1:22:30] Motorola they have a little larger um
[1:22:33] following so to speak um
[1:22:38] so the numbers seem to be a lot higher
[1:22:40] with these all across the United States
[1:22:43] [segment omitted]
[1:22:46] reason why their prices have come down a
[1:22:49] little bit uh because they now have some
[1:22:51] competition uh but we went with this
[1:22:53] company because they use commercial data
[1:22:56] also so it opens up the possibility of a
[1:22:59] lot more so do we have two now or So
[1:23:03] currently working we have one we have
[1:23:05] three on the way so that' be four total
[1:23:08] cuz there's two on that team one for
[1:23:09] love lady and
[1:23:11] then one of them one of them's not ours
[1:23:14] one of not one a one of a
[1:23:17] text one of them is a text Dot okay uh
[1:23:21] all right so the one in love lady is not
[1:23:22] working right we've got one and we have
[1:23:25] three on the way that we just closed out
[1:23:28] which one is ours the one with the St
[1:23:31] the one in love lady ours is the bigger
[1:23:34] one closer to love lady just on
[1:23:36] the side of the love lady City okay yeah
[1:23:40] it's not working what's that it's not
[1:23:42] working it is as it today the it wasn't
[1:23:45] working today the display doesn't always
[1:23:48] work okay when the battery starts
[1:23:49] getting low it'll cut that off it goes
[1:23:52] into a okay
[1:23:56] and you're getting good good results too
[1:23:58] good results from them yeah okay uh I
[1:24:03] don't know the exact number I should
[1:24:05] have had that
[1:24:06] tonight the stolen vehicles so if you
[1:24:09] don't know about license plers what they
[1:24:14] do computer and
[1:24:17] ifle for the stolen human trafficking
[1:24:21] child sex trafficking terrorist
[1:24:23] organizations Nar related or even if
[1:24:26] that vehicle tagged to have a wanted
[1:24:28] person inside it automatically alerts
[1:24:30] the officers so they can go set up and
[1:24:32] weit on that vehicle so um it also
[1:24:36] allows us to at any particular time look
[1:24:38] at our traffic count to see how many
[1:24:40] cars have come in towards
[1:24:42] Crocket use that like during events and
[1:24:45] stuff like that if that one set up on
[1:24:47] the south side that does it read coming
[1:24:51] okay it reads in the opposite direction
[1:24:53] okay it catches North and okay good okay
[1:24:56] and that's what the new ones will do too
[1:24:58] they'll catch both both Direction I
[1:25:01] think it's a great
[1:25:03] tool I mean you used to didn't know what
[1:25:05] direction of travel if you drive on the
[1:25:07] road Bey beyond the
[1:25:11] actual you want to
[1:25:15] testify AC country been huge help on
[1:25:19] Investigation that's you can trace
[1:25:21] people it's amazing to do with the SE we
[1:25:24] get that will free up uh the mobile and
[1:25:27] we'll be able to move it around the city
[1:25:29] in different areas where we're having
[1:25:31] issues or maybe higher theft something
[1:25:34] like that we can move it around that out
[1:25:37] have what you were ask about earlier
[1:25:40] only uh on the resolution um I think I
[1:25:43] just kind of read over it and everything
[1:25:45] just kind of get an understanding of it
[1:25:47] um but there's a um section that I would
[1:25:50] like to add something to your your um
[1:25:53] resolution so we can't add to these
[1:25:55] resolutions these are uh these are
[1:25:59] dictated by Homeland Security uh that's
[1:26:01] so that's where this come from the
[1:26:03] specific requirements um I'm not sure
[1:26:06] what you would like to add I mean I can
[1:26:08] ask them uh but these These are provided
[1:26:10] to us uh from the governor's office as
[1:26:13] to what has to be on this resolution
[1:26:15] okay only thing I think uh what I was
[1:26:17] asking to add possibly is where it says
[1:26:19] the authorized official is given the
[1:26:21] power to apply for accept reject
[1:26:25] alter or terminate the Grant on behalf
[1:26:29] of the applicant agency and I was
[1:26:32] looking at up on approval of
[1:26:35] counsel so is that is that sufficient or
[1:26:38] not I'm no that might be something that
[1:26:40] would be added but uh essentially
