P1 0:06And we will open with an invocation and
P1 0:08a pledge. And we do appreciate Pastor
P1 0:10[name]. He did offer to share the prayer,
P1 0:13but we're grateful that he's doing it
P1 0:15tonight. Thank you,
P1 0:16>> let us pray. Heavenly Father, we come to
P1 0:19you this afternoon thanking you for this
P1 0:21day, beautiful weather, all your
P1 0:23blessings in our life. And we also thank
P1 0:26you for the opportunity to gather here
P1 0:28tonight for those who are in attendance
P1 0:30with us tonight. Father, we just ask you
P1 0:32your blessings upon tonight. And and
P1 0:35Lord, as always, as as we uh we're here
P1 0:39concerning the the business and the
P1 0:42betterment and the welfare and the
P1 0:43growth of our city, we ask you for
P1 0:47wisdom beyond our knowledge
P1 0:50or our experience
P1 0:53that you may be glorified
P1 0:56uh through uh all things, Lord, that
P1 0:59that we come to decisions about uh
P1 1:02tonight. and we thank you and we give
P1 1:05you all of the praise in Jesus name.
P1 1:07Amen.
P1 1:08>> Amen. The
P1 1:09>> pledgece
P1 1:12to the flag of the United States of
P1 1:15America and to the republic for which it
P1 1:18stands. One nation under God,
P1 1:22indivisible, with liberty and justice
P1 1:24for all.
P1 1:31So once again, it's my pleasure to to
P1 1:33recognize all of the visitors that are
P1 1:35here. We're so grateful that you've
P1 1:36taken out of your day to come and share
P1 1:39with us uh equally. But I know one thing
P1 1:41I'll usually forget is to recognize how
P1 1:44appreciative we are of the council.
P1 1:47This is not the highest paid job in the
P1 1:49world. [laughter]
P1 1:51So, we know that it's much love and much
P1 1:53care and much concern the reason they
P1 1:55continue to work with the city and we do
P1 1:58appreciate the the job that they do
P1 2:00because in case you haven't noticed when
P1 2:02they leave here, it doesn't stop. It's
P1 2:05always a friendly constituents that
P1 2:07would like to share with them. So,
P1 2:09they're on a 24-hour call. So, we do
P1 2:11appreciate it and we thank them for
P1 2:13their dedication. Uh with that being
P1 2:15said, uh at this time we'll go to our uh
P1 2:19comments from the audience at one and we
P1 2:21have one and will be Bobby Bolan. Just
P1 2:25as a reminder, each person has three
P1 2:27minutes. Not that we don't we're not
P1 2:29interested in what you're saying. Nobody
P1 2:32from the council can comment. It's just
P1 2:34your three minutes and when it's over we
P1 2:37the clock would deem. Thank you so much.
P1 2:42Mr. Mayor, council,
P1 2:44family, appreciate y'all giving me this
P1 2:46opportunity to appear here tonight.
P1 2:49First, I want to congratulate you on
P1 2:51your your case that you won this past
P1 2:54week. Uh, judge dismissed it with
P1 2:56prejudice, which is very good. And
P1 2:59having said that, I also noticed that
P1 3:01the judge made some remarks indicating
P1 3:06in federal court that he does not
P1 3:08understand why there's not been criminal
P1 3:11charges pursued in this. [snorts]
P1 3:13Uh I think what he's talking about there
P1 3:15have been no indictments
P1 3:17or anything else in regard to the
P1 3:20criminal activity conducted by the
P1 3:22members and the board of the CIDC.
P1 3:27and they've had every opportunity,
P1 3:30officials have, our past district
P1 3:32attorney had an opportunity to prosecute
P1 3:34it. Reasons unknown, either scared to or
P1 3:38too lazy to do it, but she passed it on.
P1 3:42Uh, our city
P1 3:45uh police chief
P1 3:48uh failed to present any cases, I think,
P1 3:50for the same reason, possibly either
P1 3:52lazy or too scared to do it. But a
P1 3:55federal judge has seen and does not
P1 3:58understand why
P1 4:01uh there hadn't been any charges filed.