[1:26:44] um this Grant and all the documentation
[1:26:48] the filings um I'm responsible for since
[1:26:51] I'm filing it through the city but as an
[1:26:53] employ of the city I have to have the
[1:26:55] approval of the council to submit this
[1:26:57] grant uh so um basically what that's
[1:27:01] saying is that at any point um I can say
[1:27:05] no we're not going to get this grant
[1:27:06] it's going to cost us more money or this
[1:27:09] isn't going to work um or when they
[1:27:11] notify me uh Chief [name] your Grant has
[1:27:14] been approved at the local level do you
[1:27:16] wish to continue that gives me the
[1:27:18] authority to say yes we want to continue
[1:27:21] um and basically what this resolution is
[1:27:24] for for me to bring the information
[1:27:25] before y'all so y'all know exactly what
[1:27:28] it's going to cost and what we're doing
[1:27:30] so that there's no surprise and flavor
[1:27:33] so that's that's why that's wording okay
[1:27:36] cuz when I was looking at it it said
[1:27:37] alter and when it said alter that kind
[1:27:40] of C stuck out to me CU I was at the
[1:27:41] point to where if you make any changes
[1:27:43] and we're not aware of the changes that
[1:27:46] you made I mean um good point for
[1:27:49] instance the last round of grants that
[1:27:52] we just got reapplied for four um we
[1:27:54] didn't get awarded the full amount okay
[1:27:57] uh so I had to work and my assistant
[1:28:00] chief and the captain he back there too
[1:28:02] we had to work with the company and
[1:28:04] alter that proposal we had to alter that
[1:28:06] quote because the original one said four
[1:28:09] we didn't have enough money so we had to
[1:28:11] work with them and get them to Crunch
[1:28:13] the numbers and we were able to get
[1:28:14] three instead of four with the amount
[1:28:17] the state awarded it so I think when it
[1:28:18] talks about alter that's what it's
[1:28:20] talking about if they come back and say
[1:28:23] hey this price went up you know
[1:28:26] $1,000 then I have to work with them and
[1:28:29] say no we can't do that we need to back
[1:28:31] it down so with that being said you
[1:28:33] still bring it back to council and
[1:28:35] advise us of the changes that you made
[1:28:38] uh typically I would not um if it's
[1:28:40] something that um we're not if we didn't
[1:28:44] receive the grant funds for it uh my
[1:28:47] response to them would be either we need
[1:28:50] to go down in quantity or we need to
[1:28:53] make these work through your company
[1:28:55] because this is what's been approved for
[1:28:58] the grant this is what my city council
[1:29:00] has approved if you can't do that then
[1:29:02] we we'll go somewhere else maybe a
[1:29:05] little um input on that also if if
[1:29:08] there's a requirement for additional
[1:29:09] funds like he can't commit the city to
[1:29:12] to spending money that has not been
[1:29:13] approved so if if they come back and say
[1:29:17] hey you only you know if you're going to
[1:29:18] have to buy the fourth one if you really
[1:29:20] want it he couldn't make that kind of a
[1:29:22] decision he's not going to be able to
[1:29:24] commit the city to any funds that's not
[1:29:26] approved and right now he's telling you
[1:29:28] it's going to be now it's going to be
[1:29:29] zero so as long as he stays under
[1:29:32] zero exactly we won't have to come back
[1:29:35] the last one they come back I think we
[1:29:36] applied for
[1:29:38] 46,000 and they come back and said hey
[1:29:40] you know we can only give you
[1:29:43] 22750 um so we had had to take some off
[1:29:47] we had to take some equipment off we had
[1:29:49] to make those numbers work so it fell on
[1:29:52] us because that that Mone from the state
[1:29:54] it's not from the city so we had to make
[1:29:57] it work where it fell that number okay
[1:29:59] yeah I I was just looking over and
[1:30:01] reading it because there's a lot of
[1:30:03] times there's a play on words so I was
[1:30:05] want to make sure that I was good with
[1:30:07] it okay you have any other comments
[1:30:11] questions okay can we get a
[1:30:17] motion I make a motion that we accept
[1:30:19] the uh
[1:30:21] resolution um number r
[1:30:25] 2D2 to allow um Chief [name] to apply a
[1:30:31] submit for the Grant application uh for
[1:30:34] [segment omitted]
[1:30:37] motion on the floor second it's been
[1:30:40] moved in second all in favor motion
[1:30:44] carries okay that brings us to item
[1:30:46] number
[1:30:47] seven consider and approve a proposal
[1:30:50] for the city of Crockett and the
[1:30:52] Crockett Area Chamber Of mer to host the
[1:30:54] freedom of a quet Independence Day
[1:30:57] fireworks show and cover any funding
[1:31:01] shortfall not met by donations if
[1:31:04] necessary mayor and Council
[1:31:07] um due to this being a little bit of a
[1:31:10] moving Target and we're shooting for a
[1:31:12] project in July um I wanted to bring it
[1:31:15] to you so we could begin working hard on
[1:31:19] it's kind of the egg or the chicken
[1:31:21] process because we can't go out and
[1:31:22] bring in a lot of fun funding and
[1:31:24] donations for a project that Council has
[1:31:26] not approved or is not going to back up
[1:31:28] and and say that we're good on having so
[1:31:32] that being said we feel we've done this
[1:31:34] two years now this will be our third
[1:31:36] year uh the first year we had a budget
[1:31:38] of 25,000 and we are we were able to
[1:31:41] raise about
[1:31:43] 27,000 we had a little bit of funding
[1:31:45] left over going into last year U we had
[1:31:49] some aspirations to make it just a
[1:31:50] little bit bigger and better than the
[1:31:52] previous year um and we fell just
[1:31:55] slightly short so we were about $3,000
[1:31:58] $3,000 under um in raising the necessary
[1:32:02] donations so we wanted to bring that
[1:32:04] number back down to 25,000 the first
[1:32:07] year was 25 then we went increased it to
[1:32:09] 30,000 so we wanted to bring the budget
[1:32:11] down to about 25,000 we do have a lot of
[1:32:15] uh committed people that have have said
[1:32:18] that their business will donate the
[1:32:19] funds to we have an idea of what we're
[1:32:21] going to get but I cannot guarantee you
[1:32:23] that every one of those checks will cash
[1:32:25] and or you know everybody's going to be
[1:32:27] um able to support it um but I do feel
[1:32:30] pretty confident um as recently as
[1:32:33] possible that 25,000 is probably a safe
[1:32:37] um doable budget um a lot of the other
[1:32:39] things that we do outside of that to
[1:32:41] make that project happen does not cost
[1:32:43] us any additional funds um a lot of this
[1:32:46] money also goes back
[1:32:48] into um advertising for those businesses
[1:32:51] the businesses that uh don't towards
[1:32:54] this project we're able to put some
[1:32:56] banners up and do some newspaper ads and
[1:32:58] radio ads of all the businesses that
[1:33:01] support um our fire our freedom over
[1:33:04] Crockett fireworks show this uh this
[1:33:07] past year I also had or this current
[1:33:09] year I had someone um someone else that
[1:33:11] is that actually is
[1:33:13] local um they're out of
[1:33:16] Elkart and well fairly local and they
[1:33:20] said that they're interested in
[1:33:21] submitting a bid as well
[1:33:24] um I did ask them to submit a bid based
[1:33:27] on 25,000 so essentially you can ask for
[1:33:30] anything and the cost what I've learned
[1:33:32] to find come to find out a 3-in mortar
[1:33:36] shell to a 4 in 5 in 6 in it's not just
[1:33:39] an small incremental change it's three
[1:33:43] to four times as so a 5 in is
[1:33:46] considerably more than a 4 in not just a
[1:33:48] little bit more so if you so if you go
[1:33:51] out and ask them say hey put me a
[1:33:53] proposal together
[1:33:55] they may put a bunch of two you know 3
[1:33:56] in or 4 in and less of the other so we
[1:34:00] asked them to maximize our budget the
[1:34:03] proposal for 25 based on a $25,000 bid
[1:34:06] so y'all can kind of see an Apples to
[1:34:07] Apples comparison of kind of how big of
[1:34:10] a show this would be last year we went
[1:34:12] up to 8 in 8 Ines were visible from
[1:34:16] further off like you could see them
[1:34:17] across town on the other side of the
[1:34:19] loop you can see them but you the bulk
[1:34:22] of the people that were there to enjoy
[1:34:23] them
[1:34:24] couldn't really tell the difference
[1:34:25] because they shoot straight up in the