P1 4:04And I think as a city council and the
P1 4:07people in in this county and the city
P1 4:10have every opport every reason to be
P1 4:13told somehow somewhere what and why
P1 4:16nothing has been done.
P1 4:19I think it need to be come upon y'all's
P1 4:21power through the city council to insist
P1 4:25that charges are looked into and proper
P1 4:28charges filed for the wrongdoing in the
P1 4:31CIDC.
P1 4:33I know that uh counties surrounding us I
P1 4:36see all the time where officials have
P1 4:39been prosecuted and sent to prison for a
P1 4:42lot less than what has happened with the
P1 4:43CIDC.
P1 4:45And people don't understand in this
P1 4:47county why that's happening these other
P1 4:50places and we can't get any answers or
P1 4:52anything done uh in this county
P1 4:55regarding the CIDC.
P1 4:57I appreciate your time. Thank you.
P1 4:59>> Thank you.
P1 5:01>> Uh with that being said, those are the
P1 5:03comments from the audience at the time
P1 5:05that the council would like to make a
P1 5:07statement or comment. And likewise, it's
P1 5:09not a discussion. It's just a general
P1 5:11comment as it will be with others.
P1 5:14Um um mayor council kind of just kind of
P1 5:18want to bring to your attention um I'm
P1 5:21still kind of concerned really concerned
P1 5:24with the um deficit that we're in um the
P1 5:29328,000
P1 5:31u dollars well over a4 million uh
P1 5:35dollars. So, with that being said, I'm
P1 5:38really concerned about it because I feel
P1 5:41like that no one has spoke up and said
P1 5:43that we needed to need an audit because
P1 5:46that's quite a bit of money. As a matter
P1 5:48of fact, um that's
P1 5:52prison time uh speaking on that behalf.
P1 5:56So, um I would suggest or recommend that
P1 6:00we place it on our agenda to consider
P1 6:03auditing having an audit to find um
P1 6:08where any monies have been either
P1 6:10mismanaged
P1 6:12or any mouth or overspending has been
P1 6:16done. So, with that being said, um I
P1 6:21want to kind of ask um I see attorney
P1 6:25>> Okay. We're just you're just having a
P1 6:27journal conversation. It's not
P1 6:28>> We have that done every year
P1 6:30>> at this at this point. It's just your
P1 6:32comment and not interaction.
P1 6:34>> Okay. But
P1 6:35>> it's been done every year,
P1 6:36>> but I was told every excuse me,
P1 6:38>> it's it's done every year.
P1 6:40>> Okay. Right now, this is not a
P1 6:41discussion area. She's just going to
P1 6:43give a comment of where she feels
P1 6:45without interaction.
P1 6:46>> Yes, ma'am. But I was told last time
P1 6:48that if I needed to speak to the
P1 6:50attorney that y'all would prefer me to
P1 6:52speak to the attorney in the presence of
P1 6:54counsel. Okay. We're not This is It's
P1 6:56not a a time at this point. You're just
P1 6:58giving us comment at this time
P1 7:00>> and we're not having a dialogue.
P1 7:01>> Okay. It's just this is just for
P1 7:03comment.
P1 7:04>> Okay. Okay. We'll discuss in the
P1 7:07executive session. Thank you. Yes,
P1 7:08ma'am. Appreciate it.
P1 7:10>> Can I say something?
P1 7:12>> You can.
P1 7:12>> I mean, it's like, do you
P1 7:13>> I mean, it's not a rebuttal or anything.
P1 7:15>> Well, no, I mean, I was just asking, do
P1 7:17you get a letter from Alex and and
P1 7:20filling out? I mean, it's done every
P1 7:22year. Well, there's an audit.
P1 7:24>> Let me just explain one thing.