[1:34:26] air and they go if it's here or here you
[1:34:30] don't see the difference um and so we
[1:34:33] were able to get bigger bang for buck by
[1:34:35] dropping it down to 6 in um that's what
[1:34:38] we did the first year and we had really
[1:34:39] a really good showing um and lots of you
[1:34:43] know good feedback on it so this is what
[1:34:47] both of these quotes are based off of
[1:34:48] are um a bulk of 6in shells 5 in shells
[1:34:52] 4 in 3 in down to 2 and 1/2 in shells
[1:34:56] um the other quote the second page is
[1:34:59] the quote from the the pr Technic group
[1:35:02] that did has done it the pro previous
[1:35:04] two years both of these groups I
[1:35:07] feel um good about obviously one of them
[1:35:10] we have history with pyro shows of Texas
[1:35:15] um the other one is a local group like I
[1:35:18] say so I asked them for some references
[1:35:20] I called some other cities that they've
[1:35:22] done it for school districts they do
[1:35:23] great graduation ceremonies and U or you
[1:35:26] know graduation uh firework shows as
[1:35:29] well as for some other cities and so I
[1:35:31] got good feedback
[1:35:33] from those cities um in
[1:35:37] school so
[1:35:40] um the the other difference is the first
[1:35:44] one Wilson family pyot Technics they're
[1:35:47] available to shoot on the day of July
[1:35:49] 4th that Friday the other group
[1:35:54] is only available their Fridays are
[1:35:56] fully booked they do about 20 to 30
[1:35:58] shows a you know it every day so they
[1:36:02] didn't have any extra Crews to put
[1:36:04] together a Friday show that's the number
[1:36:07] one available you know date that or date
[1:36:10] that people request so they didn't have
[1:36:11] any availabilities then so they can do
[1:36:14] that Saturday if we wanted to move it to
[1:36:16] a
[1:36:17] Saturday
[1:36:19] um and so that's kind of another
[1:36:24] compar or you know difference between
[1:36:25] the two contracts one uh the first one
[1:36:29] will Wilson family uh pyot teist can do
[1:36:33] it on the Friday or a Saturday the other
[1:36:36] group can only do it on a
[1:36:38] Saturday that being said I I truthfully
[1:36:42] feel good about both of these entities
[1:36:45] and that's why I'm bring you know I have
[1:36:46] to I want y'all's input on it um um
[1:36:50] doing it with a company that we've done
[1:36:52] it with before there's a reasonable
[1:36:54] amount of you know comfort in that that
[1:36:58] they're not g to let us down or they
[1:36:59] don't have all the necessary equipment
[1:37:01] or they show up and they have some
[1:37:03] technical difficulties and they don't
[1:37:04] fire them all and there's things that
[1:37:07] happen all the time in firework shows so
[1:37:08] it's always good to have somebody that
[1:37:10] is really good at it so that being said
[1:37:12] I know pyro shows Wilson company been in
[1:37:14] business uh for quite a few years
[1:37:16] they've actually they began they've shot
[1:37:19] for several of these bigger groups the
[1:37:21] Pyro shows um there's a gulf coast show
[1:37:23] uh pirate uh pyot Technics so they've
[1:37:26] fired off for them and but have recently
[1:37:30] just in the last three or four years
[1:37:31] open up their own
[1:37:33] company and so it would be better to do
[1:37:36] it on the forth me I like that um and
[1:37:43] but that being said that would be my
[1:37:45] biggest concern is going with a new
[1:37:46] provider and and cuz getting back on the
[1:37:50] list with the old one is also going to
[1:37:53] be tough it was hard to get in their
[1:37:54] queue as a as a them as being our vendor
[1:38:00] so moving to a new company I wanted to
[1:38:02] be sure it was a good company to present
[1:38:04] to y'all and I feel like this is a good
[1:38:06] company to present to them and I spoke
[1:38:07] to the other cities as well you you
[1:38:09] spoke to the cities they've done them
[1:38:10] for yes sir and it was okay yes
[1:38:13] sir because they're local and they're
[1:38:17] and they so if you look at the breakdown
[1:38:19] of the shells
[1:38:21] um the
[1:38:24] the breakdown of the shells is
[1:38:26] 1,00 this did not get transferred over
[1:38:29] but that the shell quantity and like I