P1 7:26>> It's it's just a comment. It's not a
P1 7:28conversation. So, you may make a comment
P1 7:30about it or any of the council, but it's
P1 7:33not a general conversation because it's
P1 7:35not
P1 7:36>> comment. Okay. You may say it's
P1 7:38>> done every year.
P1 7:39>> Okay. Thank you. Anybody else have a
P1 7:41comment?
P1 7:42>> Uh yes, ma'am. Uh, also just to to let
P1 7:45um let you all know uh precinct three
P1 7:48know that I kind of made uh some visits
P1 7:52uh during at precinct during uh uh I
P1 7:55think about month or two ago uh vis made
P1 7:59some visits with some residents in
P1 8:00precinct 3 and so they wanted me to
P1 8:03bring to the attention of different
P1 8:05items that um need uh addressing in
P1 8:09precinct 3. So, with that being said, I
P1 8:12want to make sure that we do uh get that
P1 8:15on the agenda again [clears throat] um
P1 8:17in December. Um, also with that being
P1 8:20said, um there is um
P1 8:26also a concern of the um
P1 8:30town hall the the creek that's running
P1 8:35um
P1 8:38where MLK is Sycamore and down south uh
P1 8:43South Second Street. So um I want to
P1 8:46would like to address those concerns as
P1 8:49well. So I wanted to bring bring that
P1 8:52forth also um in that discussion about
P1 8:56putting something on the agenda for next
P1 8:58month um also about precinct 3. The size
P1 9:02of the precinct 3 has been increased um
P1 9:05and the population of precinct 2 was
P1 9:08decreased. And from my understanding
P1 9:10with the redistricting,
P1 9:12um, trying to understand how the funds
P1 9:15are distributed for repairs on streets
P1 9:20or any other repairs that need to be
P1 9:22done in our precinct. So, I would like
P1 9:24for that to be explained as well, not
P1 9:27just myself, but we have other new
P1 9:29council members on here as well that
P1 9:31probably don't understand the um the way
P1 9:34the uh funds are distributed amongst the
P1 9:36precincts.
P1 9:37>> Okay.
P1 9:37>> Okay.
P1 9:38>> Thank you. I think everybody understands
P1 9:40it except one.
P1 9:41>> Okay. Well, we're good. We're any Does
P1 9:43anyone have a personal comment that
P1 9:45they'd like to address? If not, thank
P1 9:47you so much for your comments. And the
P1 9:51way it's set up, it will be an
P1 9:52opportunity to be an agenda item to
P1 9:55discuss the details from the budget and
P1 9:57those kinds of things. So, thank you so
P1 9:59much. And so, that brings us down to the
P1 10:02uh item, the veterans recognition.
P1 10:06Number one, consider and approve a
P1 10:08proclamation recognizing the
P1 10:10contributions of veterans employed by
P1 10:12the city of Crockett to acknowledge
P1 10:14their commitment both in service to the
P1 10:17nation and their continued service to
P1 10:20the community through their work with
P1 10:22the city. Uh [name] is going to present
P1 10:25it.
P1 10:26>> Good evening everyone.
P1 10:28>> Good evening. While it's easily said
P1 10:29that our employees are our greatest
P1 10:31asset in the city, tonight the city of
P1 10:33Crockett wants to take a special moment
P1 10:35to honor a special group of people, the
P1 10:38men and women among our city staff who
P1 10:39proudly serve in the United States Armed
P1 10:42Forces in recognition of the upcoming
P1 10:44Veterans Day. Their service did not end
P1 10:47when they took off the uniform. They
P1 10:49carried that same discipline, courage,
P1 10:50and dedication right here into public
P1 10:52service of the city, serving our
P1 10:54citizens each and every day in
P1 10:56departments across the city. Tonight, we

P1 11:20council member, and over 20% of our
P1 11:21employees that have or are serving as
P1 11:23armed force veterans. At this time, I'd
P1 11:26like to formally present the Veteran
P1 11:28Friendly Employer Recognition Award on
P1 11:31behalf of the Texas Workforce
P1 11:32Commission. This award represents the

P1 25:36to where honor is due. We do appreciate
P1 25:39all the great things that have gone
P1 25:41forth.
P1 25:46>> And so with that, we're back to our
P1 25:49regular order business, approval of
P1 25:52minutes. Item number two,
P1 25:56may
P1 25:56>> make a motion we approve.
P1 25:58>> I second the motion.
P1 25:59>> It's been moved and second. All in
P1 26:00favor?
P1 26:02Motion.
P1 26:05>> Motion carries. Okay. Uh then it brings
P1 26:08us to item number three. Consider and
P1 26:10approve a resolution for the temporary
P1 26:12closure of state right of way for
P1 26:15Christmas lighting of downtown Crockett.
P1 26:18>> Mayor and council, uh the downtown
P1 26:22Crockett Association has requested we
P1 26:25close the east side of the square for
P1 26:27the Christmas lighting, the annual event
P1 26:30we have. It's at 6:00 p. p.m. It's just
P1 26:33approving the resolution to close those
P1 26:35state highways.
P1 26:37>> Okay,
P1 26:38>> I make a motion we approve it.
P1 26:39>> I second.
P1 26:40>> Okay, it's been moved and second. All in
P1 26:42favor? Motion carries. It bring us to
P1 26:45item number four. Consider approve an
P1 26:47audience of amending the code of of
P1 26:50ordering city of Crockett, Texas by the
P1 26:52amendment of chapter 13 license and
P1 26:54business regulation amending amending
P1 26:57article 13 ammusement uh redemption
P1 27:00machines section 13-503
P1 27:04paragraph C relating to
P1 27:08uh I lost my disting restriction uh
P1 27:11adding additional location to the 300 ft
P1 27:16Distant restriction limiting the
P1 27:18resident residential distant restriction
P1 27:22to only apply to a residential dwelling.
P1 27:26Adding an exception for a residential
P1 27:28dwelling that is part of a mixed use
P1 27:32commercial and residential property.
P1 27:34clarifying how the distance restriction
P1 27:37is measured and changing the distance
P1 27:39measurement for a church to consider the
P1 27:42church property line instead of only the
P1 27:45church front door. Expanding the
P1 27:48location restriction to one uh amusement
P1 27:51redemption machine establishment per
P1 27:54partial or providing a servability
P1 27:57clause containing a repealing clause and
P1 28:00providing an effective date. Mayor and
P1 28:03Council, this is just basically updating
P1 28:05and clarifying our existing ordinance.
P1 28:08And if you'll notice um the changes
P1 28:10that's on page 13 in your packet, it
P1 28:13shows what's added, which is underlined,
P1 28:16and what was taken out was marked
P1 28:18through. Uh other religious
P1 28:20establishments, government offices or
P1 28:22offices that conduct government related
P1 28:24business, public library, public parks
P1 28:25or daycare facilities were added.
P1 28:28[snorts]
P1 28:29um counseling rehab centers or a
P1 28:32residential dwelling other than a
P1 28:34residential dwelling that is part of a
P1 28:36mixeduse commercial and residential
P1 28:37property. Then it just clarifies a
P1 28:40little bit about how the distance shall
P1 28:42be measured. Uh we submitted all that to
P1 28:45the city attorney for approval and and
P1 28:49so
P1 28:51>> um I have a question.
P1 28:52>> Sure.
P1 28:53>> Okay. So, uh do we know the reason why
P1 28:56the ordinance has come about? I notic
P1 28:58you saying it's updating but did there
P1 29:00were there a business or something like
P1 29:02that ma'am you to inquire about this?
P1 29:05>> No ma'am part of it is state statutes
P1 29:07change too and what is required and and
P1 29:10this is just basically clarifying
P1 29:12because some of our ordinances as we've
P1 29:14discussed before or simply outdated.