[1:38:31] say this is not any different than
[1:38:33] previous years but the Pyro
[1:38:36] shows um for that amount of money in
[1:38:39] that in their shell breakdown they
[1:38:41] provided a few more six Ines than the
[1:38:43] other company but overall they've only
[1:38:45] they're providing about six
[1:38:47] 600 uh shells and and the other compan
[1:38:50] is providing 1,00 shells for that
[1:38:54] same uh value and I think a lot of it is
[1:38:56] because of they're not transporting
[1:38:59] these from this other company I believe
[1:39:01] transports them from Austin so they have
[1:39:03] to get Tech Stop permitting
[1:39:05] and lots of cost in bringing that and
[1:39:07] they stay overnight at the hotel and we
[1:39:10] and then they pay for a police officer
[1:39:11] to sit out and watch it this other group
[1:39:13] being local can bring them right in and
[1:39:16] set up that day without having to pay
[1:39:17] overnight security well I mean that
[1:39:21] hesitation kind of didn't do I mean we
[1:39:24] had a lot of bang but that little
[1:39:25] hesitation didn't nobody really get the
[1:39:27] full
[1:39:30] value my only we thought we thought the
[1:39:32] party was over my my only question about
[1:39:35] the whole thing is the fact that they
[1:39:38] could do it Friday or Saturday and we
[1:39:40] know that July the 4th is the big
[1:39:43] fireworks yeah and and and they they've
[1:39:46] got both dates uh open that that's my
[1:39:50] only concern about it well it
[1:39:54] they they've got both dates open but
[1:39:56] they have more
[1:39:57] people they're doing more shows than
[1:40:00] just ours yeah Wilson mhm yeah oh yeah
[1:40:03] they got they got several people that go
[1:40:06] and do this show what you you and I talk
[1:40:09] about same with Wilson and elart so so
[1:40:11] and and Wilson um a big reason they're
[1:40:14] they're trying to expand and do more of
[1:40:17] these shows so like I say they're fairly
[1:40:19] new they're not uh they haven't been out
[1:40:22] for
[1:40:24] so what
[1:40:25] are ma'am what are some of their
[1:40:27] references uh the city of Maha I called
[1:40:31] um I call the city of Maha and actually
[1:40:32] I spoke to the fire chief who was
[1:40:35] involved with them and if anybody's not
[1:40:37] going to care for the fireworks group is
[1:40:40] going to be the fire chief and he said
[1:40:42] they were very professional set up
[1:40:44] everything went off you know any of our
[1:40:47] concerns they addressed them um I also
[1:40:49] spoke to the uh city of uh or the school
[1:40:52] district um they they did the elart
[1:40:55] graduation ceremony for El the Elkart
[1:41:00] ISD and then spoke to a couple of the
[1:41:02] other big pyro shows that they uh
[1:41:04] contract
[1:41:05] for
[1:41:07] um that sounds like that the people had
[1:41:10] own that Culver company up there too
[1:41:13] possibly I thought so but they're not
[1:41:15] they're not he said
[1:41:18] possibly long distance okay or you know
[1:41:21] somewhere back down the road but um
[1:41:23] they're not directly related to
[1:41:26] Wilson but that's what I would have
[1:41:27] assumed as
[1:41:29] well so those are only two references
[1:41:31] you you spoke with on their behalf or no
[1:41:34] four of them the other two I can't
[1:41:36] remember one was GF G Gulf Coast out of
[1:41:39] Houston bont area um pyot Technics that
[1:41:43] they contract for and the other one was
[1:41:45] North Texas
[1:41:46] pyros out of Dallas area that they
[1:41:50] contract with and so all those good you
[1:41:54] know
[1:41:55] uh they they come highly recommended
[1:41:58] from other people who have used them you
[1:42:06] know that's fine with me okay what do
[1:42:10] can we get a recommendation or I'll make
[1:42:13] a motion we go with Wilson out of I
[1:42:17] second okay it's been moved in second
[1:42:19] all in favor Wilson we will okay with
[1:42:23] that being
[1:42:26] said uh that brings us
[1:42:30] to our final item is that it yes
[1:42:35] ma'am and it's in an executive session
[1:42:38] at this
[1:42:40] time we
[1:42:42] will
[1:42:46] drone y'all may stay take your shoes off
[1:42:50] S as
[1:42:53] got to tell

[1:47:53] if you talk to him he's going to
[1:48:14] tell that's the I