P1 29:18We're trying to catch up and so when
P1 29:19there's questions and we that come up
P1 29:22then I want to make sure that they're
P1 29:24right. And that's basically what this is
P1 29:26doing is clarifying, codifying what we
P1 29:28need to do as a city.
P1 29:30>> Yeah. Cuz I was ask cuz I looked and I
P1 29:32saw where you said uh adding locations.
P1 29:36So
P1 29:37where it says adding
P1 29:39>> the the ones I just read off the in
P1 29:41general like other religious
P1 29:43establishments that was not in the
P1 29:44ordinance before. not a specific
P1 29:46location or a specific business, but
P1 29:49where that the amusement redemption
P1 29:52machine shall be shall not be situated
P1 29:54within 300 ft of any church or other
P1 29:57religious establishment, it just
P1 29:59clarifies where they can and cannot be
P1 30:01if somebody were to apply for a permit.
P1 30:03When I when I did when I saw uh when I
P1 30:06looked up the ordinance the the previous
P1 30:08old ordinance uh I think it's on 13503b
P1 30:12and it states that the amusement
P1 30:15machines are only to be located in
P1 30:18commercial district
P1 30:20>> and that didn't change
P1 30:21>> manufacturing but um but then you got
P1 30:25the mixuse.
P1 30:27that's within
P1 30:28>> that could be within those the distance
P1 30:31to those because of where boundary lines
P1 30:34are. You could still be in that zoned
P1 30:36area, but if you're within 300 ft and
P1 30:39fit in there, then it would not be
P1 30:41allowable there.
P1 30:42>> Okay. In uh in the Okay. So, with that
P1 30:45being said, so in a mixed use area, so
P1 30:49how
P1 30:51how is it own? So, in other words, if
P1 30:53you
P1 30:53>> The key to it is
P1 30:55>> okay,
P1 30:55>> it's still got to be zoned as you said.
P1 30:57That didn't change.
P1 30:58>> Okay.
P1 30:59>> But the key to this is up front. It says
P1 31:01situated within 300 ft up there.
P1 31:04>> Oh, a residential area.
P1 31:06>> Correct.
P1 31:08>> Okay. Cuz it's going to be a mixeduse.
P1 31:10So, within 300 ft residential. Okay.
P1 31:14Okay. cuz I was wondering with that
P1 31:15being said, I was wondering if it need
P1 31:17needed to be reszoned or if the
P1 31:22>> No, it's just No, it's got to be in the
P1 31:24zoning that is required according to the
P1 31:26ordinance like you discussed. This is
P1 31:28just adding stipulations to where
P1 31:30>> they can be in relation to that zone.
P1 31:34>> Okay.
P1 31:34>> Because at the edges of that zone you're
P1 31:37talking about, you could have
P1 31:39residential next door, but you can't put
P1 31:41one of these in if it's within 300 ft.
P1 31:43Mhm.
P1 31:44>> Okay.
P1 31:46Any
P1 31:46>> I'll make a motion we approve it.
P1 31:48>> Okay.
P1 31:49>> Second the motion.
P1 31:50>> It's been moved and second. All in
P1 31:52favor?
P1 31:54>> Motion carries.
P1 31:56Brings us to
P1 31:59>> Oh,
P1 31:59>> our executive session.
P1 32:04I need I guess I need to read uh item
P1 32:07five and six will be covered in
P1 32:09executive session.
P1 32:11uh government code section 551071
P1 32:14and government code 551.072

P1 32:21value and recapture of real property
P1 32:24described as for lot one Crockett
P1 32:27Industrial Park phase 1 portion number

P1 33:11Did anyone need to take a break before
P1 33:13the session?
P1 33:16>> All good. It shouldn't be long,
P1 33:18>> huh?
P1 33:19>> It may not be too long. It shouldn't be
P1 33:21that long.
P1 33:21>> I looking at I was like,

P2 0:36from Midland Estates LLC due to default

P2 0:45>> I second her motion.
